Chapter 1 General Provisions Article 1 This agreement is formulated in accordance with the Labor Law of the People’s Republic of China and relevant laws and regulations, in order to ensure the safe operation of pressure pipelines and protect the lives and property of the people. Article 2: The pressure pipelines referred to in these regulations are special equipment used in production and daily life that may pose significant risks such as fires, explosions, or poisoning. Pressure pipelines are classified into industrial pipelines, utility pipelines, and long-distance pipelines according to their uses. Article 3 These provisions apply to pipelines and their auxiliary facilities that meet one of the following conditions: (1) Pipelines that transport media with an extreme hazard level as specified in GB5044 \"Classification of Hazards from Occupational Exposure to Toxic Substances\" ; (II) Pipelines for transporting media with fire hazard classification of Class A or B as specified in GB50160 \"Code for Fire Protection Design of Petrochemical Enterprises\" and GBJ16 \"Code for Fire Protection Design of Buildings\" ; (III) Pipelines with a maximum operating pressure of 0.1 Mpa or more (gauge pressure; the same applies hereafter), and whose transport medium is gas or liquefied gas ; (IV) Pipelines with a maximum operating pressure of 0.1 Mpa or more, in which the fluid being transported is flammable, explosive, toxic, corrosive, or a liquid whose maximum operating temperature is equal to or above its boiling point ; (5) The auxiliary facilities and safety protection devices for the pipelines specified in the preceding four items. Article 4 These provisions do not apply to the following pipelines ; (1) Pipelines belonging to the equipment itself ; (II) **Pipes in equipment, vehicles, and nuclear installations ; (III) Pipelines for transporting non-toxic, non-flammable, and non-corrosive gases, with a nominal diameter of less than 150 mm and a maximum operating pressure of less than 1.6 Mpa ; (IV) The domestic gas pipelines prior to the last valve before entering the building (residential building, courtyard), as well as the heating pipelines downstream of the heating points (excluding the heating points themselves). Article 5: Units responsible for the design, manufacturing, installation, use, inspection, and repair/renovation of pressure pipelines must comply with these provisions. The competent authorities in charge of the design, manufacturing, installation, use, inspection, and repair/maintenance of pressure pipelines shall be responsible for the safety management of pressure pipelines in their respective enterprises. Article 6: The boiler and pressure vessel safety supervision agency under the Ministry of Labor is responsible for the safety supervision of pressure pipelines. The agencies responsible for the supervision of boiler and pressure vessel safety, which are under the jurisdiction of the labor administrative departments at or above the county level, are in charge of overseeing the safety of pressure pipelines within their respective administrative areas. Chapter 2 Safety Management Article 7 The relevant competent departments shall perform the following duties: (1) Implement relevant safety laws, regulations, as well as technical specifications and standards for pressure pipelines, and establish and improve various safety management systems for pressure pipelines within their respective departments ; (II) Organize the review and approval, in accordance with relevant regulations, of the designs for newly built, renovated, or expanded pressure management projects within the department; supervise and inspect the construction quality; and organize the completion acceptance ; (III) Formulate annual and long-term plans for pressure management and safety control within the department; organize and assist relevant units in conducting inspections, safety assessments, and corrective actions regarding potential major accidents involving pressure pipelines, in order to eliminate such risks and ensure safety ; (IV) Report pressure pipeline accidents in a timely manner in accordance with relevant regulations, and participate in or organize accident investigations and handling ; (5) Be responsible for organizing safety inspections, evaluations, and assessments of pressure pipelines within the department, recognizing those who excel, and summarizing as well as exchanging experiences related to the safe operation of pressure pipelines ; (VI) Organize research and promotion of advanced safety science and technology as well as safe production management methods for pressure pipelines ; (7) Carry out publicity and education on the safety of pressure pipelines, and be responsible for organizing training for personnel in charge of pressure pipeline safety ; (8) Other pressure pipeline safety management tasks for which responsibility is required according to relevant regulations. Article 8 The user of pressure pipelines is responsible for the safety management of such pipelines within its own organization, and shall fulfill the following duties. (1) Implement relevant safety laws, regulations, as well as technical specifications and standards for pressure pipelines, and establish and improve the unit’s safety management system for pressure pipelines ; (II) There should be full-time or part-time professional technical personnel responsible for the safety management of pressure pipelines ; (III) Pressure pipelines and their safety facilities must comply with the relevant **regulations ; If newly constructed, renovated, or expanded pressure pipelines and their safety facilities do not comply with **relevant regulations, approval for acceptance may be denied ; (IV) Establish a technical file and register it with the labor administrative department at the district (city) level where the enterprise is located, or with the county-level department designated by it ; (5) Provide safety and technical training for pressure pipeline operators and inspectors ; (VI) Formulate a regular inspection plan for pressure pipelines, and arrange for the periodic calibration and maintenance of auxiliary instruments, safety protection devices, and measurement and control devices ; (7) Measures should be taken promptly to rectify potential accident hazards; major potential accident hazards must be reported in writing to the competent authorities at or above the provincial level (including the provincial level) as well as the labor administration departments at or above the provincial level ; (8) For pressure pipelines transporting flammable, explosive, or toxic media, a system for regular inspections of the pipelines should be established, emergency measures and rescue plans should be developed, emergency response teams should be formed as needed, and regular drills should be conducted ; (IX) Report pressure pipeline accidents to the competent authorities and local labor administrative departments in a timely and truthful manner in accordance with relevant regulations, assist in the investigation of such accidents and the handling of subsequent matters, carefully summarize the lessons learned, and take measures to prevent such accidents from occurring ; (10) Other pressure pipeline safety management tasks required by relevant regulations. Article 9: Managers, inspectors, and operators of pressure pipelines shall strictly abide by relevant safety laws, regulations, technical specifications, standards, as well as the enterprise’s safety production systems. Chapter 3 Safety Supervision Section 1 General Provisions Article 10 The design unit for pressure pipelines shall obtain a design qualification certificate issued by the relevant competent department at the provincial level or above, and file it with the labor administrative department at the provincial level or above. The pressure pipeline design unit shall be responsible for the safety and technical performance of the designed pressure pipelines. Article 11: Manufacturers of products such as pipes, fittings, valves, flanges, compensators, and safety protection devices used in pressure pipelines (hereinafter referred to as manufacturers) shall apply for safety registration with the labor administrative department at the provincial level or above, or with the labor administrative department at the prefecture/city level authorized by such a provincial department. The review of secure registrations is carried out by the Ministry of Labor in conjunction with evaluation agencies recognized by the relevant competent departments at the same level. The manufacturing unit shall be responsible for the safety and quality of its products. Type tests shall be conducted before the product is put into production. The Ministry of Labor is responsible for the qualification assessment and approval of type testing institutions, and issues certificates for such institutions. Article 12: Pressure pipeline safety organizations must hold a pressure pipeline installation license issued by the labor administrative department. The evaluation for the accreditation of pressure pipeline installation units is carried out by labor administration departments in conjunction with evaluation agencies recognized by the relevant competent authorities. The pressure pipeline installation approval certificate is printed uniformly by the Ministry of Labor and issued respectively by the Ministry of Labor and the provincial labor administrative departments. The pressure pipeline installation unit shall be responsible for the safety and quality of the pressure pipeline projects it installs. Article 13 Pressure pipelines that are newly constructed, expanded, or renovated shall have their installation quality supervised and inspected by qualified inspection units ; Pressure pipelines in use shall be subject to regular inspections by qualified inspection units. The qualification review of testing units shall be conducted in accordance with the provisions of Articles 25 and 28 of these regulations. Article 14: Pressure pipeline repair and modification units must meet certain requirements; when carrying out major modifications to pressure pipelines, their technical and management standards shall be consistent with those required for newly constructed pressure pipelines. Article 15 Welders who work on pressure pipeline welding and inspection personnel engaged in non-destructive testing must obtain qualification certificates for special operation workers issued by the labor administrative department in accordance with relevant regulations. Article 16: The labor administration department shall conduct safety inspections on units responsible for the design, manufacturing, installation, use, inspection, and repair/modification of pressure pipelines in accordance with these regulations, and determine the methods for on-site safety inspections based on the actual conditions of the region. Article 17: Labor administrative departments shall conduct statistics, reporting, and handling of accidents in accordance with relevant regulations. Section 2 Safety Supervision of Industrial Pipelines Article 18 Industrial pipelines are classified according to their degree of hazard, and safety supervision is carried out based on such classification. Article 19: When a using unit designs industrial pipelines on its own, it must obtain approval from its provincial competent authority and file the design with the provincial labor administration department. Article 20: Units that install industrial pipelines on their own must obtain approval from their provincial competent authorities and register with the provincial labor administration department. Section 3: Safety Supervision of Public Pipelines Article 21: The construction of public pipelines must comply with urban planning, fire protection, and safety requirements. During the review of line selection, consent from the local labor administration department must be obtained. Article 22: The design review and completion inspection of public pipeline projects shall involve safety inspectors dispatched by the local labor administration department. Article 23 No unit or individual shall construct buildings, structures, or pile up items on public pipelines. Article 24: The supervision of the safety of long-distance pipelines is the responsibility of the Ministry of Labor. Personnel engaged in the safety supervision of long-distance pipelines are trained, assessed, and certified by the Ministry of Labor, and they are accountable to the Ministry of Labor for their work. Article 25: Inspection units for long-distance pipelines must meet the appropriate requirements. The qualification assessment of such units is carried out jointly by the Ministry of Labor and the relevant competent departments at the same level, while the inspection qualification certificates are issued by the Ministry of Labor. Article 26 Before the installation work of newly built, expanded, or renovated long-distance pipelines begins, the construction unit shall file a record with the Ministry of Labor. Safety inspectors dispatched by the Ministry of Labor should be present at the completion inspection of the project. Chapter 4 Inspection Entities Article 27 Entities engaged in the inspection of industrial pipelines and utility pipelines shall meet certain requirements and obtain the corresponding inspection qualifications in accordance with the provisions of these regulations. Article 28: The qualifications of inspection units for industrial pipelines and utility pipelines affiliated to departments at the provincial level or above shall be reviewed by the Ministry of Labor in conjunction with the relevant departments at the same level. Article 29 Pressure pipeline inspectors must pass assessments organized by labor administrative departments at or above the provincial level and obtain the corresponding qualification certificates. Article 30: Inspection agencies and inspectors must carry out inspection work within the scope permitted by their respective qualification certificates. The testing laboratory shall be responsible for the accuracy of the test results it provides. Article 31: Inspection agencies responsible for the safety supervision and inspection of pressure pipelines, as well as for import and export inspections, shall maintain an impartial third-party status. Inspection units and their personnel engaged in supervision and inspection shall not be involved in the design, manufacturing, installation, repair, or modification of pressure pipelines, nor in any related distribution activities. Article 32: Inspection agencies and inspectors shall keep the trade secrets of the inspected entities confidential. Article 33 Inspection agencies and inspectors shall be subject to supervision, inspection, and professional guidance by the labor administrative department. Article 34: Inspection agencies engaged in the inspection of pressure pipelines shall charge inspection fees in accordance with the relevant fee-setting regulations. Chapter 5 Penalties Article 35 In any of the following circumstances, the labor department shall order rectification and may impose a fine: (1) A pressure pipeline design unit that has not gone through the registration procedures designs pressure pipelines ; (II) Manufacturers of pipes, fittings, valves, flanges, compensators, and safety devices for pressure pipelines that have not gone through the safety registration procedures ; (III) Installation of pressure pipelines by installation units that have not applied for a pressure pipeline installation license ; (IV) Pressurized pipelines that are newly constructed, expanded, or renovated and put into operation without undergoing supervision inspection and passing the completion acceptance are used illegally ; (5) Use of pressure pipelines by user units that have not completed the registration process for such pipelines ; (VI) Units that do not possess the qualifications for inspecting pressure pipelines engaging in such inspection work ; (7) The user unit fails to conduct regular inspections on pressure pipelines in accordance with relevant regulations. Article 36: Pressure pipeline inspectors, non-destructive testing personnel, and welders who fall under any of the following circumstances shall be ordered by the labor administration department to make corrections; they may also be fined. In cases where the circumstances are serious, their qualification certificates may be temporarily seized or revoked ; (1) Those working without a valid license; (2) Those performing pressure pipeline inspection, welding, or non-destructive testing tasks beyond the scope permitted by their qualification certificates. Article 37: In any of the following circumstances, the labor administration department shall order the party concerned to make corrections and may impose a fine; in cases of serious violations, its qualification certificate may be temporarily seized or revoked. Those who cause economic losses to the using unit or other entities shall bear corresponding economic compensation liability; if a crime is committed, criminal liability shall be pursued in accordance with the law ; (1) Accidents resulting from safety and quality issues in pressure pipelines due to the faults of the units responsible for their design, manufacture, and installation ; (II) Accidents caused by missed inspections, incorrect inspections, or wrong judgments on the part of the pressure pipeline inspection units ; (III) Accidents occurring to pressure pipelines due to poor management by the user entity. Article 38: The amounts of the fines specified above shall be determined in accordance with relevant regulations. Chapter 6 Supplementary Provisions Article 39 Terms used in these provisions: (1) Industrial pipelines refer to the process pipelines, utility pipelines, and other auxiliary pipelines owned by enterprises and institutions and used for transporting process media. (II) Public pipelines refer to gas pipelines and heat pipelines used for public services or domestic purposes within urban or rural areas. (III) Long-distance pipelines refer to pipelines used for transporting commodity media between sources, storage facilities, and users. Article 40: The design and acceptance of pressure pipelines in domestically introduced equipment may be carried out in accordance with the specifications or standards stipulated in the agreement, provided that the important safety technical requirements shall not be lower than those specified in China’s relevant regulations. Article 41: The measures for the supervision and management of the import and export of pipes, pipe fittings, valves, flanges, compensators, auxiliary instruments and meters, and safety protection devices used in pressure pipelines shall be formulated separately by the Ministry of Labor. Article 42: The safety management and supervision of domestic gas pipelines located after the final valve before entry into a building (residential building, courtyard) shall be regulated separately. Article 43 These provisions shall come into force as of July 1, 1996.
