I. The necessity of understanding the common qualifications and licensing requirements in certification processes: Firstly, examining an organization’s qualifications is one of the key tasks in accepting certification applications. For organizations applying for certification, if their products/services/activities are related to **public safety, macroeconomic regulation, environmental protection, as well as activities that are directly related to human health, property safety, and other specific activities stipulated by laws and regulations, they must obtain approval or the necessary qualifications from the **administrative authorities in accordance with legal requirements. These requirements are all explicitly stipulated by laws and regulations, and all organizations must comply with them. This is a basic requirement for organizations applying for certification. It is inconceivable that an accreditation body could \"verify a company’s ability to consistently supply products that meet the requirements of customers and relevant laws and regulations\" for an organization that does not meet the specified conditions and has not obtained the necessary permits or qualifications. Secondly, various qualifications and the rules governing permits specify in detail the standards that products must meet, the production processes and required conditions, as well as the inspection rules. Understanding these aspects is undoubtedly of great help to auditors when assessing the control over the organization’s product/service delivery process. Therefore, whether they are market development personnel, certification project managers, or auditors, it is necessary to have some knowledge of the common qualifications and licensing requirements in certification work. Below is a brief introduction to the qualification and licensing requirements established by laws, administrative regulations, and decisions of the State Council, which are frequently involved in certification processes. II. Enterprise Qualification Requirements 1. Construction Industry: A construction industry enterprise refers to an enterprise that is engaged in the construction, expansion, or renovation of civil engineering projects, building projects, pipeline and equipment installation projects, as well as decoration work. These enterprises must pass a qualification review and obtain the corresponding level of qualification certificates before they can engage in construction activities within the scope permitted by their qualification level. The \"Standards for the Qualification Grades of Construction Enterprises\" stipulate that the qualifications of construction enterprises are divided into three categories: general construction contracting, specialized contracting, and labor subcontracting. Each of these categories is further divided into several qualification types based on the nature of the project and its technical characteristics. General construction contracting enterprises are divided into 12 categories, such as general contracting for building construction projects. Specialized contracting is divided into 60 categories, such as specialized contracting for foundation and substructure work. Labor subcontracting is divided into 13 categories, such as carpentry work. Each qualification category is divided into several levels according to the specified conditions. For example: the qualifications for general contracting enterprises in housing construction projects are divided into special grade, first grade, second grade, and third grade. The qualifications for general contracting enterprises in highway construction are divided into special grade, first grade, second grade, and third grade. The qualifications for general contracting enterprises in mechanical and electrical installation projects are divided into grade one and grade two. Approval of construction enterprise qualifications: special-grade and first-grade general contracting enterprises. First-class professional contracting enterprises as well as enterprises under central management are approved by the Ministry of Construction. The qualifications for general construction contractors and specialized contractors at level 2 and below, as well as those for labor subcontracting companies, are approved by the provincial construction department where the company is registered. 2 Qualifications for real estate development enterprises: Real estate development enterprises are classified into four qualification levels: first, second, third, and fourth. Enterprises with first-level qualifications are subject to preliminary review by the provincial construction departments before being submitted to the Ministry of Construction for approval; the approval procedures for enterprises with second-level qualifications and those with lower qualifications are established by the provincial construction departments. 3 Qualifications for property management companies: The qualification levels for property management companies are divided into first, second, and third grades. Qualifications for first-grade property management companies are approved by the Ministry of Construction. Provincial and autonomous region construction departments are responsible for issuing certificates of qualification for second-grade property management companies, while the real estate authorities of municipalities directly under the Central Government are in charge of issuing certificates for both second- and third-grade property management companies. The real estate authorities of cities with districts are responsible for issuing certificates of qualification for third-grade property management companies. 4 Qualifications for power enterprises: The power business license is issued by the Power Regulatory Commission, while the licenses for electricians to work on electrical systems, as well as the licenses for installing (repairing or testing) electrical facilities, and the qualifications for overseeing power supply and consumption are issued by the agencies affiliated with the Power Regulatory Commission. 5 Road Transport Operation License: For passenger transport operations within a county-level administrative area, an application must be submitted to the county-level road transport management authority ; Those engaged in passenger transport operations across two administrative regions at or above the county level within the administrative territory of a province, autonomous region, or municipality directly under the Central Government shall submit an application to the road transportation administration agency at the next higher level that oversees both of those regions ; Engaged in activities across provinces and autonomous regions. For passenger transport operations within the administrative regions of municipalities directly under the Central Government, an application must be submitted to the road transportation administration agency of the province, autonomous region, or municipality directly under the Central Government where the operation takes place. Those wishing to apply for operating road transport stations (yards), engaging in motor vehicle repair, or providing motor vehicle driver training services must submit their applications to the local county-level road transport administration agency. Taxis. Applications for taxi operation licenses, vehicle operation permits, and driver licensing for passenger transport must be submitted to the local people’s government administrative department in charge of taxis at the county level or above. 6 Qualifications for printing enterprises: To establish an enterprise engaged in the printing of publications, packaging and decoration printed materials, and other printed products, an application must be submitted to the provincial **publication administration department in the location of the enterprise ; Among them, enterprises specialized in printing business cards submit an application to the county-level **publishing administration department in their location; upon approval, they are granted a printing operation license. 7. Administrative licenses for special industries: For businesses in the pawnbroking and hotel industries, as well as those involved in seal engraving, industry licenses are issued by the public security organs of local people’s governments at or above the county level. III. Industrial Product Production License **A production license system is implemented for enterprises that produce the following important industrial products: 1. Dairy products. Meat products, beverages, rice. Processed foods such as flour, cooking oil, and alcoholic beverages that are directly related to human health ; 2. Products such as electric blankets, pressure cookers, and gas water heaters that may pose a threat to personal safety and property safety ; 3. Products related to financial security and communication quality, such as tax control cash registers, anti-counterfeiting currency detectors, ground receiving equipment for satellite TV broadcasts, and wireless radio and television transmission equipment ; 4. Products that ensure workplace safety, such as safety nets, safety helmets, and construction fasteners ; 5. Products such as power transmission towers and bridge bearings, railway industrial products, hydraulic metal structures, hazardous chemicals and their packaging, containers, etc., which affect production safety and public safety ; 6. Other products for which legal and administrative regulations require management through production licenses in accordance with the Provisions on the Administration of Production Licenses for Industrial Products of the People’s Republic of China. No enterprise shall produce products listed in the production license catalog without obtaining a production license. No entity or individual shall sell or use in business operations products listed in the catalog that have not obtained a production license. **The General Administration of Quality Supervision, Inspection and Quarantine is responsible for the management of industrial product production licenses nationwide. **The General Administration for Quality Supervision, Inspection and Quarantine has an Office for National Industrial Product Production Licenses within it, which is responsible for the day-to-day management of national industrial product production licenses. Except for aluminum alloy windows, plastic windows, and colored-coated steel panel windows in the category of building exterior windows, as well as custom-made glasses in the category of optical products, whose licenses are issued by the provincial authorities, all other production licenses are issued by the **General Administration of Quality Supervision, Inspection and Quarantine. The validity period of the industrial product production license is 5 years. Currently, there are 104 types of products across 76 categories that are subject to the management of such licenses. For the products subject to management under the industrial product production license system, implementation rules have been issued for 94 types of products. On February 27, 2003, Document No. Guo Jian Zhi Ren Lian 46 issued by the General Administration of Quality Supervision, Inspection and Quarantine decided that the system of industrial product production licenses would no longer be applied to the following 17 types of products related to mandatory product certification ; Low-voltage electrical appliances, radio and television receivers, home audio systems, communication equipment. Tires, electric irons, fluorescent lights; fire-fighting equipment, anti-theft alarms; safety glass, air conditioners, explosion-proof lighting fixtures, computer systems, mining lamps, coal drills, medical diagnostic X-ray machines and protective devices, small and medium-sized lifting and transportation equipment. It was also decided that a mandatory product certification system would be implemented for the following 6 types of products, and the industrial product production license system would no longer be in use: 1. Food electric ovens ; Home electric oven products (including home and similar-purpose electric ovens, bread toasters, waffle makers, and similar appliances with a rated capacity of no more than 10 liters) ; 2 Internal combustion engine category: Motorcycle engine products ; 3 Wire and cable products: “Mine-use rubber-sheathed flexible cables”, “Wires and cables for railway locomotives and vehicles with an AC rated voltage of 3 kV or less”, “Rubber-insulated wires and cables with a rated voltage of 450/750 V or less”, “Polyvinyl chloride-insulated wires and cables with a rated voltage of 450/750 V or less” ; 4 Refrigeration equipment category: “Household refrigerators, food freezers” (refrigerators with an effective volume of 500 liters or less, intended for household use or similar purposes and equipped with or without a compartment for storing frozen foods, as well as food freezer boxes and similar devices), as well as “Electric motors – compressors” (hermetically sealed types (fully enclosed, semi-enclosed) used in household and similar-purpose air conditioning and refrigeration units with an input power of 5000 W or less) ; 5 Rubber products: Latex products (rubber**) ; 6 Electrical accessories: Plug and socket products for household and similar uses.
