Measures for the Completion Acceptance of Refining and Sales Engineering Construction Projects of China National Petroleum Corporation, Oil Refining and Sales Document No. [2002] 210 Chapter 1 General Provisions Article 1 The completion acceptance of engineering construction projects is the final step in such projects; it represents an important stage for comprehensively evaluating the outcomes of the construction work and checking the design and quality of the project. It holds great significance for maximizing the return on investment in these projects, summarizing experience gained from construction, and continuously improving project management standards. In accordance with the **Plan Commission’s Measures for the Completion Acceptance of Construction Projects (Works)**, and taking into account the actual conditions of project construction in the petrochemical industry, these management measures are specifically formulated. Article 2 These Provisions apply to all new construction, renovation, expansion, and technical improvement projects related to refining facilities, as well as related infrastructure projects, and also to projects related to the storage and transportation of refined oil products, carried out by China National Petroleum Corporation (hereinafter referred to as the Corporation) (hereinafter collectively referred to as refining and sales project initiatives). Article 3: Oil refining and sales project construction projects that are completed in accordance with the provisions of the approved preliminary design documents, reach operational capacity after trial operation, and meet the completion acceptance standards must undergo completion acceptance in a timely manner, and the procedures for handing over fixed assets shall be carried out. Article 4 Basis for completion acceptance. The approved feasibility study reports, preliminary designs, construction drawings, equipment technical specifications for oil refining and sales engineering projects, as well as the current construction technical acceptance standards, along with relevant approval, modification, and adjustment documents from the competent authorities. The introduced engineering construction projects should also be inspected in accordance with the signed contracts, design documents, and other relevant materials. Chapter 2: Completion Acceptance Standards Article 5: For oil refining and sales project construction projects that meet the following conditions, completion acceptance shall be organized in a timely manner. (1) The oil refining production units, auxiliary facilities, utility systems, as well as the necessary living facilities are constructed in accordance with the approved design documents, enabling them to meet the production requirements. After successful trial operation with feedstock, they gain production capacity and can produce qualified products on a continuous basis. The oil depot and gas station construction projects of the sales enterprise have been built in accordance with the approved design documents, enabling normal operations for oil receipt, dispatch, and delivery. (II) After 72 hours of continuous trial operation, the main economic and technical indicators as well as production capacity meet the design requirements ; For engineering construction projects introduced from abroad, production assessments should be carried out in a timely manner in accordance with the contract, and the contract requirements must be met. (III) The production organization, staffing, preparation of production materials, maintenance capabilities, and rules and regulations are all capable of meeting the needs of production. (IV) Environmental protection, occupational safety and health, industrial hygiene, as well as fire protection facilities have been constructed and put into use simultaneously with the main structure in accordance with the design requirements; all relevant indicators meet the standards set out in the **regulations or the design specifications, and they have passed the special inspection by the **competent authorities. (5) The completion documents (including the final accounts) and the documents related to the completion inspection have been compiled in accordance with regulations, and the completion documents have passed the acceptance check by the archives department. (VI) The audit of the final accounts upon completion has been carried out in accordance with relevant regulations. Article 6: For oil refining and sales project construction projects that have not yet met the standards for completion acceptance, the following measures shall be taken according to the actual situation: (1) For some projects that are generally in line with the completion acceptance standards, it is merely the case that certain civil engineering works and a small number of non-key equipment have not been completed as required; however, this does not affect normal production and operations. With the approval of the Oil Refining and Sales Branch, completion acceptance procedures and the handover of fixed assets shall still be carried out. Sufficient funding should be allocated for the remaining work in accordance with the design, and it must be completed within a set time frame. (II) In the initial stage of operation for some engineering construction projects, it may be impossible to achieve the capacity specified in the design due to reasons such as insufficient raw material supply or changes in the composition of the raw materials; however, if production operations proceed normally, approval from the Refining and Sales Branch shall be obtained prior to carrying out the completion acceptance procedures and the handover of fixed assets. (III) For some engineering construction projects or individual projects that have already developed some production capacity but cannot be completed in their full designed scale in the near future, it is necessary to adjust the scale based on actual conditions. After obtaining approval from the Refining and Sales Branch, inspections should be carried out as soon as possible for the completed sections of the project, and procedures for the transfer of fixed assets should be finalized. (IV) For engineering construction projects that allow for phased construction and phased revenue generation, once part of them is completed, as long as the necessary auxiliary facilities are in place to enable the production of qualified products and the operation of the facility can proceed normally, acceptance should be carried out in phases, and the facility should be put into production accordingly; fixed assets should also be transferred at that time, rather than waiting until the entire project is completed before handling everything at once. Article 7: For projects that have met the completion acceptance standards, the procedures for completion acceptance and the handover of fixed assets shall be carried out within six months. If it is indeed difficult to complete the acceptance procedures within this period, an appropriate extension may be granted upon approval by the Refining and Sales Branch. Chapter 3 Classification of Completion Acceptance Levels Article 8 The completion acceptance of oil refining and sales project construction is divided into three levels, namely **level completion acceptance, holding company level completion acceptance, and regional company level completion acceptance. Article 9 **Final acceptance inspection: For projects approved for construction by the **Planning Commission or the **Economic and Trade Commission, the joint-stock company shall submit an application to these commissions so that they can organize the final acceptance inspection ; Or the acceptance can be organized by a joint-stock company commissioned by the **Planning Commission** and the **Economic and Trade Commission**. Article 10: Acceptance at the joint-stock company level: For all oil refining and sales project construction initiatives that fall under the designated scope, that is, construction projects with an investment amount of over 20 million yuan by refining enterprises, as well as oil depot and gas station construction projects whose preliminary designs have been approved by the joint-stock company for sales enterprises, the acceptance shall be carried out by the refining and sales branch company, or such branch company may delegate this task to a regional company. Article 11: Completion acceptance at the regional company level: For all oil refining and sales-related construction projects, that is, projects in which the investment amount by oil refining companies is less than 20 million yuan, as well as storage tank and gas station construction projects for sales companies for which the preliminary design has not been approved by the holding company, the regional company shall be responsible for organizing the acceptance process. Chapter 4 Organization of Completion Acceptance Article 12 The **-level acceptance shall be organized for inspection by the Shareholding Company upon submission to the **Planning Commission or the **Economic and Trade Commission. Article 13: The acceptance at the joint-stock company level is organized by the Refining and Sales Branch. Together with the joint-stock company and various local departments, a completion acceptance committee is formed to oversee all aspects of the project construction. This committee listens to the work summaries submitted by various relevant units, reviews the project completion documents and acceptance materials, inspects the status of the construction and installation work on-site, and provides a comprehensive evaluation of the project’s design, construction, production trials, environmental protection, fire safety, occupational health and safety, industrial hygiene, seismic resistance, energy conservation, as well as the completion documents. Projects that do not meet the standards will not be accepted, and deadlines are set for resolving any remaining issues. Article 13: The completion acceptance committee at the joint-stock company level shall have one chairperson, several vice chairpersons, and several members. The completion acceptance committee shall be composed of representatives from the Refining and Sales Branch, the Planning and Programming Department, the Finance Department, the Audit Department, the Quality, Safety and Environmental Protection Department, the President’s Office, as well as representatives from local departments in charge of environmental protection, health, labor, fire safety, archives, and trade unions. The supervision unit, construction unit, and survey and design unit participate in the acceptance process. Article 14: The acceptance at the regional company level is organized by the regional company to which the project belongs. Its completion acceptance committee or acceptance team is composed of departments such as engineering management, safety and environmental protection, finance, audit, planning, and archives from the regional company; if necessary, local departments responsible for environmental protection, fire control, labor, etc., may be invited to participate, with an appropriately reduced scale. Chapter 5 Contents and Procedures for Completion Acceptance Article 15 The contents of completion acceptance include: (1) Special inspections regarding environmental protection, labor safety and hygiene, occupational safety and hygiene, industrial hygiene, fire protection, as well as the audit of the final accounts for the project. (II) Examine and review the completion documents and completion acceptance documents. (III) Inspect the progress of project construction. (IV) Sign the completion acceptance appraisal report. Article 16 Depending on the scale and complexity of oil refining and sales plant construction projects, the project acceptance can be carried out in two stages: preliminary acceptance and final acceptance, or the final acceptance can be conducted in one go. **Projects subject to acceptance at the division and joint-stock company level are generally inspected in two phases, while projects at the regional company level are accepted in a single step. Article 17 **For projects at the joint-stock company level, once they meet the standards for completion acceptance, the regional company shall organize relevant departments as well as units involved in production, design, and construction to carry out a preliminary acceptance (which can be conducted concurrently with the handover of the completed project). The purpose of this is to assess the quality of the project’s design and construction, to examine the completion documents and those related to acceptance, and to prepare for the final acceptance carried out by the higher-level supervisory authorities. Article 18: After preliminary inspection, the regional companies shall confirm that the project meets the standards for completion acceptance, that all completion documents and records are complete and accurate. They shall also seek the opinions of relevant departments such as those responsible for environmental protection, health, energy conservation, earthquake resistance, fire safety, labor affairs, trade unions, and archives regarding the project to be accepted. Only after going through the necessary procedures in accordance with **relevant regulations shall they submit an application for completion acceptance to the Refining and Sales Branch. Article 19 The procedures for completion acceptance can be divided into the following steps: (1) Hold a preparatory meeting to discuss and establish a completion acceptance committee (or acceptance team), and determine the agenda for the meeting. (II) Listen to and review the report submitted by the regional company regarding the preliminary acceptance of the project. (III) Listening to and reviewing the project completion acceptance report submitted by the regional company ; Summary by the design and construction units on the engineering design and construction progress ; Summary by the production unit on production preparation and commissioning assessment results ; The introduction of complete projects should also include summaries of foreign affairs work, as well as the reception, maintenance, inspection, and transportation of the introduced equipment and materials. (IV) Examine and review the completion documents. (5) Inspect the construction progress on site. (6) Propose requirements regarding the issues identified during deliberation, review, and inspection, and have the regional company organize the construction, production, design, and construction units to implement corrective measures and make arrangements to complete them within a specified time frame. (7) Sign and issue the completion acceptance inspection report. (8) Summarize the completion acceptance meeting. (IX) Revise and officially publish the completion acceptance documents, archive them as required, and submit a copy to the Refining and Sales Branch. (10) The completion acceptance procedures at the regional company level shall be carried out in accordance with the methods for acceptance at the ** and corporate levels, with the relevant procedures may be simplified appropriately. Chapter 6 Special Inspections Article 20 The special inspections prior to the completion inspection include inspections in six areas: environmental protection, labor safety and hygiene, occupational safety and hygiene, industrial hygiene, fire protection, and final account settlement. Article 21: Regional companies must complete the special acceptance procedures prior to organizing the completion acceptance meeting for construction projects in the form of a ** or a joint-stock company. The procedures for sales companies can be appropriately simplified in accordance with **established rules. Special inspections that are not required for the project can be omitted. Article 22 Environmental Protection Acceptance: (1) The environmental protection department in charge of the construction unit (hereinafter referred to as the construction unit) is responsible for contacting the **environmental protection administrative department and handling the procedures for the special environmental protection acceptance of the construction project. (II) During the trial production phase, the project owner shall promptly entrust an environmental testing laboratory recognized by the environmental protection authorities to monitor the pollution emissions generated by the construction project, as well as the performance of the clean production processes and environmental protection facilities, and obtain a \"Testing Report\" issued by such laboratory. (III) The project owner shall prepare the \"Application Report for the Completion Inspection of Environmental Protection Facilities for Construction Projects\" in accordance with the format specified in the annex to **Environmental Protection Bureau Order No. 14, Regulations on the Management of Completion Inspections for Environmental Protection Facilities in Construction Projects». (IV) The construction unit shall, in accordance with the Regulations on the Environmental Protection Management of Construction Projects issued by Decree No. 253 of the State Council, submit an Application Report for the Completion Inspection of Environmental Protection Facilities for a construction project to the environmental protection administrative department that approved the environmental impact report, environmental impact form, or environmental impact registration form for that project, within 3 months as of the date when the project starts trial production, in order to apply for the completion inspection of its environmental protection facilities. (5) The project owner shall promptly address the issues identified during the inspection of the environmental protection facilities, and complete the approval procedures for the \"Application Report for the Completion Inspection of Environmental Protection Facilities in Construction Projects\". Article 23 Labor Safety and Health Inspection: (1) The department in charge of labor safety and health at the project owner’s site (hereinafter referred to as the project owner) is responsible for contacting the **administrative authority for labor safety and health and handling the procedures for the special inspection of labor safety and health related to the construction project. (II) The project owner shall, in accordance with the Provisions on Labor Safety and Health Supervision for Construction Projects (Works) issued by Order No. 3 of the Ministry of Labor, entrust an institution recognized by the labor safety and health administrative authority to conduct inspections of working conditions, classification of the degree of hazard, as well as safety and health inspections and tests of relevant equipment. The operator status of labor safety equipment during the trial operation, the effectiveness of the measures taken, the inspection and test data, existing problems, and the measures implemented shall all be included in a special report on labor safety and health acceptance, which shall then be submitted to the **labor safety and health administrative authority for approval. (III) The construction unit shall promptly address the suggestions regarding labor safety and health that are raised during the inspection, and report the progress of these improvements to the **administrative department in charge of labor safety and health, so as to complete the approval procedures for the labor safety inspection of the construction project. Article 24 Occupational Safety and Health Inspection: (1) The trade union organization of the project owner (hereinafter referred to as the project owner) is responsible for contacting the trade union organization that carries out the occupational safety and health inspection, and handling the procedures related to the special inspection of occupational safety and health for the construction project. (II) The construction unit shall, in accordance with the Notice issued by the General Administration of the All-China Federation of Trade Unions under document No. [1989]8 titled \"Issuance of the Interim Measures on Union Supervision over Occupational Safety and Health Facilities in Production-related Construction Projects\", and in line with the provisions regarding a hierarchical responsibility system for the inspection of such facilities, carefully fill out the \"Form for Inspection and Review of Occupational Safety and Health Conditions in Construction Projects\". It shall also prepare a special report covering the operation of occupational safety and health facilities during trial production, the effectiveness of the implemented measures, testing data, existing problems, and proposed solutions, and submit this application to the trade union organization responsible for conducting the inspection. (III) The construction unit shall promptly address the improvement suggestions and recommendations put forward during the occupational safety and health inspection, and complete the approval procedures for the \"Occupational Safety and Health Inspection Form for Construction Projects\". Article 25 Industrial Hygiene Inspection: (1) The industrial hygiene management department of the project owner (hereinafter referred to as the project owner) is responsible for contacting the **health supervision agency and handling the procedures for the special industrial hygiene inspection of the construction project. (II) The construction unit shall, in accordance with the Guidelines for Health Pre-assessment of Industrial Construction Projects issued by the Ministry of Health under Document No. 28 (1994), submit an application for inspection to the **health supervision agency two months prior to the inspection, while the construction project is in trial production and operational status. It is necessary to fill out the Application Form for Industrial Health Inspection and Assessment for the Completion Inspection of Construction Projects carefully, and provide the required drawings and documents. (III) The construction unit shall contact the health supervision agency to conduct a hygiene investigation and tests for occupational hazard factors at the site in a timely manner, and carry out a hygiene assessment for the completion acceptance of the construction project. (IV) The construction unit shall promptly address the issues raised by the health supervision agency and complete the procedures for obtaining the \"Health Inspection and Approval Certificate for Completed Construction Projects\". Article 26 Fire Inspection and Approval (1) The fire safety management department of the construction unit (hereinafter referred to as the construction unit) is responsible for contacting the **public security fire department and handling the procedures for the special fire inspection of the construction project. (II) The construction unit shall, after the fire protection facilities of the construction project have been completed in accordance with the approved design documents, and taking into account the results of self-inspections of those facilities, prepare a report on the status of the fire protection facilities and submit an application for acceptance to the **public security fire department. (III) The construction unit shall promptly address the issues identified during the fire safety inspection and complete the relevant procedures for fire safety approval. Article 27 Archive Acceptance: (1) The archive management department of the project owner (hereinafter referred to as the project owner) is responsible for contacting the archive management department of the joint-stock company or the local archive administration authority where the project is located, and handling the procedures for the special acceptance of the project’s archives. (II) The project owner shall prepare an archive acceptance report in accordance with the Regulations on the Management of Archives for Construction Projects of China National Petroleum Corporation, issued under Document No. 213 [2001] by the Petroleum Department of the corporation, and submit an application for approval of this report to the corporation’s archive management department or the provincial archive administration department where the project is located. (III) The project owner shall promptly address the issues identified during the archive acceptance process and complete the acceptance procedures for the \"Project Archive Pre-acceptance Form\". Article 28 Final Accounts for Completion of Projects: (1) The financial and audit authorities of the project owner (hereinafter referred to as the project owner) are responsible for contacting the **Audit Office’s local offices (which are in charge of auditing the final accounts for completion of capital construction projects and technical renovation projects funded through **investment), or the audit departments of joint-stock companies (which are responsible for auditing the final accounts for completion of oil refining construction projects and technical renovation projects funded through investments or financing by those companies), or the audit departments of oil refining and sales subsidiaries (which are in charge of auditing the final accounts for completion of sales-related construction projects and technical renovation projects funded through investments or financing by those companies), in order to carry out the audit of the final accounts for the completion of the construction project. (II) The project owner shall prepare the final accounts for the completed construction project in accordance with the relevant regulations set forth by the Ministry of Finance, and submit an audit request to the local office of the National Audit Office or the audit department of the joint-stock company, in line with the \"Measures for Auditing the Final Accounts of Construction Projects issued by the National Audit Office in Document No. Shentoufa [1996] 346\" and the \"Standards for Auditing the Final Accounts of Construction Projects\" issued in Document No. Zhuyou Shenzi [1998] 139. (III) The project owner shall, within the time limits and in accordance with the requirements set by the local offices of the National Audit Office, or the audit departments of joint-stock companies and their refining and sales subsidiaries, provide documents approving the project construction, audit documents, records of all budget adjustments, contract agreements and settlement information, contracts and lists related to equipment and major materials purchased by the project owner itself, as well as records of their receipt and dispatch, information on significant design changes, progress reports and financial statements from the start of project construction, final settlement statements for the project, and other documents related to financial transactions. (IV) The construction unit shall obtain an \"Audit Opinion Letter\" issued by the Local Office of the National Audit Office, or the audit department of the joint-stock company, or the audit department of the refining and sales subsidiary, or a \"Audit Decision\" issued by them. (5) For projects commissioned by a joint-stock company, the audit may be carried out by the audit department of the regional company. Chapter 7 Requirements for Completion Documents and As-Built Acceptance Documents Article 29 The completion documents for a construction project refer to the document materials that need to be archived throughout the entire process of such a project, from its initiation, approval, survey, design, construction, production preparation to its commissioning for operation, as well as audio-visual materials on other media. Completion documents are important technical records for construction projects; they serve as a basis for normal operation, maintenance, repair, renovation, or expansion after the project is put into use. These documents must be complete, accurate, and systematic. Article 30: The completion documents must correspond to the actual conditions of the project, and they should be compiled and formed during the construction process to ensure their authenticity, truthfulness, and accuracy. A strict responsibility system for the preparation and review of completion documents must be implemented; the signing procedures must be complete, the specifications must meet the requirements regarding technical archives, the handwriting must be clear, and the drawings must be neat. It is not allowed to use writing materials or drawing tools that tend to fade easily. Article 31 The completion documents for engineering construction projects include seven categories of content: preliminary work documents, survey and design documents, project management documents, construction documents (handover technical documents), as-built drawings, documents related to commissioning trials and trial production evaluations, and final settlement documents. Article 32 Preliminary work documents (1) Project proposal and approval documents ; (II) Feasibility study report and approval documents ; (III) Environmental Impact Assessment Report and Approval Documents ; (IV) Pre-evaluation report on labor safety and health and approval documents ; (5) Feasibility study report on occupational safety and health facilities and approval documents ; (VI) Materials on industrial hygiene in the feasibility study report. Article 33 Survey and design documents (1) Design basis documents 1. Engineering geology, hydrogeology, survey and design information, survey reports, geological maps, survey records, laboratory tests, and test reports ; Important soil and rock samples and descriptions ; 2. Topography, geomorphology, control points, buildings, structures, and measurement and positioning for the installation of important equipment, along with observation records ; 3. Other design basis data such as hydrology, meteorology, and seismology ; 4. Material property data. (II) Design documents 1. Approval and adjustment documents for the preliminary design (including cost estimate) ; 2. Design calculation sheet ; 3. Overall planning design ; 4. Patent technical documents. Article 34 Project management documents: (1) Documents related to land expropriation: including the approval documents for land expropriation and the boundary maps, as well as the agreements regarding demolition and compensation ; (II) Agreements and relevant documents signed with external entities: including documents related to power supply, water supply, gas supply, provision of raw materials, fuel, and product sales, as well as transportation agreements; in addition, there are also documents related to agreements concerning the passage of projects through railways, roads, power transmission lines, and rivers ; (III) Bidding documents and materials, as well as project contracting contracts and agreements (including those related to design, construction, project supervision, and procurement of equipment and materials) ; (IV) Approval of the project commencement report and relevant documents such as construction permits ; (5) Materials such as the overall deployment for project construction and the overall network plan ; (VI) Engineering construction supervision documents. Article 35 Construction documents (refer to the technical documents accumulated in accordance with **current construction acceptance standards, or known as handover technical documents) (1) Commencement report ; (II) Design change documents: including design change notices, project coordination forms, material substitution forms, and records or minutes of design drawing reviews ; (III) Foundation treatment records and acceptance documents ; (IV) Records of concealed works and inspection documents ; (5) Factory departure and inspection documents for materials and components: such as factory certificates of conformity, material certification, test and inspection reports, etc. (Copies are acceptable for bulk materials, but the application location must be indicated) ; (VI) Equipment inspection documents: such as factory certification, user manual, inspection records prior to leaving the factory and during installation, etc. (Copies are acceptable for batch of equipment, but the application location must be indicated) ; (7) Civil engineering construction documents: such as foundation inspection records, concrete construction records, anti-corrosion and fire protection construction records, furnace construction records, lining construction records, etc ; (8) Documentation for equipment and pipeline installation projects: such as installation records, pressure testing records, flaw detection reports, and other related documents ; (IX) Installation documents for electrical, communication, instrumentation, and automatic control systems: such as installation records, inspection, testing, and commissioning records, etc ; (10) Measurement results data: such as tables of elevation, azimuth, and level measurement results, settlement observation records, etc ; (11) Commissioning data: such as records of individual unit commissioning, system commissioning, and coordinated commissioning, etc ; (12) Materials for project quality assessment ; (13) Certificates of project handover and acceptance for individual projects (or unit projects), etc ; (14) Completion report ; (15) Others: In the event of quality accidents during construction, a \"Quality Accident Handling Report\" should be prepared; in case of significant issues, it is necessary to describe those issues along with the proposed solutions and actions to take ; (16) Construction documents shall be compiled and filed by unit project. Article 36 As-built drawings: As-built drawings are an important part of the completion documents. They must be complete and accurate, and should include all the construction drawings (except for general drawings and standard drawings). It is necessary to ensure that the as-built drawings are in agreement with the design change documents and the records of concealed works, achieving a \"three-way alignment\". (1) Source of as-built drawings: 1. The construction drawings that were not altered during construction, stamped with the “As-Built Drawing Special Seal”” ; 2. For construction drawings that have undergone some changes during construction, the modifications can be made directly on the original drawings; the modified sections should be stamped with the \"As-Built Drawing Approval Stamp\", while the entire drawing, after all modifications, should be stamped with the \"Special Stamp for As-Built Drawings\"” ; 3. For construction drawings that have undergone significant changes, as-built drawings must be redrawn and stamped with the “As-Built Drawing Special Seal”. (II) When preparing the as-built drawings, changes from the original construction drawings should follow the principle of \"ten changes\" and \"seven no-changes\", as detailed below: The \"ten changes\" refer to the situation where, for concealed works, important equipment, pipelines, reinforced concrete structures, etc., if the differences resulting from construction exceed the limits permitted by the standards, such changes must all be reflected in the as-built drawings. Including: 1. Vertical layout and ground/road elevations ; 2. Plan layout and coordinates of factories, installations, buildings, pipelines, and roads ; 3. Mechanical equipment for processes, thermology, electricity, HVAC, etc ; 4. Pipe diameter, thickness, material, and pipe connection method (for changing the flow path) ; 5. Wiring methods, routing, and cross-section of electrical and telecommunications equipment ; 6. Automatic control methods and equipment ; 7.
