Article 5: Production and business entities that hold positions related to safety management and safety engineering technology, as well as intermediary organizations that provide technical services for safety production, must have a certain number of Certified Safety Engineers on staff. 　　Article 6: Authorized by the **Economic and Trade Commission**, the **Production Supervision and Administration Bureau** is responsible for carrying out the tasks related to the practice qualification system for registered safety engineers. 　　Article 7: The Ministry of Human Resources and **Production Supervision and Administration Bureau are responsible for formulating policies, organizing coordination, conducting qualification examinations, handling registration, and providing supervision and management for the national professional qualification system for registered safety engineers. Chapter 2 Exams Article 8: The professional qualification for registered safety engineers is assessed under a national unified syllabus, with unified examination questions and organized on a national scale; in principle, the exams are held once a year. 　　Article 9: The **Production Supervision and Administration Bureau is responsible for determining the examination subjects, drafting examination syllabuses, preparing examination materials, organizing question-setting, and uniformly planning pre-examination training and other related matters. 　　Pre-exam training is carried out on the principle of separating training from examinations and on a voluntary basis. 　　Article 10: The Personnel Department is responsible for determining the examination subjects, syllabi, and test questions, as well as organizing the administration of the examinations. Together with the **Production Supervision and Administration Bureau, it conducts inspections, supervision, guidance regarding the professional qualification examination for registered safety engineers, and determines the passing standards. 　　Article 11: Any citizen of the People’s Republic of China who abides by **laws and regulations and meets one of the following conditions may apply to take the Qualification Examination for Registered Safety Engineers: (1) Having obtained a secondary vocational education degree in safety engineering or engineering economics, and having been engaged in work related to work safety for at least 7 years ； Or hold an equivalent secondary vocational diploma in another field, with 9 years of experience in work related to safety production. 　　(II) Hold an associate degree in safety engineering or engineering economics, and have at least 5 years of experience in work related to safe production ； Or hold an associate degree from another specialized university, with at least 7 years of experience in work related to safe production. 　　(III) Hold a bachelor’s degree in safety engineering or engineering economics, and have at least 3 years of experience in work related to safe production ； Or hold a bachelor’s degree from another specialized university, with at least 5 years of experience in work related to safe production. 　　(IV) Hold a second bachelor’s degree in safety engineering or engineering economics, or have graduated from a postgraduate program, and have at least 2 years of experience in work related to safe production ； Or have obtained a second bachelor’s degree in another field or graduated from a graduate program, with at least 3 years of experience in work related to safe production. 　　(5) Hold a master’s degree in safety engineering or engineering economics, and have at least 1 year of experience in work related to safe production ； Or hold another professional master’s degree and have at least 2 years of experience in work related to safe production. 　　(VI) Obtain a doctoral degree in safety engineering or engineering economics ； Or hold a doctoral degree in another field, with at least 1 year of experience in work related to safe production. 　　Article 12: Those who pass the Qualification Examination for Registered Safety Engineers shall be issued the \"Certification of Registered Safety Engineer of the People’s Republic of China\", which is printed uniformly by the Ministry of Human Resources and Social Security and stamped by both the Ministry of Human Resources and Social Security and the **Work Safety Supervision Administration, by the human resources departments of the respective provinces, autonomous regions, and municipalities directly under the Central Government. This certificate is valid nationwide. Chapter 3 Registration Article 13 A registration system is implemented for registered safety engineers. Those who have obtained the \"Practice Qualification Certificate for Registered Safety Engineers of the People’s Republic of China\" must go through registration before they can practice in the capacity of registered safety engineers. 　　Article 14: **The Production Supervision and Administration Bureau or its authorized agencies are the authorities responsible for registering the professional qualifications of registered safety engineers. The work safety supervision and management departments of various provinces, autonomous regions, and municipalities directly under the Central Government serve as the agencies responsible for the preliminary review of applications for the professional qualification of registered safety engineers. 　　Article 15: The Ministry of Human Resources and the human resources administrative departments at all levels are responsible for inspecting and supervising the registration and use of the professional qualifications for registered safety engineers. 　　Article 16: Applicants for registration must meet all of the following conditions: (1) Hold a Professional Qualification Certificate for Registered Safety Engineers of the People’s Republic of China. 　　(II) Abide by laws and regulations, and uphold professional ethics. 　　(III) Be in good health, and able to continue working in positions related to safety management, safety engineering technology within production and business units, or in intermediary organizations that provide technical services for safety production. 　　(IV) Pass the assessment by the employer. 　　Article 17: Those who have obtained the professional qualification certificate for registered safety engineers and wish to be registered shall submit an application on their own initiative. With the approval of their employer, the application is submitted to the local provincial work safety supervision and management department for preliminary review. Upon passing this review, it is forwarded to the **Work Safety Supervision Bureau or an institution authorized by it to carry out the registration procedures. 　　To applicants approved for registration, the **Production Supervision and Administration Bureau or an institution authorized by it issues the ‘Registration Certificate for Certified Safety Engineers of the People’s Republic of China’. 　　Article 18: The validity period of the professional qualification registration for registered safety engineers is generally 2 years. Three months before the expiration of this period, the holder shall go to the original registration authority to proceed with the re-registration procedures. 　　Those registering again must, in addition to meeting the requirements stipulated in Article 16 of these regulations, also provide proof of having received continuing education and participated in professional training. 　　Article 19: During the validity period of their registration, if a registered safety engineer changes their practice institution, they must promptly apply to the registration authority to go through the change procedures. 　　Article 20: After registration, if a registered safety engineer falls under any of the following circumstances, their employer shall proceed to cancel their registration with the registration authority: (1) Having been away from safety-related job duties for a continuous period of 1 year. 　　(II) Lacking full capacity for civil conduct. 　　(III) Subject to criminal punishment. 　　(IV) Serious violation of professional ethics. 　　(5) Practicing in 2 or more independent legal entities simultaneously. 　　Article 21: **The Production Supervision and Administration Bureau or its authorized agencies shall regularly publish information on the registration and cancellation of the professional qualifications of registered safety engineers. Chapter 4 Responsibilities Article 22 Registered safety engineers may practice in positions such as safety production management, safety inspection and supervision, safety technology research, safety engineering technology testing and inspection, identification of safety characteristics, and safety assessment of construction projects within production and business entities, as well as in intermediary organizations that provide technical services for safety production. 　　Article 23: In the course of their professional activities, registered safety engineers must strictly abide by laws, regulations, and various rules, uphold principles, and adhere to professional ethics. 　　Article 24 Registered safety engineers shall enjoy the following rights: (1) To submit opinions and suggestions regarding the issues existing in the work of production and business operation entities in areas such as safety management, safety supervision and inspection, safety technology research, safety testing and inspection, safety assessment of construction projects, hazard identification, or risk assessment. 　　(II) Review the reports on work safety submitted by the affiliated unit. 　　(III) In the event of an emergency that endangers personal safety, it is necessary to promptly advise the production and operation unit to cease operations and organize the workers to evacuate from the dangerous area. 　　(IV) Participate in the review of safety facilities for construction projects and the final acceptance procedures, and provide opinions. 　　(5) Participate in the inspection, assessment, and monitoring of major hazard sources, as well as in the development of accident emergency plans and the maintenance of related records. 　　(VI) Participate in the formulation of safety rules, as well as in the establishment of safety production regulations and operating procedures, and submit suggestions regarding the financial resources necessary to meet safety production requirements. 　　(7) Other rights stipulated by laws and regulations. 　　Article 25 Registered safety engineers shall fulfill the following obligations: (1) Comply with **the laws, regulations, and standards related to work safety. 　　(II) Abide by professional ethics, practice objectively and fairly, avoid fraud, and assume legal responsibility for signing opinions on relevant reports. 　　(III) Protect the interests of ** and the public, as well as the legitimate rights and interests of the employing entity. 　　(IV) Strictly safeguard the technical and commercial secrets of entities and individuals learned about in the course of practice. 　　Article 26: Registered safety engineers shall regularly receive professional training to continuously update their knowledge and improve their professional skills. Chapter 5 Penalties Article 27 Where a registered safety engineer violates the laws, regulations, and relevant provisions regarding production in the course of his work, administrative liability shall be imposed on him in accordance with the law, corresponding penalties shall be given, and in severe cases, criminal liability shall be pursued. 　　Article 28: If a registered safety engineer commits any of the following acts, the registration authority shall, depending on the severity of the offense, impose sanctions such as a warning, cancellation of registration, or revocation of professional qualifications ； If a crime is committed, criminal liability shall be pursued in accordance with the law: (1) Those who obtain the \"Practice Qualification Certificate for Registered Safety Engineers of the People’s Republic of China\" or the \"Registration Certificate for Registered Safety Engineers of the People’s Republic of China\" by improper means. 　　(II) Failing to go through the registration or change-of-registration procedures as required, and arbitrarily undertaking safety engineering and work safety management tasks in the name of a registered safety engineer. 　　(III) Allowing others to engage in the work of a registered safety engineer in one’s own name. 　　(IV) Causing major or extremely serious accidents, or significant economic losses, due to work mistakes. 　　(5) Using one’s position for the purpose of embezzlement, extorting bribes, accepting bribes, or obtaining improper benefits. 　　(6) Colluding with the client or deliberately issuing false certificates or safety technical reports. 　　(7) Other acts for which punishment is required according to laws and regulations. 　　Article 29: Where a registered safety engineer causes losses to a party due to negligence in the course of practice, the entity to which he or she belongs shall bear the liability for compensation. After the entity makes the compensation, it may, depending on the circumstances, recover part or all of the compensation costs from it. 　　Article 30: If a party is dissatisfied with a sanction or penalty, they may apply for administrative reconsideration or file a complaint in accordance with the law. Chapter 6 Supplementary Provisions Article 31: For those who have obtained the professional qualification certificate for registered safety engineers, their employers may appoint them to professional and technical positions such as engineer or economist, depending on the needs of the work. 　　Article 32: Prior to the implementation of the professional qualification examination for registered safety engineers nationwide, individuals who have long been engaged in work related to safety management and safety engineering technology in production and operation units as well as entities that provide technical services for safe production, possess a high level of theoretical knowledge and extensive practical experience, and hold senior professional and technical positions, may obtain the professional qualification certificate for registered safety engineers through an assessment and certification process. 　　Article 33: The specific measures for the management of the qualifications of employees engaged in work related to safety production management, safety engineering technology, and intermediary agencies that provide technical services for safety production within production and business operations shall be formulated by the personnel departments (bureaus) of each province, autonomous region, and municipality directly under the Central Government in conjunction with the departments responsible for safety production supervision and management. 　　Article 34: With the approval of the relevant departments of the State Council, foreign nationals and professionals from Hong Kong, Macao, and Taiwan who are permitted to work within the People’s Republic of China may also apply to take the exam for Certified Safety Engineers and seek registration to practice, provided that they meet the requirements set out in these regulations. 　　Article 35: These provisions shall be interpreted by the Ministry of Personnel and the **Production Supervision and Administration Bureau in accordance with their respective responsibilities. Article 36 These provisions shall come into force 30 days after the date of issuance. Measures for the Recognition of Professional Qualifications for Registered Safety Engineers I. Application Requirements Those who have been engaged for a long time in work related to safety management, safety engineering technology testing and inspection, safety assessment, or safety consulting in production and operation units as well as organizations that provide technical services for safety production, who have achieved outstanding results, hold senior professional and technical positions, and meet the following conditions may apply for recognition of their professional qualifications as registered safety engineers: (1) Comply with all laws and regulations, and have a passion for safety production and related tasks. 　　(II) Persons who, prior to December 31, 2001, held senior professional and technical positions in safety production management, safety engineering technology, or in roles involving the provision of safety engineering technology services. 　　(III) After 1995, having won provincial or ministerial-level awards for scientific and technological achievements, or having published 2 representative papers on safety production supervision and management as well as safety engineering technology in provincial or ministerial-level journals, or having authored important monographs on safety production management or safety engineering technology. 　　(IV) Having continuously worked in a production or business entity in professional roles related to work safety management, safety engineering technology testing and inspection, safety assessment, or safety consulting for 5 years, with a total of 10 years of such experience. 　　(5) Passing the assessment conducted by the provincial work safety supervision and management department on knowledge related to work safety management, safety engineering technologies, and relevant regulations. 　　II. Designation Organization: The Ministry of Human Resources and **Production Supervision and Administration Bureau jointly establish the \"Leadership Group for the Designation of Professional Qualifications for Registered Safety Engineers\" (hereinafter referred to as the Leadership Group; the list of members is attached), which is responsible for the designation of professional qualifications for registered safety engineers across the country. An office is established under the leadership group, located in the **Production Supervision and Administration Bureau. 　　III. Approval Procedure 　　(1) Professional and technical personnel who meet the aforementioned application requirements may submit an application to their respective employers. Upon approval by the employer, the employer will then submit the application to the work safety supervision and management departments of the province, autonomous region, or municipality directly under the Central Government. The units affiliated with various departments of the State Council and the enterprises under central government administration can apply directly to the **Production Supervision and Administration Bureau. 　　(II) The work safety supervision and management departments of each province, autonomous region, and municipality directly under the Central Government are responsible for reviewing the qualifications of the applicants from the entities within their jurisdictions. After obtaining approval from the corresponding personnel (job reform) departments, they submit a list of recommended candidates to the office of the leading group. The submission process for the military system is organized by the Cadre Department of the General Political Department. 　　The safety production management departments of the various units under the ministries of the State Council and of the enterprises under central government supervision are responsible for reviewing the qualifications of the applicants from their respective departments (enterprises). After obtaining approval from the personnel departments at the same level, they submit a list of recommended candidates to the office of the leading group. 　　(III) The following documents shall be provided at the time of application: 1. Two copies of the \"Application Form for Certification as a Registered Safety Engineer\" (a sample form is attached). 　　2. Copies of the academic qualification or degree certificate, the appointment letter for a senior professional position, award certificates, as well as excerpts from representative papers in this field or from published monographs, along with their first pages. 　　3. Proof of passing the assessments on safety production management, safety engineering technologies, and relevant regulations conducted by the provincial safety production supervision and management department, as well as proof of professional ethics. 　　(IV) The Office of the Leading Group conducts a preliminary qualification review of the candidates recommended by various regions, relevant departments, and central state-owned enterprises, prepares a list of candidates to be approved, and submits it to the Leading Group for review. 　　(5) The leading group holds a meeting to review those who have passed the preliminary assessment by the leading group’s office. After approval, the list of qualified candidates will be submitted to the Human Resources Department and the **Production Supervision and Administration Bureau for approval procedures. 　　IV. Application Time and Requirements (1) **A total limit is set on the number of persons to be recognized; no further recognition process will take place after the examination is conducted. 　　(II) The work safety supervision and administration departments as well as the personnel administration departments of each province, autonomous region, and municipality directly under the Central Government; the work safety management and personnel departments of relevant departments and enterprises; the work safety supervision and administration departments of the General Logistics Department and the cadre departments of the Political Department shall submit the materials of those who have passed the assessment to the office of the leading group by December 31, 2002. 　　(III) When reviewing the materials submitted by applicants, all regions, relevant departments, and enterprises must examine the original documents ； When submitting materials to the Leading Group Office, copies may be provided. 　　(IV) All regions, relevant departments, and enterprises must strengthen leadership effectively, adhere to standards and impose strict requirements, and carry out review and application processes carefully. Any unit or individual engaged in fraud shall have their right to submit applications for that year suspended in the relevant area (department) or unit as soon as it is discovered, and the individual’s application eligibility or any qualifications already obtained shall be revoked. 　　(5) Those who violate relevant laws and regulations on work safety and those involved in bribery shall not apply. 　　(6) Local authorities should give priority to recommending professional and technical personnel who meet the application requirements and have long been engaged in work related to work safety in production and operation units. 　　(7) All persons applying for recognition of the professional qualification as a registered safety engineer must follow these procedures.
