Should spare parts be specified in the mechanical pump technical agreement?
Our company requires spare parts to be available for 2 years when signing contracts

The seller is required to provide, in the technical agreement, spare parts for commissioning as well as a list of spare parts for two years; the spare parts for commissioning are supplied together with the unit, while it is up to the owner to decide whether to purchase the spare parts for the two-year period.
According to international practices, spare parts should be specified; API610 provides details on the spare parts required for startup and those needed for one year.
Generally, large companies* carry spare parts with them, while some smaller companies prefer not to. The funds for spare parts included with the pump are counted as fixed assets, while purchases made later are classified as materials; there is a significant difference in terms of accounting.
As is standard practice, installation spare parts, commissioning, and two years’ worth of spare parts should be provided. Reputable large companies will proactively include this item in their design documents.
The random spare parts ordered at the time of purchase are mainly those consumable parts that are needed to ensure the proper operation of the machine within 1 to 2 years after it starts operating. For those spare parts that are of high value and not likely to get damaged in the short term, there is no need to include them in the technical agreement (after all, spare parts cost money). Of course, if you don’t mind having capital tied up in inventory or require very high reliability of certain machines, then they can be included in the agreement. Of course, you can also determine the purchase time based on the machine’s operating condition and make the purchase on your own.

Logically, when purchasing equipment, the seller should take the completion and delivery point to be when the trial operation on site is successful; all costs up to that point are the responsibility of the seller. In other words, test run spare parts must be provided, while spare parts for the following year or two are another matter. If necessary, it must be specified in the tender specifications; the bid price should include the cost of spare parts, otherwise it will only cover low-value consumables. One thing to keep in mind is that the cost comes from the sheep; no matter how many spare parts there are, the money is paid by the buyer. So it needs to be clearly stated in the agreement. Moreover, the technical agreement is an essential part of a business contract and carries the same legal validity; otherwise, in case of any disputes, it is the agreement that counts, as verbal agreements hold no weight.

I believe it is essential to specify which parts are vulnerable to damage and to include information on spare parts for a period of two years when making purchases. Additionally, manufacturers should provide detailed specifications in accordance with national standards, so as to avoid unnecessary complications in future procurement processes.
A contract is a matter between the two parties; it needs to be written only if the buyer requires it, otherwise not.
