Order No. 344 of the State Council of the People's Republic of China, "Regulations on the Safety Management of Hazardous Chemicals," was adopted at the 52nd executive meeting of the State Council on January 9, 2002, is hereby promulgated, and will come into effect on March 15, 2002. Chapter 1 General Provisions Article 1 of the Regulations on the Safety Management of Hazardous Chemicals promulgated by Prime Minister Zhu Rongji on February 1, 2002. In order to strengthen the safety management of hazardous chemicals, ensure the safety of people's lives and property, and protect the environment, these Regulations are formulated. Article 2 The production, operation, storage, transportation, use of hazardous chemicals and the disposal of waste hazardous chemicals within the territory of the People's Republic of China must comply with these regulations and * * Provisions on laws and other administrative regulations regarding production safety. Article 3 The term “dangerous chemicals” as mentioned in these regulations includes explosives, compressed gases and liquefied gases, flammable liquids, flammable solids, self-igniting items and flammable items when exposed to moisture, oxidants and organic peroxides, toxic substances and corrosive substances, etc. Hazardous chemicals are listed in * * "List of Dangerous Goods" published by the standard (GB12268) ; The catalog of highly toxic chemicals and other hazardous chemicals not included in the "List of Dangerous Goods" shall be determined and announced by the comprehensive economic and trade management department of the State Council in conjunction with the public security, environmental protection, health, quality inspection, and transportation departments of the State Council. Article 4 For units that produce, operate, store, transport, use hazardous chemicals and dispose of waste hazardous chemicals (hereinafter collectively referred to as hazardous chemical units), the principal person in charge must ensure that the safety management of hazardous chemicals in the unit complies with the provisions of relevant laws, regulations, and rules. * * meet the requirements of the standards and be responsible for the safety of hazardous chemicals in the unit. Personnel engaged in the production, operation, storage, transportation, use of hazardous chemicals or the disposal of waste hazardous chemicals in hazardous chemicals units must receive training on relevant laws, regulations, rules and safety knowledge, professional skills, occupational health protection and emergency rescue knowledge, and must pass the assessment before they can start working. Article 5 Relevant departments that supervise and manage the production, operation, storage, transportation, use of hazardous chemicals and the disposal of waste hazardous chemicals shall perform their duties in accordance with the following provisions: (1) The comprehensive economic and trade administration department of the State Council and the people of provinces, autonomous regions and municipalities directly under the Central Government * * The economic and trade management department, in accordance with the provisions of these regulations, is responsible for the comprehensive safety supervision and management of hazardous chemicals, responsible for the review of the establishment and reconstruction and expansion of hazardous chemical production and storage enterprises, responsible for the review and designation of professional production enterprises of hazardous chemical packaging and containers (including tanks for transportation, the same below), responsible for the issuance of hazardous chemical business licenses, responsible for the registration of domestic hazardous chemicals, responsible for the organization and coordination of emergency rescue of hazardous chemical accidents, and responsible for the supervision and inspection of the aforementioned matters. ; People at the municipal level divided into districts * * and county-level people * * The department responsible for the comprehensive safety supervision and management of hazardous chemicals shall be composed of people at each level * * Determine and perform duties in accordance with the provisions of these regulations. (2) The public security department is responsible for the public safety management of hazardous chemicals, is responsible for issuing purchase vouchers and purchase permits for highly toxic chemicals, is responsible for reviewing and issuing road transport passes for highly toxic chemicals, supervises the safety of road transport of hazardous chemicals, and is responsible for the supervision and inspection of the aforementioned matters. (3) The quality inspection department is responsible for issuing production licenses for hazardous chemicals and their packaging and containers, for supervising the product quality of hazardous chemicals packaging and containers, and for supervising and inspecting the aforementioned matters. (4) The environmental protection department is responsible for the supervision and management of the disposal of abandoned hazardous chemicals, the investigation of major hazardous chemical pollution accidents and ecological damage events, the emergency monitoring of toxic chemical accident sites and the registration of imported hazardous chemicals, and the supervision and inspection of the aforementioned matters. (5) The railway and civil aviation departments are responsible for the safety management, supervision and inspection of hazardous chemicals railways, air transport, hazardous chemicals railways, civil aviation transport units and their means of transport. The transportation department is responsible for the safety management of hazardous chemicals road and waterway transport units and their means of transportation, supervision of the safety of hazardous chemicals waterway transport, responsible for the qualification identification of hazardous chemicals road and waterway transport units, drivers, crews, loading and unloading personnel and escorts, and responsible for the supervision and inspection of the aforementioned matters. (6) The health administrative department is responsible for the toxicity identification of hazardous chemicals and the medical rescue of casualties in hazardous chemical accidents. (7) The industrial and commercial administration department shall, based on the approval and licensing documents of relevant departments, issue business licenses for hazardous chemicals production, operation, storage and transportation units, and supervise and manage hazardous chemicals market operations. (8) The postal department is responsible for the supervision and inspection of mailing hazardous chemicals. Article 6 The relevant departments that supervise and manage hazardous chemical units in accordance with these Regulations shall conduct supervision and inspection in accordance with the law and may exercise the following powers:: (1) Enter hazardous chemical workplaces to conduct on-site inspections, obtain relevant information, learn about the situation from relevant personnel, and propose corrective measures and suggestions to hazardous chemical units ; (2) When hidden dangers of hazardous chemical accidents are discovered, order them to be eliminated immediately or eliminated within a time limit. ; (3) For those who have basis to believe that they do not comply with relevant laws, regulations, rules and regulations; * * Facilities, equipment, equipment and means of transportation required by the standards shall be ordered to cease use immediately. ; (4) If illegal acts are discovered, correct them on the spot or order them to make corrections within a time limit. Hazardous chemical units shall accept supervision and inspection carried out by relevant departments in accordance with the law and shall not refuse or obstruct them. When staff dispatched by relevant departments conduct supervision and inspection in accordance with the law, they must produce their certificates. Chapter 2 Production, Storage and Use of Hazardous Chemicals Article 7 * * Implement unified planning, rational layout and strict control over the production and storage of hazardous chemicals, and implement an approval system for the production and storage of hazardous chemicals ; Without approval, no unit or individual is allowed to produce or store hazardous chemicals. People at the municipal level divided into districts * * According to the actual needs of local economic development, when formulating the overall plan, appropriate areas should be planned specifically for the production and storage of hazardous chemicals in accordance with the principle of ensuring safety. Article 8 Hazardous chemical production and storage enterprises must meet the following conditions: (1) There is compliance with * * Standard production processes, equipment or storage methods and facilities ; (2) The perimeter protection distance of factories and warehouses complies with * * standard or * * Relevant regulations ; (3) Have management personnel and technical personnel that meet production or storage needs ; (4) Have a sound safety management system ; (5) Comply with laws, regulations and * * Other conditions required by the standard. Article 9 The establishment of highly toxic chemical production and storage enterprises and other hazardous chemical production and storage enterprises shall be reported to the people of provinces, autonomous regions, and municipalities directly under the Central Government respectively. * * Economic and trade management departments and people at the districted municipal level * * The department responsible for the comprehensive safety supervision and management of hazardous chemicals shall submit an application and submit the following documents: (1) Feasibility study report ; (2) Physical and chemical performance indicators such as ignition point, autoignition point, flash point, explosion limit and toxicity of raw materials, intermediate products, final products or stored hazardous chemicals ; (3) Technical requirements for packaging, storage and transportation ; (4) Safety evaluation report ; (5) Accident emergency rescue measures ; (6) Documents proving compliance with the conditions stipulated in Article 8 of these Regulations. People of provinces, autonomous regions and municipalities directly under the Central Government * * Economic and trade management departments or people at the districted municipal level * * After receiving the application and submitted documents, the department responsible for the comprehensive safety supervision and management of hazardous chemicals shall organize relevant experts to conduct a review, put forward review opinions, and report them to the people at the same level. * * Make a decision to approve or disapprove. According to the people at this level * * The decision shall be approved by the people of the province, autonomous region or municipality directly under the Central Government * * Economic and trade management departments or people at the districted municipal level * * The department responsible for the comprehensive safety supervision and management of hazardous chemicals issues an approval letter ; If the application is disapproved, the applicant will be notified in writing. The applicant shall go through the registration procedures with the industrial and commercial administration department with the approval letter. Article 10 In addition to transportation gas stations and gas stations, storage facilities whose production equipment and storage quantities of hazardous chemicals constitute major sources of danger must be at a distance from the following places and areas: * * standard or * * Relevant regulations: (1) Residential areas, commercial centers, parks and other densely populated areas ; (2) Public facilities such as schools, hospitals, theaters, stadiums (venues), etc. ; (3) Water supply sources, water plants and water source protection areas ; (4) Stations and docks (according to * * stipulates that, with approval, except those specializing in hazardous chemical loading and unloading operations), airports, highways, railways, water transportation trunk lines, subway pavilions and entrances and exits ; (5) Basic farmland protection areas, livestock areas, fishery waters and seed, breeding livestock, and aquatic seed production bases ; (6) Rivers, lakes, scenic spots and nature reserves ; (seven) * * restricted area, * * management area ; (8) Other areas protected by laws and administrative regulations. If the built production equipment and storage facilities of hazardous chemicals that constitute major hazard sources do not comply with the provisions of the preceding paragraph, the people's government of the local municipality with districts shall * * The department responsible for the comprehensive safety supervision and management of hazardous chemicals shall supervise its rectification within the prescribed time limit. ; If it is necessary to change production, stop production, relocate or close down, report it to the people at the same level * * Implemented after approval. The term "major hazard sources" as mentioned in these regulations refers to units (including places and facilities) that produce, transport, use, and store hazardous chemicals or dispose of waste hazardous chemicals, and the quantity of hazardous chemicals equals or exceeds the critical quantity. Article 11 Any reconstruction or expansion of hazardous chemicals production or storage enterprises must be reviewed and approved in accordance with the provisions of Article 9 of these Regulations. Article 12 Hazardous chemicals production enterprises established in accordance with the law must apply to the quality inspection department of the State Council to obtain a hazardous chemicals production license ; Without obtaining a hazardous chemicals production license, production shall not begin. The quality inspection department of the State Council shall notify the comprehensive economic and trade management department, environmental protection department and public security department of the State Council on the issuance of hazardous chemicals production licenses. Article 13 No unit or individual may produce, operate or use * * Prohibited hazardous chemicals. It is prohibited to use highly toxic chemicals to produce rodenticides and other chemical products and household chemicals that may enter people's daily lives. Article 14 Those who produce hazardous chemicals shall attach chemical safety technical instructions that are completely consistent with the hazardous chemicals in the packaging of hazardous chemicals, and affix or hang chemical safety labels that are completely consistent with the hazardous chemicals in the packaging (including outer packaging). When a hazardous chemicals manufacturer discovers that the hazardous chemicals it produces have new hazardous characteristics, it shall immediately make an announcement and revise the safety technical instructions and safety labels in a timely manner. Article 15 Units that use hazardous chemicals to engage in production must meet the production conditions * * Standard and * * relevant regulations and in accordance with * * To obtain corresponding licenses in accordance with relevant laws and regulations, it is necessary to establish and improve safety management rules and regulations for the use of hazardous chemicals to ensure the safe use and management of hazardous chemicals. Article 16 Those who produce, store, and use hazardous chemicals shall, according to the types and characteristics of hazardous chemicals, set up corresponding safety facilities and equipment for monitoring, ventilation, sun protection, temperature regulation, fire prevention, fire extinguishing, explosion protection, pressure relief, virus prevention, disinfection, neutralization, moisture protection, lightning protection, antistatic, anticorrosion, anti-leakage, protective dikes or isolation operations and other safety facilities and equipment in workshops, warehouses and other workplaces according to the types and characteristics of hazardous chemicals, and shall comply with * * Standard and * * Carry out maintenance and upkeep according to relevant regulations to ensure compliance with safe operation requirements. Article 17 Units that produce, store, and use highly toxic chemicals shall conduct a safety assessment of the unit's production and storage devices every year. ; Units that produce, store, and use other hazardous chemicals shall conduct a safety assessment of their production and storage devices every two years. The safety evaluation report should propose rectification plans for safety problems existing in production and storage devices. If it is discovered during the safety assessment that there is a real danger in the production or storage device, use should be stopped immediately, replaced or repaired, and corresponding safety measures should be taken. The safety assessment report shall be submitted to the people's government at the municipal level where it is located. * * The department responsible for the comprehensive safety supervision and management of hazardous chemicals shall be registered. Article 18 Units that produce, store, and use hazardous chemicals shall set up communication and alarm devices at the production, storage, and use sites, and ensure that they are in a normal and applicable state under any circumstances. Article 19 Units that produce, store, and use highly toxic chemicals shall truthfully record the production, flow direction, storage volume, and uses of highly toxic chemicals, and take necessary security measures to prevent theft, loss, misuse, or misuse of highly toxic chemicals. ; When highly toxic chemicals are discovered to be stolen, lost, missold or misused, they must be reported immediately to the local public security department. Article 20 The packaging of hazardous chemicals must comply with * * the provisions of laws, regulations and rules and * * Standard requirements. The material, type, specification, method and unit mass (weight) of hazardous chemicals packaging should be compatible with the nature and purpose of the packaged hazardous chemicals and facilitate loading, unloading, transportation and storage. Article 21 Packages and containers of hazardous chemicals must be provided by the people of the province, autonomous region, or municipality directly under the Central Government. * * It can only be used after it has been designated by professional production enterprises that have passed the review of the economic and trade management department, and has been tested and passed the inspection by a professional testing and inspection agency recognized by the quality inspection department of the State Council. Reused hazardous chemical packages and containers should be inspected and recorded before use ; Inspection records should be kept for at least 2 years. The quality inspection department shall conduct regular or irregular inspections on the product quality of packages and containers of hazardous chemicals. Article 22 Hazardous chemicals must be stored in special warehouses, special venues or special storage rooms (hereinafter collectively referred to as special warehouses). The storage methods, methods and storage quantities must comply with * * standards and managed by dedicated personnel. Hazardous chemicals entering and exiting the warehouse must be checked and registered. Stockpiles of hazardous chemicals should be inspected regularly. Highly toxic chemicals and other hazardous chemicals whose storage quantity constitutes a major source of danger must be stored separately in a special warehouse, and a two-person sending and receiving and two-person custody system shall be implemented. The storage unit shall report the quantity, location and management personnel of highly toxic chemicals and other hazardous chemicals that constitute major hazard sources to the local public security department and the department responsible for the comprehensive safety supervision and management of hazardous chemicals for record. Article 23 Special warehouses for hazardous chemicals shall comply with * * Standard requirements for safety and fire protection shall be clearly marked. The storage equipment and safety facilities of special warehouses for hazardous chemicals should be tested regularly. Article 24: Waste hazardous chemicals shall be disposed of in accordance with the Law on the Prevention and Control of Environmental Pollution by Solid Waste and * * Relevant regulations are implemented. Article 25 If a unit that produces, stores, or uses hazardous chemicals changes production, suspends production, ceases operations, or dissolves, it shall take effective measures to dispose of the production or storage equipment, inventory products, and production raw materials of hazardous chemicals, and shall not leave any hidden dangers of accidents. The disposal plan shall be reported to the people's government at the municipal level where the district is located. * * The department responsible for the comprehensive safety supervision and management of hazardous chemicals and the environmental protection department and public security department at the same level shall register. The department responsible for the comprehensive safety supervision and management of hazardous chemicals shall supervise and inspect the disposal situation. Article 26 Hazardous chemicals submitted by the public shall be received by the public security department. Hazardous chemicals received by the public security department and hazardous chemicals seized by other relevant departments shall be handed over to professional units recognized by the environmental protection department for processing. Chapter 3 Business of Hazardous Chemicals Article 27 * * Implement a licensing system for the operation and sales of hazardous chemicals. Without permission, no unit or individual may operate or sell hazardous chemicals. Article 28 Enterprises operating hazardous chemicals must meet the following conditions:: (1) Business premises and storage facilities comply with * * standard ; (2) Supervisors and business personnel have received professional training and obtained job qualifications ; (3) Have a sound safety management system ; (4) Comply with laws, regulations and * * Other conditions required by the standard. Article 29 Those who deal in highly toxic chemicals and other hazardous chemicals shall report to the people of the provinces, autonomous regions, and municipalities directly under the Central Government respectively. * * Economic and trade management departments or people at the districted municipal level * * The department responsible for the comprehensive safety supervision and management of hazardous chemicals shall submit an application and attach relevant certification materials for the conditions specified in Article 28 of these Regulations. People of provinces, autonomous regions and municipalities directly under the Central Government * * Economic and trade management departments or people at the districted municipal level * * After receiving the application, the department responsible for the comprehensive safety supervision and management of hazardous chemicals shall review the certification materials and business premises submitted by the applicant in accordance with the provisions of these regulations. After review, if the conditions are met, a hazardous chemicals business license will be issued, and the issuance of the hazardous chemicals business license will be notified to the public security department and environmental protection department at the same level. ; If the conditions are not met, the applicant will be notified in writing and the reasons will be explained. The applicant shall go through the registration procedures with the industrial and commercial administration department with the hazardous chemicals business license. Article 30 When dealing in hazardous chemicals, no one shall engage in the following acts:: (1) Purchasing hazardous chemicals from enterprises that have never obtained a hazardous chemicals production license or hazardous chemicals business license ; (2) Operation * * Explicitly prohibited hazardous chemicals and rodenticides produced with highly toxic chemicals, as well as other chemical products and daily chemicals that may enter people's daily lives ; (3) Selling hazardous chemicals without chemical safety technical specifications and chemical safety labels. Article 31 Hazardous chemicals production enterprises shall not sell hazardous chemicals to units or individuals that have not obtained a hazardous chemicals business license. Article 32 Hazardous chemicals operating enterprises shall abide by the relevant provisions of Chapter 2 of these Regulations when storing hazardous chemicals. Hazardous chemicals stores can only store hazardous chemicals in small packages for civilian use, and the total amount must not exceed * * prescribed limits. Article 33: When selling highly toxic chemicals, an enterprise selling highly toxic chemicals shall record the name and address of the purchasing unit, the name and ID number of the purchaser, and the name, quantity, and purpose of the purchased highly toxic chemicals. Records should be kept for at least 1 year. Enterprises operating highly toxic chemicals should check the sales of highly toxic chemicals every day ; If any stolen, lost or mis-sold items are discovered, they must be reported immediately to the local public security department. Article 34 When purchasing highly toxic chemicals, the following regulations must be observed:: (1) Production, scientific research, medical and other units that frequently use highly toxic chemicals shall report to the people of the districted city level * * The public security department applies for a purchase voucher and purchases with the purchase voucher. ; (2) If a unit needs to purchase highly toxic chemicals temporarily, it shall submit a certificate issued by the unit (indicating the product name, quantity, and purpose) to the people's government at the districted city level. * * The public security department applies for a purchase permit and purchases with the purchase permit. ; (3) Individuals are not allowed to purchase highly toxic chemicals other than pesticides, rodenticides, and insecticides. Highly toxic chemical production and operating enterprises shall not sell highly toxic chemicals to individuals or units without purchase vouchers or purchase permits. Purchase vouchers and purchase permits for highly toxic chemicals may not be forged, altered, bought, sold, lent or otherwise transferred, and invalidated purchase vouchers and purchase permits for highly toxic chemicals must not be used. The format and specific application methods for purchase vouchers and purchase permits for highly toxic chemicals shall be formulated by the public security department of the State Council. Chapter 4 Transport of Hazardous Chemicals Article 35 * * Implement a qualification certification system for the transportation of hazardous chemicals ; Hazardous chemicals are not allowed to be transported without qualification certification. The conditions that hazardous chemicals transportation enterprises must meet shall be stipulated by the transportation department of the State Council. Article 36 Tanks and other containers used for transporting hazardous chemicals must be produced by professional production enterprises in accordance with the provisions of Article 21 of these Regulations, and must pass the inspection before they can be used. The quality inspection department shall conduct regular or irregular inspections on the product quality of tanks and other containers designated by the professional production enterprises specified in the preceding paragraph. Article 37 Hazardous chemical transportation enterprises shall provide relevant safety knowledge training to their drivers, crew members, loading and unloading managers, and escort personnel. ; Drivers, crew members, loading and unloading managers, and escorts must master the safety knowledge of hazardous chemical transportation, and * * Only those who pass the assessment of the transportation department (the crew members pass the assessment of the maritime administration agency) and obtain the qualification certificate can start working. The loading and unloading of hazardous chemicals must be carried out under the on-site command of loading and unloading managers. Drivers, crew, loading and unloading personnel and escorts transporting hazardous chemicals must understand the nature, hazardous characteristics, usage characteristics of packaging containers and emergency measures in the event of an accident. When transporting hazardous chemicals, necessary emergency treatment equipment and protective equipment must be equipped. Article 38 When transporting hazardous chemicals by road, the shipper can only entrust a transport enterprise with the qualification to transport hazardous chemicals to transport the hazardous chemicals. Article 39 When transporting highly toxic chemicals by road, the shipper shall notify the county-level people at the destination * * The public security department applies for a road transport pass for highly toxic chemicals. To apply for a road transport pass for highly toxic chemicals, the shipper shall submit to the public security department materials related to the name, quantity, transportation origin and destination, transportation route, transportation unit, driver, escort, operating unit and purchasing unit qualifications of the hazardous chemicals. The format and specific application methods for road transportation passes for highly toxic chemicals shall be formulated by the public security department of the State Council. Article 40 It is prohibited to use shipping channels such as inland rivers and other closed waters to transport highly toxic chemicals and other hazardous chemicals prohibited from transport by the transportation department of the State Council. Those who use shipping channels such as inland rivers and other closed waters to transport hazardous chemicals other than those specified in the preceding paragraph can only entrust water transport enterprises with hazardous chemicals transport qualifications to carry out the transportation, and go through the procedures in accordance with the regulations of the transportation department of the State Council, and accept the supervision and management of the relevant transportation departments (port departments, maritime management agencies, the same below). Ships transporting hazardous chemicals and the containers they carry must comply with * * It must be produced according to the specifications for ship inspection and must be inspected by a ship inspection agency recognized by the maritime administration agency before it can be put into use. Article 41 When consigning hazardous chemicals, the shipper shall explain to the carrier the name, quantity, hazards, emergency measures, etc. of the transported hazardous chemicals. If it is necessary to add inhibitors or stabilizers to transport hazardous chemicals, the shipper shall add the inhibitors or stabilizers when delivering the consignment and notify the carrier. Shippers are not allowed to carry hazardous chemicals in consigned general cargo, and are not allowed to conceal or falsely declare hazardous chemicals as consigned general cargo. Article 42 The transportation, loading and unloading of hazardous chemicals shall be carried out in accordance with the provisions of relevant laws, regulations and rules and * * Take necessary safety protection measures in accordance with the requirements of standards and in accordance with the hazardous characteristics of hazardous chemicals. Tanks and other containers transporting hazardous chemicals must be tightly sealed and able to withstand the internal and external pressure generated under normal transportation conditions to ensure that hazardous chemicals do not leak (spill) due to changes in temperature, humidity or pressure during transportation. Article 43 When transporting hazardous chemicals by road, they must be equipped with escorts and be under the supervision of the escorts at all times. They are not allowed to overload or overload, and they are not allowed to enter areas where dangerous chemicals transport vehicles are prohibited. ; If you really need to enter a prohibited area, you should report it to the local public security department in advance, and the public security department will designate the driving time and route. Transport vehicles must comply with the driving time and route prescribed by the public security department. Areas where hazardous chemicals transport vehicles are prohibited from passing shall be designated by the people at the districted municipal level * * The public security department shall demarcate and set up obvious signs. If you need to stop for accommodation while transporting hazardous chemicals or encounter situations where normal transportation is impossible, you should report to the local public security department. Article 44 When highly toxic chemicals are stolen, lost, scattered or leaked during road transportation, the carrier and escort must immediately report to the local public security department and take all possible warning measures. After receiving the report, the public security department shall immediately report the situation to other relevant departments ; Relevant departments should take necessary safety measures. Article 45 No unit or individual may mail or carry hazardous chemicals in the mail, and may not conceal or falsely declare hazardous chemicals as ordinary items for mailing. Article 46 The transportation of hazardous chemicals by railway or air shall be carried out in accordance with the relevant regulations of the railway and civil aviation departments of the State Council. Chapter 5 Registration of Hazardous Chemicals and Accident Emergency Rescue Article 47 * * Implement a hazardous chemicals registration system and provide technical and information support for hazardous chemicals safety management, accident prevention and emergency rescue. Article 48 Hazardous chemical production and storage enterprises and units that use highly toxic chemicals and other hazardous chemicals whose quantities constitute major sources of danger shall register hazardous chemicals with the agency responsible for the registration of hazardous chemicals in the comprehensive economic and trade management department of the State Council. Specific measures for the registration of hazardous chemicals shall be formulated by the comprehensive economic and trade management department of the State Council. Article 56 If a hazardous chemical accident occurs and the relevant departments fail to perform their duties in accordance with the provisions of these Regulations, organize and implement rescues or take necessary measures to reduce accident losses and prevent the accident from spreading or expanding, or delay or shirk the responsibility, the responsible person in charge and other directly responsible personnel shall be given administrative sanctions of demotion or dismissal in accordance with the law. ; Anyone who violates criminal law shall be investigated for criminal liability in accordance with the provisions of the Criminal Law on abuse of power, dereliction of duty or other crimes. Article 58 Hazardous chemical units violate the provisions of these Regulations and fail to set up corresponding monitoring, ventilation, sun protection, temperature regulation, fire prevention, fire extinguishing, explosion protection, pressure relief, poison prevention, disinfection, neutralization, moisture proof, lightning protection, For safety facilities and equipment such as anti-static, anti-corrosion, anti-leakage, protective dikes or isolation operations, the department responsible for the comprehensive safety supervision and management of hazardous chemicals or the public security department shall order corrections immediately or within a time limit according to their respective powers, and impose a fine of not less than 20,000 yuan but not more than 100,000 yuan. ; If criminal law is violated, the responsible person in charge and other directly responsible persons shall be held criminally accountable in accordance with the provisions of the Criminal Law on the crime of dangerous goods causing accidents, the crime of major liability accidents or other crimes. Article 59 Anyone who violates the provisions of these Regulations and commits any of the following acts shall be ordered to make corrections immediately or within a time limit by the department responsible for the comprehensive safety supervision and management of hazardous chemicals, the quality inspection department or the transportation department in accordance with their respective powers, and shall be fined not less than 20,000 yuan but not more than 200,000 yuan. ; Those who fail to make corrections within the time limit shall be ordered to suspend production and business for rectification. ; If criminal law is violated, the responsible person in charge and other directly responsible persons shall be held criminally accountable in accordance with the provisions of the Criminal Law on the crime of causing trouble with dangerous substances, the crime of producing and selling counterfeit and inferior goods, or other crimes.: (1) Producing packages and containers of hazardous chemicals without authorization ; (2) Ships transporting hazardous chemicals and the containers they carry do not comply with * * Produced in accordance with the ship inspection specifications and passed the inspection ; (3) The material, type, specification, method and unit quality (weight) of hazardous chemicals packaging are not suitable for the nature and purpose of the packaged hazardous chemicals. ; (4) Failure to inspect packaging and containers of reused hazardous chemicals before use ; (5) Packaging, holding, and transporting hazardous chemicals using packaging materials and containers produced by non-designated enterprises or that have not been tested or qualified. Article 60 If a hazardous chemicals unit violates the provisions of these Regulations and commits any of the following acts, the department responsible for the comprehensive safety supervision and management of hazardous chemicals shall order it to make corrections immediately or within a time limit, and impose a fine of not less than RMB 10,000 but not more than RMB 50,000. ; Those who fail to make corrections within the time limit shall be ordered to suspend production and business for rectification.: (1) Hazardous chemical production enterprises fail to attach chemical safety technical instructions that are completely consistent with the hazardous chemicals in the packaging of hazardous chemicals, or fail to affix or hang chemical safety labels on the packaging (including outer packaging) that are completely consistent with the hazardous chemicals in the packaging. ; (2) When hazardous chemicals manufacturing enterprises discover new hazardous characteristics of hazardous chemicals, they do not immediately announce and promptly revise their safety technical instructions and safety labels. ; (3) Hazardous chemicals business enterprises sell hazardous chemicals without chemical safety technical instructions and safety labels. Article 63 Anyone who violates the provisions of these Regulations and commits any of the following acts shall be ordered to make corrections by the administrative department for industry and commerce. Article 64 Anyone who violates the provisions of these Regulations by forging, altering, buying and selling, lending or otherwise transferring highly toxic chemical purchase vouchers, purchase warrants and other relevant documents, or using invalidated above-mentioned relevant documents, shall be ordered to make corrections by the public security department and fined not less than RMB 10,000 but not more than RMB 50,000. ; If criminal law is violated, the responsible person in charge and other directly responsible persons shall be subject to the provisions of the Criminal Law on counterfeiting, alteration, and trading. * * Criminal liability shall be investigated in accordance with the provisions of the provisions of the official documents, certificates, seals or other crimes of the government. Article 67 Anyone who violates the provisions of these Regulations and commits any of the following acts shall be ordered by the public security department to make corrections and be fined not less than RMB 20,000 but not more than RMB 100,000. ; Anyone who violates criminal law shall be investigated for criminal liability in accordance with the provisions of the Criminal Law on the crime of causing accidents with dangerous goods, the crime of major environmental pollution accidents or other crimes.: (1) The shipper fails to apply to the public security department for a road transport pass for highly toxic chemicals and transports highly toxic chemicals by road without authorization ; (2) Hazardous chemicals transport enterprises transport hazardous chemicals without providing escorts or without the supervision of escorts, overloading or overloading, stopping for accommodation during the journey, or failing to report to the local public security department when transportation is unable to be carried out normally. ; (3) A hazardous chemicals transport enterprise transports hazardous chemicals without reporting to the public security department, enters a prohibited area for hazardous chemical transport vehicles without authorization, or enters a prohibited area and fails to comply with the driving time and route prescribed by the public security department. ; (4) Hazardous chemicals transportation enterprises transport highly toxic chemicals and fail to immediately report to the local public security department and take all possible warning measures if they are stolen, lost, scattered, or leaked during road transportation. ; (5) The shipper carries hazardous chemicals in the consigned general cargo or conceals or falsely declares hazardous chemicals as consigned general cargo. Article 68 Anyone who violates the provisions of these Regulations by mailing or carrying hazardous chemicals in mails, or concealing or falsely reporting hazardous chemicals as ordinary items by mail, shall be fined not less than 2,000 yuan but not more than 20,000 yuan by the public security department. ; Anyone who violates criminal law shall be investigated for criminal liability in accordance with the provisions of the Criminal Law on the crime of causing accidents with dangerous goods or other crimes. Article 69 If a hazardous chemicals accident occurs in a hazardous chemicals unit and fails to immediately organize a rescue in accordance with the provisions of these regulations, or fails to immediately report to the department responsible for the comprehensive safety supervision and management of hazardous chemicals and the public security, environmental protection, and quality inspection departments, resulting in serious consequences, the responsible person in charge and other directly responsible personnel shall be investigated for criminal responsibility in accordance with the provisions of the Criminal Law on dereliction of duty or other crimes by state-owned companies and enterprise staff.
