Legal basis for the assessment of occupational disease hazards in construction projects: I. The Law of the People’s Republic of China on the Prevention and Control of Occupational Diseases, Article 15: Where new construction projects, expansion projects, renovation projects, as well as projects involving technological upgrades or the introduction of new technologies (hereinafter collectively referred to as construction projects) may pose risks of occupational diseases, the project owner shall submit a preliminary assessment report on such occupational disease hazards to the health administration department during the feasibility study phase. If a pre-evaluation report is not submitted, or if the pre-evaluation report has not been approved by the health administration department, the relevant authorities shall not approve such construction project. Article 16: The costs associated with the installation of occupational disease prevention facilities for construction projects shall be included in the project’s budget. Such facilities shall be designed, constructed, and put into operation simultaneously with the main structure of the project. Before the completion acceptance of a construction project, the project owner shall conduct an evaluation of the effectiveness of controls against occupational disease hazards. At the time of completion acceptance for a construction project, its occupational disease prevention facilities can be put into formal production and use only after passing the inspection by the health administration department. Article 17 Pre-assessments of occupational disease hazards and evaluations of the effectiveness of controls against such hazards shall be carried out by professional occupational health technology service institutions that have been established in accordance with the law and have received qualification certification from the health administrative departments at the provincial level or above. The evaluations conducted by occupational health technical service agencies shall be objective and truthful. II. Article 13 of the Regulations on Labor Protection in Workplaces Using Toxic Substances: For new construction projects, expansion projects, renovation projects, as well as technology improvement and technology introduction projects (hereinafter collectively referred to as construction projects) that may pose risks of occupational poisoning, a pre-assessment of such risks must be carried out in accordance with the provisions of the Law on the Prevention and Control of Occupational Diseases, and such assessment must be approved by the health administration department ; The protective facilities against occupational poisoning for construction projects that may pose such risks should be designed, constructed, and put into operation simultaneously with the main structure of the project ; Upon the completion of a construction project, an evaluation of the effectiveness of controls against occupational poisoning hazards must be conducted, and the project must pass the inspection by the health administration authorities. The design of protective facilities against occupational poisoning in construction projects involving highly toxic operations must undergo health scrutiny by the health administration department ; Upon inspection, work may proceed only if it meets **occupational health standards and hygiene requirements. III. Article 4 of the \"Administrative Measures for the Classification of Occupational Disease Hazards in Construction Projects\": **Classification-based management shall be applied to construction projects with occupational disease hazards: (1) For construction projects that may pose general occupational disease hazards, a health assessment of the preliminary evaluation of occupational disease hazards during the feasibility study phase, an evaluation of the effectiveness of measures to control occupational disease hazards at the time of project completion, and a health inspection of the occupational disease prevention facilities are required.** ; (II) For construction projects that may pose serious risks of occupational diseases, in addition to the health inspections and health approvals specified in the preceding item, a health review of the design of protective facilities at the design stage shall also be conducted. IV. Article 6 of the Regulations on Radiation Protection for Radioisotopes and Radiation Devices: The radiation protection facilities for newly built, renovated, or expanded radiation work sites must be designed, approved, constructed, and put into use simultaneously with the main structure of the facility. The design of radiation protection facilities must be approved by the health administration department of the province, autonomous region, or municipality directly under the Central Government, in conjunction with departments such as public security. After completion, it must undergo approval from relevant departments such as those responsible for health, public security, and environmental protection; only after obtaining the permit registration certificate can it be put into use. For engineering projects related to the treatment of radioactive wastewater, waste gas, and solid waste, an environmental impact assessment document approved by the environmental protection authorities must be submitted alongside the application for review; upon completion, the project must also receive approval from departments such as those responsible for health, public security, and environmental protection.
