Measures for Economic Penalties in Safety Supervision ZD/JZSH 09.07-2007 1 Scope 1.1 These measures are formulated in accordance with relevant regulations issued by higher authorities, in order to ensure the orderly operation of the company’s production, operations, and safety activities. 1.2 These regulations apply to all units affiliated with the company, its employees and visitors, as well as various entities that provide services (including those who come to the factory for construction work, training, visits, official matters, or support activities). 2 Responsibilities 2.1 The Safety Department is responsible for evaluating and assessing the safety work of various units. 2.2 The General Manager’s Office is responsible for organizing inspections to ensure the implementation of the cadre duty system. 2.3 The General Manager’s Office, the Human Resources Department, the Production and Operations Department, and the Enterprise Management and Regulations Department cooperate with the Safety Department in conducting random inspections of labor discipline. 3 Work Procedures and Requirements 3.1 The Safety Department shall impose penalties on entities and individuals that violate these procedures in accordance with them. 3.2 Contents of safety supervision 3.2.1 Contents of labor discipline supervision and penalty measures All new employees must receive thorough education on labor discipline and take an exam; those who fail this education are not allowed to enter the factory or the production facilities. Contracted workers and those undergoing external training must also receive labor discipline education and training in accordance with the standards and requirements for regular employees; moreover, management and supervision efforts should be intensified to address any issues that arise promptly. The principal Party and administrative leaders of each unit are the primary persons responsible for labor discipline management; they are tasked with carrying out education and oversight related to labor discipline within their respective units, keeping records of labor discipline inspections, and including details of such inspections in the duty logs. 3.2.1.1 Any activity performed during working hours that is unrelated to one’s job constitutes a violation of labor discipline. The main manifestations include: a) being late, leaving early, and absenteeism without reason. b. Failing to conduct inspections according to the prescribed methods in a timely manner within the class. c. Drinking before or during shifts, taking baths, getting haircuts, reading magazines or newspapers, playing chess or cards, or engaging in recreational activities during working hours. d. Leaving one’s post, switching positions, dozing off, sleeping, fighting, engaging in personal tasks, arguing or swearing during working hours, as well as bringing cigarettes or flames into the factory. e. Those who give warnings or cover up, conceal information, or provide false testimony when the company inspects labor discipline, or those who lock the doors and pull down curtains during such inspections. f. The duty personnel are not on duty, fail to arrive on time, do not conduct inspections as required, and do not keep a duty log. g. Those who enter the workplace or construction site without wearing personal protective equipment as required. 3.2.1.2 Penalties for violations of labor discipline: The Safety Department issues a notice of disciplinary violation; during the monthly performance evaluation, 20% to 100% of the violator’s total bonus for that month is deducted. Meanwhile, related personnel who are also affected shall have their bonuses deducted according to the following proportions: a) The team leader has 80% of the violator’s bonus deducted from his own salary. b. The duty personnel of the directly affiliated units shall deduct 50% of the bonus of the staff who violate discipline. c. The main Party and administrative leaders of the directly affiliated units and their subordinate units shall deduct 20% of the bonuses of the personnel who have violated discipline. d. If the employee who violates discipline commits serious violations that result in severe consequences, they will be dealt with in accordance with the Regulations on Administrative Penalties for Employee Violations of Discipline. e. For those who violate labor discipline and are dealt with by the company, the secondary units shall not take further action; in cases involving collective responsibility, the penalty shall not be shifted to the individual who violated the rules or to the entire group. f. The penalty deduction methods for disciplining employees, as determined by each unit on its own, may be implemented with reference to these guidelines. 3.2.2 Supervision aspects and penalty measures for work discipline: a) Reading books or newspapers unrelated to work, listening to radios, recorders, or digital devices, watching TV, or playing computer games at the workplace. b. Improper sitting posture, with feet on a stool or workbench ; Chit-chat at the workplace, chatting on office phones. c、Failing to dress appropriately for company meetings. Those who violate the above work discipline shall be fined 20–100 yuan. 3.2.3 Inspection contents and penalty measures for process discipline 3.2.3.1 Process discipline requires that job operation records, shift handover logs, instrument records, technical records, and production chronicles be kept in an orderly manner. 3.2.3.2 The process cards for production units must be posted on the wall. 3.2.3.3 Process changes must go through approval procedures. 3.2.3.4 Interlocks for large units: the safety protection systems must function properly, and there must be proper procedures for disabling them. Assessment: The above provisions shall be implemented in accordance with the relevant regulations of the Technical Development Department, the Production and Operation Department, and the Mechanical Equipment Department. 3.2.4 Inspection contents and penalty measures for operational discipline 3.2.4.1 The stability rate of production unit operations for the current year shall be no less than 98.5%. 3.2.4.2 Violation of process parameters, operating procedures, and operation procedure cards. Assessment: Conducted in accordance with the relevant regulations of the Technical Development Department and the Production Operations Department. 3.2.5 Supervision aspects and penalty measures for construction discipline 3.2.5.1 All construction units must strictly comply with the relevant regulations regarding construction within the production area, and those who violate these regulations shall be punished in accordance with the relevant provisions. 3.2.5.2 The units employing external construction workers and those who receive training on a contractual basis must assign a dedicated person to handle the issuance of temporary access permits. Workers must enter the premises with such permits; those who enter without a permit or with an expired permit will be fined 50 yuan, while their employers will be fined between 100 and 500 yuan. If any violations are detected ; Depending on the severity of the case, a fine of 100 to 500 yuan will be imposed on each person per incident. 3.2.5.3 Strictly implement various work permit systems (work permits for industrial use of fire, electricity, excavation, radiation work, work in confined spaces, maintenance work, etc.), and enforce rigorous approval procedures. 3.2.5.4 All units must strictly manage external construction workers in accordance with relevant regulations; in the event that a construction unit violates these rules, the leaders responsible for supervision of the construction and the safety oversight personnel in the relevant area shall bear management responsibilities, in line with the provisions of 3.2.1.2. Assessment: Those who carry out construction without permits and cause accidents will be severely punished, in accordance with the Accident Management Regulations. 3.2.6 Any unit or individual that violates the following regulations and systems shall be fined between 100 and 1,000 yuan. a. Failing to provide employees with proper safety training, and assigning untrained or those who failed tests to operate the equipment. b. Those who fail to install safety protection devices and safety signs on mechanical equipment as required, or fail to repair them promptly after they are damaged, or are the direct responsible parties. c. Units or the direct responsible persons who fail to properly address the potential hazards and problems identified during safety inspections, despite suggestions from the relevant departments, and fail to do so by the prescribed deadline. d. Unit managers who carry out construction in major and high-risk locations without formulating a construction plan, or whose plans lack safety provisions. e. Those who ignore warnings and proceed with risky operations in violation of regulations ; I do not possess a permit to operate, and I neither engage in myself nor encourage others to carry out work involving special types of operations. f. Ash, cigarette butts, or cigarette packs found within the unit, or a smoking odor detected. g. Failing to install flame arresters on motor vehicles, speeding, driving in violation of regulations, entering production areas without permission, or accessing production facilities or the Xishan tank farm without obtaining the necessary permits. h. Those who enter the Xishan tank farm without going through the required procedures. i. Performing work without obtaining the required work permits (referring to various permits such as those for industrial use of fire and electricity, earthwork, radiation, work in confined spaces, and road occupation). 3.2.7 In the event that outsiders or organizations violate the company’s relevant regulations, resulting in fires, casualties, or damage to equipment, depending on the severity of the situation and the extent of the losses, they shall, in addition to compensating for the economic losses, be fined between 1,000 and 5,000 yuan. 3.2.8 Those who smoke within the factory shall be subject to the “Regulations on Administrative Penalties for Employee Violations”. 3.2.9 The entities and individuals subject to a fine shall submit the amount to the finance department within three days upon receiving the fine notice; starting from the fourth day, a penalty of 10% will be added for each passing day. Those who refuse to pay the fine will have the amount deducted from their final financial settlement. 3.2.10 Each unit shall establish an inspection team, with the main administrative leader of that unit serving as the team leader; the team shall organize two centralized inspections per month (for Shift 1 and Shift 3), while inspections during the day shift are carried out on an ad-hoc basis. The recommendations regarding the results of these inspections must be submitted in writing to the company’s Safety Department by the 7th of each month. The Safety Department uses information on the inspection activities carried out by various units as part of the evaluation criteria at the end of the year. 4 Documents and records generated: Safety inspection ledger B(CX)/JZSH 10.51-01. 5 Inspection and assessment: The Safety Department, the General Manager’s Office, the Human Resources Department, the Production and Operations Department, and the Enterprise Management and Regulations Department cooperate with the Safety Department to conduct inspections and assessments at any time. The assessment results are incorporated into the monthly performance evaluation system in accordance with the measures for economic penalties in safety supervision.
