To the Development and Reform Commissions, Economic and Trade Commissions, and (Economic Commissions) of all provinces, autonomous regions, municipalities directly under the Central Government, and the Xinjiang Production and Construction Corps: In order to implement the provisions of the “Notice on Standardizing Investment Activities in the Lead and Zinc Industry and Accelerating Structural Adjustment” issued by our commission and eight other departments (Document No. Fa Gai Yun Xing 1898, hereinafter referred to as the “Guiding Principles”) as well as the “Access Requirements for the Lead and Zinc Industry” (**Commission Announcement No. 13 of 2007, hereinafter referred to as the “Access Requirements”), and to accelerate the industrial upgrading of the lead and zinc smelting industry, the following measures regarding the phasing out of outdated production capacities and the management of access regulations in this industry are hereby notified: 1. Formulate plans for phasing out outdated production capacities in the lead and zinc smelting industry. The provincial development and reform commissions (economic and trade commissions, economic commissions) shall, in accordance with the “Guidelines for Industrial Structure Adjustment” (**Commission Order No. 40 of 2005) and the provisions of the “Guiding Principles”, conduct a comprehensive review of outdated production capacities in the lead and zinc smelting sector within their respective regions, and provide a thorough summary of the efforts made to phase out such outdated capacities since 2003. On this basis, a work plan for phasing out outdated lead and zinc smelting capacity in the region during the 11th Five-Year Plan period was formulated. The main contents include: the current situation of the lead and zinc smelting industry in this region as well as the status of outdated production capacity; the achievements, experiences, as well as difficulties and problems encountered in phasing out outdated facilities; the annual plans and specific measures for phasing out outdated facilities during the 11th Five-Year Plan period; and suggestions for carrying out this task effectively. II. Conducting the announcement of enterprises that meet the entry requirements for the lead and zinc smelting industry: In order to leverage the exemplary and guiding role of advanced enterprises, in accordance with the provisions of the Entry Requirements, our commission has decided to announce those enterprises that satisfy the entry requirements for the lead and zinc smelting industry. The main procedures are as follows: (1) The enterprise submits an application for announcement. Lead and zinc smelting enterprises that, based on their own assessment, meet the \"Access Requirements\" shall submit an application for publication and provide the relevant documents in accordance with the procedures and requirements set out in the \"Interim Measures for the Management of Announcements by Lead and Zinc Smelting Enterprises\" (see attachment; hereinafter referred to as the \"Announcement Management\"). (II) The relevant provincial departments receive and verify the applications. The provincial development and reform commissions (economic and trade commissions, economic commissions) are responsible for accepting applications from lead and zinc smelting enterprises in their respective regions to issue announcements. Together with other relevant provincial departments, they verify the materials submitted by these enterprises in accordance with the procedures and requirements outlined in the \"Announcement Management\" regulations, and then submit both their verification opinions and the enterprise-related materials to our commission. (III) **The Development and Reform Commission issues a announcement regarding the enterprises that meet the criteria. Our commission organized units such as the China Non-ferrous Metals Industry Association and relevant experts to review the submitted materials and conduct targeted inspections; after public announcement, the list of enterprises that meet the entry requirements for the lead and zinc smelting industry was published in the form of an official notice. III. Carry out work on phasing out outdated technologies and managing market access with seriousness and responsibility. Given that phasing out outdated technologies and managing market access are important measures for promoting structural adjustment in the lead and zinc smelting industry, all localities must attach great importance to this and carry out the relevant work in a conscientious manner. It is necessary to fully understand the situation of underperforming production capacity in order to prevent underreporting and omissions ; Formulate an elimination schedule in a proactive and cautious manner. It is necessary to carefully verify the announcement application materials submitted by enterprises to prevent fraud. To ensure progress in the work, all relevant parties are requested to submit one copy of the plan for phasing out outdated technologies in the lead and zinc smelting industry (including the attached tables, see Annex 1 and Annex 2) by December 5, 2007. Additionally, they must submit three copies of the verification opinions and related documents regarding enterprises that meet the requirements specified in the announcement to our commission (Economic Operations Bureau) by December 31, 2007.
