Accident Management System 1. Accident Classification and Management 1.1 Accidents can be managed according to the following categories: 1.1.1 Production (process) accidents: These refer to accidents that occur during the production process as a result of violations of process procedures, job operation guidelines, or improper operations, leading to losses of raw materials, semi-finished products, or finished products. 1.1.2 Equipment accidents: Refer to incidents in which equipment suffers abnormal damage, resulting in downtime, loss of production, or repair costs reaching a specified amount. 1.1.3 Quality accidents: refer to incidents in which the product quality (including project quality and service quality) fails to meet technical standards and specifications. 1.1.4 Traffic accidents: refer to incidents in which vehicles or ships are damaged, people are injured or killed, or property is lost as a result of violations of transportation rules or other reasons. 1.1.5 Fire accident: Refers to any burning phenomenon that gets out of control and causes damage to property and people, which is considered a fire accident. 1.1.6 Explosion accident: refers to an accident in which **property damage or casualties occur as a result of an explosion. 1.1.7 Damage accident: refers to an accident deliberately created. 1.1.8 Injury and accident: Refers to physical injuries or acute poisoning that occur to enterprise employees during the course of production work. 1.2 Production (process) accidents and equipment accidents are under the responsibility of the Production Department ; Quality incidents are managed by the Technical Quality Inspection Department ; Fire, explosions, traffic incidents, damage accidents, and casualties are under the responsibility of the security department. Various functional departments conduct investigations, collect statistics, and archive them in accordance with the requirements for classified management. 2. Accident levels and loss calculation 2.1 Equipment accidents shall be handled in accordance with the relevant provisions outlined in the \"Equipment and Power Management System for Chemical Industry Enterprises\". 2.2 Fire incidents shall be handled in accordance with the \"Regulations on Fire Statistics Management\" jointly issued by the Ministry of Public Security, the Ministry of Labor, and the **Statistics Bureau. 2.3 Traffic accidents shall be handled in accordance with the provisions of the Ministry of Public Security’s “Notice on Doing a Good Job in Traffic Management Statistics”. 2.4 Incidents involving casualties shall be handled in accordance with the \"Classification of Work-related Injury and Death Incidents in Enterprises\", the \"Regulations on the Reporting, Investigation, and Handling of Production Safety Incidents\", and relevant provisions. 3. Emergency response and rescue 3.1 In the event of an accident in a company, it is necessary to take active measures for rescue and proper handling in order to prevent the accident from spreading. 3.2 In the event of a major accident, enterprise leadership must provide direct command, while the departments responsible for safety technology, equipment and power supply, production, and security should assist in carrying out rescue operations and setting up security measures at the scene. During rescue efforts, care should be taken to preserve the scene. When it is necessary to move objects at the scene to rescue the injured and prevent the accident from spreading, markers must be placed. 3.3 At the scene of accidents or fires involving a large release of hazardous materials, warning barriers must be set up. Rescue personnel should wear appropriate protective equipment, and those who have suffered poisoning, burns, or scalds must receive prompt medical treatment. 4. Accident reporting procedure 4.1 The person who first discovers an accident shall, in addition to taking immediate action, report it to the supervisor or dispatch officer as quickly as possible, and then report it up the chain of command. In the event of any major accident, the enterprise must promptly report an overview of the accident – including the time and location of occurrence, the causes, as well as information on casualties and economic losses – to higher-level authorities and relevant departments within 2 hours, using rapid methods. If the situation continues, report at any time. 4.2 The grassroots unit where the accident occurred shall, within 8 hours, fill out a written accident report in accordance with the regulations and submit it to the enterprise’s competent department. 4.3 In the case of major accidents, the enterprise shall prepare an accident investigation report and submit it to the relevant higher-level authorities within 24 hours. 4.4. In the case of serious liability accidents, in addition to reporting in accordance with relevant regulations, it is also necessary to report to the local people’s procuratorate. 4.5 In the event of any injuries or fatalities among personnel from external organizations while working, conducting practical training, or receiving training at the enterprise, the enterprise shall compile statistics and submit reports in accordance with the specified format. 4.6 In the event of an injury at work, starting from the date of the accident, if the injury changes from minor to severe within one month, or from severe to fatal, it shall not be reported as a severe injury or fatal accident. 5. Responsibility Allocation 5.1 The enterprise’s safety management operates under a responsibility system that combines the responsibility of the general manager with the divided responsibilities of the relevant supervisors. For tasks assigned by the principal officer, if the deputy officer reports them to the principal officer and the suggestions put forward receive no attention or support, or if no action is taken to address them leading to consequences, the principal officer bears primary responsibility. 5.2 If the company’s rules and regulations are inadequate or unscientific, the chief engineer and the deputy general manager in charge are responsible for this issue. If the management department has formulated such rules and regulations but the responsible leader fails to issue them or implement them, then that responsible leader is accountable. 5.3 If the design is defective or does not meet the design specifications, the designer and the approver are responsible. If design defects are discovered during construction or production and measures could have been taken to address them but were not, the leadership of the construction or production department bears primary responsibility. If measures have been established but not implemented, resulting in an accident, the person who violated those measures is responsible. 5.4 Any scientific and technological achievements that are transferred or put into practical use must undergo technical evaluation. If such achievements do not include measures for dust prevention, poison prevention, fire prevention, explosion prevention, as well as treatment of waste materials, along with safety operating procedures, the responsibility of the research and design unit shall be held. 5.6 The manufacturing and construction departments that fail to carry out manufacturing and construction in strict accordance with the drawings, or those who design or modify designs on their own without approval, shall be held responsible for any accidents that result therefrom. 5.7 In the event of an accident caused by violations of safety rules, the persons who committed such violations are held responsible. 5.8 During their apprenticeship*, apprentices must work under the supervision of their master; any accidents resulting from operating without following the master’s instructions are the responsibility of the apprentice themselves ; If an accident occurs while operating under the instructor’s guidance, the instructor bears primary responsibility. 6. Investigation and Handling 6.1 Accident Investigation 6.1.1 Whenever an accident occurs in a company, it must be handled in accordance with the principle of “four no-lets-go” (no letting go until the cause of the accident is identified, no letting go until those responsible for the accident and the people around them have received education, no letting go until preventive measures are put in place, and no letting go until the persons responsible for the accident are punished). 6.1.2 For minor accidents (those resulting in economic losses of less than 1,000 yuan) and serious near-miss accidents, the workshop and relevant department leaders shall organize an investigation and hold an accident analysis meeting within three days after the accident occurs. 6.1.3 For major accidents (those resulting in economic losses of 1,000 yuan or more), the enterprise or the leadership of the enterprise’s supervising authority shall organize accident investigation and handling efforts involving relevant personnel. 6.1.4 The composition of the accident investigation team shall follow the principles of simplicity and efficiency. Depending on the specific circumstances of the accident, the accident investigation team is composed of relevant responsible persons, safety departments, relevant management and technical departments, the unit where the accident occurred, and other entities related to the accident. 6.1.4.1 Members of the accident investigation team shall possess the knowledge and expertise required for accident investigation, and shall have no direct interest in the accident under investigation. 6.1.4.2 The head of the accident investigation team is appointed by the general manager or the vice general manager in charge of safety. The head of the accident investigation team oversees the work of the team. 6.1.4.3 The accident investigation team shall perform the following duties: (1) Determine the course of the accident, its causes, the number of casualties, and the direct economic losses ; (II) Determination of the nature of the accident and accident liability ; (III) Put forward suggestions regarding the handling of those responsible for the accident ; (IV) Summarize the lessons learned from the accident, and propose preventive and corrective measures ; (5) Submit an accident investigation report. 6.1.5 Responsibilities and authorities of the accident investigation team 6.1.5.1 The accident investigation team has the right to inquire with relevant entities and individuals about matters related to the accident, and to request them to provide relevant documents and information; such entities and individuals shall not refuse. The person in charge of the unit where the accident occurred and relevant personnel shall not leave their posts without permission during the accident investigation, and must be available at all times to answer questions from the accident investigation team, providing accurate information regarding the matter. If criminal offenses are suspected as a result of the accident investigation, the accident investigation team shall promptly transfer the relevant materials or their copies to the judicial authorities for handling. 6.1.5.2 Members of the accident investigation team shall act with integrity and fairness in their work, fulfill their duties diligently, abide by the discipline of the team, and keep the secrets related to the accident investigation. Without the permission of the head of the accident investigation team, its members shall not release any information related to the accident on their own. 6.2 Accident Handling 6.2.1 The investigation and handling of casualties shall be carried out in accordance with the Regulations on the Reporting, Investigation, and Handling of Production Safety Accidents. 6.2.2 Those who cause major accidents due to non-compliance with management rules, violation of regulations, or forcing workers to carry out dangerous tasks in violation of rules shall be punished by the judicial authorities in accordance with the law for the crimes of gross negligence and dereliction of duty. 6.2.3 Penalties for those responsible for an accident can include ordering them to compensate for economic losses, or imposing administrative sanctions such as warnings, reprimands, serious reprimands, demotions, salary cuts, dismissal from their positions, suspension on duty, or even expulsion from the company, depending on the severity of the accident, the extent of the losses, the nature of the faults committed, and the impact of the incident. 6.2.4 Those who conceal, misreport, or deliberately delay reporting various types of accidents shall be held accountable and dealt with strictly. 6.2.5 Enterprises should commend and reward those who contribute to preventing the expansion of accidents or to rescuing victims in case of accidents. 6.3 Competent authorities at all levels should confer various honorary titles or awards on units and individuals whose safety management departments and safety production efforts are excellent and have achieved outstanding results.
