Our company applied for a license for the safe production of hazardous chemicals last year. However, we have now discovered a type of waste that has high value for recycling, and we would like to include it among the products covered by that license for safe production of hazardous chemicals; but since it is considered waste, what procedures are required to handle this? What is the relevant basis?
It turns out that when the waste is mentioned in the safety assessment report, it’s sufficient to simply include it in the updated list of business activities. There is no need to prepare a new assessment report; instead, one can take the new report along with other relevant documents to the safety supervision agency to apply for an expansion of the production scope.
In the original safety assessment, this was defined as waste disposal, and that’s exactly what was stated.
It depends on the complexity of the recycling process and the category of hazardous chemicals. 1. If adding a new device requires an investment of over 500,000 yuan, a special safety assessment is necessary. 2. If the investment is small and the relevant hazardous characteristics of that dangerous chemical were already analyzed in the original project assessment, then only a change to the safety production license is required, by submitting an application with omissions. 3. Consider the opinions of the local work safety supervision agency.

According to Article 50 of the Measures for the Implementation of Safety Production Licenses for Hazardous Chemicals Production Enterprises: If a hazardous chemicals production enterprise commences production on a newly built, renovated, or expanded project that has already passed the inspection, without applying for and going through the necessary change procedures as required by these measures, it shall be ordered to cease production activities, must complete the change procedures within a specified time frame, and shall also be fined between 10,000 and 30,000 yuan.

Our approach here is that if you want to change the safety production license, you simply need to discuss it with the local safety supervision agency and then complete a safety status assessment. In the evaluation report, the hazard of the product should be re-analyzed, and this should be included in the analysis of major hazard sources as well.

These documents must be verified by the county (city, district) and municipal safety supervision bureaus before an application can be submitted for the renewal (modification) of the safety production license. Otherwise, they shall all be regarded as new projects, and the provisions of the \"Implementation Measures for Safety Permits for Hazardous Chemicals Construction Projects\" shall be strictly followed. In the first half of 2008, an application for change was submitted at the original company. As it was an established enterprise, they lacked many necessary things; at first they refused to approve the request outright. Later, the head of the municipal work safety supervision department accompanied the company’s manager to the provincial authorities, and everything was sorted out. The main documents required for the change include: 1. One or four copies of the application form for the change or extension of the work safety license (one electronic copy as well) ； 2. The original and duplicate copies of the previous work safety license ； 3. In the case of a change in the principal responsible person, provide proof of the principal responsible person’s successful assessment ； 4. In the case of a change in affiliation or company name, provide a copy of the updated business license (photocopy) ； 5. Once new, renovated, or expanded projects pass the acceptance inspection, the documents and materials related to the construction project must be submitted.
