Design Change Order

The construction party has only a contractual relationship with Party A; without Party A’s signature, there is a risk of not receiving payment for the work done, in addition to having to take on responsibility. There is no contractual relationship with the designer, and it has no legal validity. The normal procedure should be that the designer sends the changes to Party A for approval (signing); once Party A signs to agree, it is sent to the construction party, who, if they deem it feasible, will sign and proceed with the work.

There are various reasons for design changes; if it is caused by the designer, the owner’s signature is not required； If the change is caused by the owner, it shall be signed and confirmed by the owner. Sometimes design changes also result in increased costs, and in such cases it depends on the contracting arrangement to determine whether the owner’s approval is required.

This change was proposed by Party A. At that time, the change order we provided to Party A did not have any space for their signature, but the change order was intended for the construction unit. Let me address this properly first: the \"construction unit\" should refer to Party A, that is, the client; what the building owner actually means is the technicians from the \"construction company\"... Even if there is no space for the construction unit to sign on the change order, there should at least be a place for the supervision unit to sign. Any change to the drawings alters the content intended by the original drawings, and such changes need to be approved, even if no additional costs are involved.

This change order should be structured like this: the client requests a change, sends a signed authorization letter to the design firm; upon receiving this letter, the design firm issues the change order to the client, who then assigns the construction work to a construction company. The construction contractor may request the owner to sign, but has no right to take the change order back to the design institute.
