People of Shanghai * * On February 12, 2009, Article 1 of the Trial Measures for Applying for Permanent Resident Registration in this City for Persons Holding a "Shanghai Residence Permit" (Purpose and Basis) In order to deepen the reform of household registration management in this city, improve the residence permit system, and attract talents to Shanghai, these measures are formulated in accordance with relevant laws, regulations, and the "Shanghai Residence Permit Interim Provisions" and in combination with the actual situation of this city. Article 2 (Guiding Principles) In accordance with the principle of equal rights and obligations, annual total volume control will be implemented, applications will be accepted according to conditions, and processing will be done in sequence. Adhere to open policies, unified standards, standardized procedures, and convenient handling. Article 3 (Applicable objects) These measures apply to domestic personnel who come to Shanghai to start a business or find employment and hold a "Shanghai Residence Permit" (hereinafter referred to as "certificate holders"). Article 4 (Management Department) The municipal human resources and social security department is responsible for the acceptance and review of applications for permanent residence in this city by certified personnel. The municipal public security department is responsible for the settlement work. The Municipal Development and Reform Commission is responsible for the policy coordination for the implementation of these measures, determines the annual total based on the comprehensive balance of the city's economic and social development status, and supervises the implementation of the policy. Housing security and housing management, taxation, education, population and family planning, industry and commerce and other departments shall be responsible for the management work related to these measures in accordance with their respective responsibilities. Article 5 (Application Conditions) Certificate holders applying for permanent residence in this city must meet the following conditions at the same time: (1) Holding the "Shanghai Residence Permit" for 7 years or more ; (2) Participate in this city’s urban social insurance for at least 7 years as required while holding the certificate ; (3) Pay income tax in this city in accordance with the law during the period of holding the certificate ; (4) Being employed as an intermediate professional and technical position or above in this city or having a technician ( * * Second-level professional qualification certificate or above) or above professional qualifications, and corresponding majors and types of work ; (5) No violation * * and records of violations and crimes stipulated in the city's family planning policy, public security management penalties, and other bad behaviors. Article 6 (Incentive Conditions) Certificate holders who meet one of the following conditions may be given priority in applying for permanent residence in this city.: (1) Make significant contributions and receive corresponding rewards in this city, or be appointed as a senior professional and technical position or senior technician in this city ( * * If you have a first-level professional qualification certificate) and the major and type of work are consistent with the position you are employed, you are not subject to the restrictions on the number of years of certification and insurance stipulated in Items (1) and (2) of Article 5. ; (2) For those who have worked in education, health and other positions in the outer suburbs of this city for 5 years, the period of holding the certificate and participating in insurance can be shortened to 5 years. ; (3) If the urban social insurance base paid in this city in the last three consecutive years is more than twice the average salary of employees in this city in the previous year, or if the taxable salary income in the last three consecutive years is higher than the average annual salary income level of intermediate technical, skill or management positions in the same industry in the previous year, technical management and key position personnel are not subject to the restrictions on professional technical positions or professional qualification levels stipulated in Item (4) of Article 5 ; (4) Calculated based on individual direct investment (or investment share) in this city, if the cumulative total payment and annual minimum payment in the last three consecutive tax years reach the standards stipulated by this city, or if the number of employees employed in this city for three consecutive years reaches the required standards, relevant investment and entrepreneurial talents are not subject to the restrictions on professional and technical positions or professional qualification levels in Item (4) of Article 5 of these Measures. The scope of major contribution awards mentioned in the preceding paragraph, the standards for taxable salary income, the scope of technical management and key positions, the amount of investment tax and the number of employees shall be announced by the relevant management departments in a timely manner. Article 7 (Submission of application) Certificate holders who meet the conditions stipulated in these measures and need to apply for permanent residence in this city can go to the human resources and social security department to obtain and fill out the "Application Form for Permanent Residence Registration in this City for Residence Permit Holders", and the employer is responsible for reporting to the human resources and social security department. Article 8 (Application Materials) Certificate holders who meet the requirements of Article 5 and apply for permanent residence in this city shall submit the following materials:: (1) Valid identity certificate and "Application Form for Residential Registration in this City for Residence Permit Holders" ; (2) Proof of participation in this city’s urban social insurance ; (3) Personal income tax or corporate tax payment certificate issued by the tax authorities at or above the city or county level ; (4) Professional and technical positions, professional qualification certificates and relevant employment (labor) contract certificates ; (5) Family planning certificate of current place of residence and certificate of no illegal or criminal record ; (6) The house ownership certificate or public housing rental certificate of the person or the unit or relative who agrees to accept the settlement ; (7) Other necessary supporting materials required by relevant departments. Certificate holders who meet the provisions of Article 6 and apply for priority in applying for permanent residence in this city must also submit corresponding certification materials. Article 9 (Acceptance) After receiving the application materials from certified personnel applying for permanent residence in this city, the human resources and social security department shall accept the applications if the application materials are complete and issue an acceptance receipt. If the application materials are incomplete, the certificate holder shall be informed to complete the relevant materials. Article 10 (Audit) The human resources and social security departments shall review the application materials in accordance with the prescribed conditions. For those who meet the prescribed conditions, a "Notice of Applying for Permanent Residence Registration in this City for Persons Holding a "Shanghai Residence Permit"" shall be issued ; Those who do not meet the prescribed conditions shall be notified in writing to the certificate holder. Article 11 (Relocation of Household Registration) Certificate holders shall handle the relocation and settlement procedures with the "Notification of Permanent Residence Registration in this City for Persons Holding a "Shanghai Residence Permit"" and the "Certificate of Approval of Moving in" issued by the Municipal Public Security Department and relevant certificates. Article 12 (Family members move with them) If the spouse of a certificate holder meets the prescribed conditions, he or she can apply for permanent residence in this city at the same time. If he does not meet the conditions, he or she can apply for residence in accordance with the existing settlement policy. Minor children can move with them. Article 13 (Total Control) This city implements annual total control on the application for permanent residence by certificate holders, and qualified certificate holders will queue up and wait in line according to regulations. If the total number of people under control is exceeded in the current year, it will be transferred to the next year. Article 14 (Legal Responsibilities) Administrative agency staff shall perform their duties in accordance with the law. If they practice favoritism, abuse their power, solicit and accept bribes during the implementation of these Measures, they shall be subject to administrative sanctions by their unit or the supervisory authority. ; If a crime is constituted, criminal liability shall be investigated in accordance with the law. Certificate holders and units must commit in writing to the authenticity of the certification materials provided, and fraud is strictly prohibited. Once it is found to be false or forged, the applicant will be disqualified from re-applying and will be recorded in the social credit system. Anyone who fraudulently obtains a permanent residence in this city will be deregistered in a timely manner. If a crime is constituted, criminal liability shall be investigated in accordance with the law. Article 15 (Implementation Rules) The Municipal Human Resources and Social Security Bureau shall, in conjunction with relevant municipal functional departments, formulate corresponding implementation rules in accordance with these Measures. Article 16 (Trial Period) These Measures will be implemented on a trial basis from the date of issuance, with a trial period of 3 years.
