What kind of new projects require a start-up permit? How to proceed? **Which department head?
Does your construction permit refer to the start of construction or the start of production? There is a difference. Construction can begin only after all relevant authorities, including the Development and Reform Commission, the Construction Bureau, the Fire Department, the Environmental Protection Agency, and the Work Safety Supervision Bureau, have issued their approval documents ; Theoretically, production can begin after the fire safety, environmental protection, and safety inspections are completed; for projects involving hazardous chemicals, a safety production license must also be obtained from the safety supervision agency before production can start. In practice, it is possible to commence production after completing the fire safety inspections, environmental protection checks, and safety trials, as long as these inspection procedures are finished within the specified time frame.
The main procedures include project feasibility studies, project registration (approval), land use planning permits, land titles, construction project planning permits, project bidding, quality and safety registrations, and then the issuance of the construction permit. Procedure: 1. The applicant shall gather all the necessary documents and go to the service desk at the Construction Bureau to apply for the construction permit; 2. The application materials are accepted by the staff at the window ; 3. Upon review, if the documents are complete, a ‘Construction Permit’ will be issued. IV. Documents to be submitted: 1. The \"Application Form for Construction Permit\" with all required seals affixed (four copies in total; for projects under district jurisdiction, only one copy is required, but it must include an approval note stating \"Approval for commencement of work\" issued by the District Construction Bureau) ; 2. One copy of the “Construction Project Construction Transaction Filing Form” with all stamps applied ; 3. Construction Project Planning Permit ; 4. One copy each of the signed Construction Contract and Supervision Contract ; 5. The ‘Work Safety License’ of the construction enterprise ; 6. Project manager qualification certificate (including project management manual), Safety Production Assessment Certificate Type B, registered supervision engineer certificate, and the Practice Registration Manual for Chief Supervision Engineers in Construction Projects ; 7. Certificate for the registration procedures related to quality supervision of construction projects ; 8. The “Registration Form for Pre-construction Safety Measures in Construction Projects” issued by the Safety Supervision Station ; 9. Noise permit issued by the environmental protection department ; 10. For projects that require bidding, submit the winning bid notice ; 11. For enterprises from outside the region, they must also submit the registration documents obtained from the Shantou City Construction Bureau ; 12. For projects listed in item 9 of the \"Application Requirements,\" a termite control contract must also be submitted. Except for the first item, copies of all the above materials must be submitted simultaneously, with the originals returned after verification.

The project entity has been established. The project organization and management structure, as well as the rules and regulations, are sound. The project manager and members of the management team are in place. The project manager has received training and is qualified to undertake the duties of the position. II. The preliminary design and overall budget of the project have been approved. If the time elapsed from the approval of the project’s total budget estimate to the start of construction exceeds two years (including two years), or if there are significant changes in dynamic factors during that period, resulting in the total investment exceeding the originally approved budget estimate by more than 10%, it is necessary to re-evaluate the project’s total budget estimate. III. The project’s capital funds and other construction funds have been secured; the sources of these funds comply with relevant regulations, the necessary approval procedures have been fulfilled, and they have been recognized by the auditing authorities. IV. The outline for the project construction organization design has been prepared. The specific contents and requirements for preparing the project construction organization design outline are detailed in the attachment (the relevant industry authorities may make adjustments according to actual circumstances). V. The construction contractor for the main project (or key control project) has been selected through bidding, and the construction contract has been signed. VI. The project legal entity and the project design unit have signed an agreement regarding the delivery of design drawings. The construction drawings for the main project (or key control project) should be sufficient to cover the needs of construction for at least three consecutive months. VII. The project construction supervision unit has been selected through bidding. 8. The work related to land acquisition, demolition, and the preparation of the construction site for \"four connections and one leveling\" (i.e., power supply, water supply, transportation, communication, and site leveling) has been completed, and agreements have been reached regarding the necessary external supporting facilities. The construction preparation work for the main project (or key project) has been completed, and the conditions for continuous construction are in place. 9. The main equipment and materials required for the project construction have been ordered; the sources and transportation arrangements for the building materials needed for the project have been secured, and sufficient quantities of materials to enable continuous construction for three months are already available. For equipment and materials that require tendering for procurement, the tendering organization must be established, and the procurement plan must be aligned with the project schedule. ***The relevant competent departments are responsible for inspecting and reviewing the start-up conditions for central projects in their respective industries ; The planning departments of each province (autonomous region, municipality directly under the Central Government) are responsible for examining and reviewing the conditions for the commencement of local projects in their respective areas. For projects submitted to the **Planning Commission for approval to commence construction, it is necessary to attach the inspection opinions on the construction readiness conditions issued by the relevant *** departments or local planning authorities. Construction permits are generally obtained from the local construction bureau, construction department, or the relevant competent authority under ***, depending on the scale and level of the construction project. As for the documents required to obtain a construction permit, requirements may vary from province to province and region to region; it is advisable to consult the local construction authorities.
Is a construction permit mandatory? I haven’t completed the procedures for Phase 152 of my company’s project, but it was brought up during the audit.

Article 10 of the Measures for the Administration of Construction Project Permitting stipulates that those who carry out construction without obtaining a construction permit, or who divide a project into smaller parts in order to avoid obtaining such a permit, shall be ordered by the competent licensing authority to make corrections; those projects that do not meet the conditions for commencement shall be ordered to stop construction, and both the project owner and the construction contractor shall be fined. Furthermore, the absence of a construction permit has a direct impact on aspects such as the start date of the construction period specified in the contract, as well as the liability for delays in commencement caused by the employer.
