Understanding of the FORM OF TENDER

Why raise this question? Reason: The original FIDIC documents were translated by seniors like He from Tianjin University; I noticed a few errors in them. Of course, I have no intention of carrying out professional corrections on them – it’s sufficient to read the English version; it’s best not to even look at the Chinese version. But my understanding of FORM OF TENDER at that time was a bit inaccurate; Tian Da translated it as: Bid format. I felt something wasn’t right; after asking a few foreigners, I found out that its meaning was consistent with what Xrayl and PMER said: it’s similar to a COVER LETTER. (However, when our company submits bids, we usually need to write a separate COVER LETTER as well, with content like greetings and expressions of well-being for everyone.) And the meaning of FORM is: a formal document with blanks to be filled in. Therefore, FORM OF TENDER has nothing to do with format. Gentlemen,
1. Having examined the Conditions of Contract, Specification, Drawings, Bill of Quantities and Addenda Nos.____________for the execution of the above-named Works, we the undersigned, offer to execute and complete such Works and remedy any defects therein in conformity with the Conditions of Contract, Specification, Drawings, Bill of Quantities and Addenda for the Sum of _________________________________________________________(_________________) or such other sums as may be ascertained in accordance with the said Conditions.
2. We acknowledge that the Appendix forms part of our Tender.
3. We undertake, if our Tender is accepted, to commence the Works as soon as is reasonably possible after the receipt of the Engineer’s notice to commence, and to complete the whole of the Works comprised in the Contract within the time stated in the Appendix to Tender.
4. We agree to abide by this Tender for the period of _*__________ days from the date fixed for receiving the same and it shall remain binding upon us and may be accepted at any time before the expiration of that period.
5. Unless and until a formal Agreement is prepared and executed,this Tender, together with your written acceptance thereof, shall constitute a binding contract between us.
6. We understand that you are not bound to accept the lowest or any tender you may receive.
