Tender Conditions This tender is for the purchase of urea for the desulfurization and denitrification contracting project at Wangtan Site of the Environment Corporation in June 2022. The tendering party is the Wangtan Project Branch of Datang Environment Industry Group Co., Ltd.; the funds for this project come from internal sources, with a 100% capital contribution rate. The project is now ready for bidding, and public bidding is being conducted for it. 2. Bidder Qualification Requirements The bidder must possess the necessary qualifications, capabilities, and reputation to undertake this bidding project. 3.1 The bidder shall be a corporate legal person or other organization with the capacity to perform obligations and assume legal responsibilities, and shall possess a valid business license. 3.2 The bidder must be in good financial condition, not under any order to cease operations, have its assets seized or frozen, or be bankrupt, and must also have sound financial standing. 3.3 Bidders shall meet the following credit requirements: (1) Have good bank credit and commercial reputation ； (2) No acts of fraud, bid rigging, or serious breach of contract have occurred in the past 3 years ； (3) Over the past 3 years, there have been no instances of failure to fulfill obligations after winning the bid, serious violations of contract provisions during the performance period, or significant quality issues with the supplied products in relation to the execution of supply contracts, after-sales service, or product operation ； (4) No major safety accidents have occurred in the past 3 years. 3.4 Bidders shall meet the following qualification and experience requirements: (1) If the bidder is a manufacturer, it must possess the production capacity to meet the quantities specified in this tender, as well as the appropriate qualifications and capabilities for sourcing urea, ensuring quality control, handling transportation, and managing operations; it must also ensure that all activities are carried out in compliance with relevant laws. (2) If the bidder is an agent, a valid authorization document or agreement issued by the manufacturer must be provided. (3) Bidders must provide proof of supply performance showing that they have sold a total of 1,000 tons or more of urea over the past five years (from June 2017 to the present), by submitting copies of sales contracts or other supporting documents that reflect the volume of supplies delivered. (4) In this tender, manufacturers and agents shall not submit bids simultaneously. 3.5 Joint bids are not accepted for this tender. 3.6 Different entities that have the same person in charge or are in a holding or management relationship shall not bid for the same project; otherwise, all such bids shall be invalid. 3.7 Suppliers shall not fall under any of the following circumstances: 3.7.1 Being included in the list of entities prohibited from cooperating with the group company (including those on the blacklist, as well as those whose procurement and bidding activities have been suspended) ； 3.7.2 For construction and service procurement, those that have been included in the **\"blacklist\" for joint disciplinary action against entities with poor safety recordings, as identified by the Ministry of Emergency Management, or in the \"blacklist\" of entities with negative safety records over the past three years (the query website is: https://www.mem.gov.cn/fw/cxfw/xycx/) ； 3.7.3 For similar construction works, equipment, materials, and services purchased, if any major or higher-level liability accidents have occurred within the past three years, the level of such liability accidents is specified in the \"Regulations on the Reporting, Investigation, and Handling of Production Safety Accidents\" ； 3.7.4 Those who have been listed by the court as defendants with dishonesty (search address: http://zxgk.court.gov.cn/shi*n/) or as defendants for whom the current execution proceeding has been terminated (search address: http://zxgk.court.gov.cn/zhongben/), and for whom such designation has not been revoked ； 3.7.5 Those who are included on the list of entities subject to disciplinary action for breach of credit obligations on the official Creditchina website (search address: https://www.creditchina.gov.cn/) or those who are listed as parties involved in serious tax violation cases ； 3.7.6 If the supplier, the legal representative of the supplier, or the project manager is listed on the National Construction Market Supervision Service Platform (search address: http://jzsc.mohurd.gov.cn/) as being on a blacklist, or is included in the list of entities subject to joint disciplinary action for dishonesty, or has a poor record in terms of corporate integrity, or has a poor record in terms of personal integrity ； 3.7.7 Those listed on the **Enterprise Credit Information Publicity System (search address: http://www.gsxt.gov.cn/)** as enterprises with serious violations and dishonesty ； 3.7.8 Financial accounts and major assets have been frozen or seized (search address: http://wenshu.court.gov.cn/) ； 3.7.9.
