I would like to ask my friends at HaiChuan: Our company has a design patent that has been infringed upon. If I decide to file an appeal, how much would the costs for such an appeal be approximately? (It’s not a chemical engineering issue, but I still hope it can be resolved here.)
Filing a lawsuit costs 20,000 to 30,000; the amount may vary depending on the circumstances. A friend of mine is a lawyer specializing in intellectual property; he just asked me about this and hopes it can be useful as reference for you.
The costs associated with an appeal are the same as those for the first-instance trial. The amount paid in the first instance is also the same amount that must be paid when appealing. The calculation method for the costs in the first instance is as follows: for amounts up to 1,000 yuan, it is 50 yuan; for amounts between 1,000 yuan and 50,000 yuan, it is 4% of the amount plus 10 yuan. For amounts between 50,000 yuan and 100,000 yuan, it is 3% of the amount plus 510 yuan; for amounts between 100,000 yuan and 200,000 yuan, it is 2% of the amount plus 1,510 yuan; for amounts above 200,000 yuan but up to 500,000 yuan, it is 1.5% of the amount plus 2,510 yuan; for amounts above 500,000 yuan but up to 1,000,000 yuan, it is 1% of the amount plus 5,010 yuan; and for amounts above 1,000,000 yuan, it is 0.5% of the amount plus 10,010 yuan.
