May I ask that the design institute specify the technical parameters, while the owner is responsible for conducting the bidding and making the purchases? Is it necessary for professional engineers from a design institute to be involved when a winning bidder signs a technical agreement with the client? If the purchased products do not meet the technical requirements in the end, who is responsible?
Generally speaking, one should participate. However, the decision rests with the owner; the design firm only provides guidance, and the negotiation matters are handled by the owner
The technical specifications are provided by the design institute; in other words, the selection criteria, process requirements, and specific parameters for instruments are all determined after comprehensive consideration by the design institute. The owner must fully understand the design intentions and concepts of the design institute, while the design institute must be responsible for the technical specifications and has the duty to provide technical support and explain the relevant requirements. However, the design institute only has the right to make suggestions regarding the specific instrumentation to be selected, but no authority to make decisions. On this point, both the design institute and the owner need to maintain proper boundaries.
It is best to have people from a design institute involved and to conduct a joint approval of the technical agreement! If the design institute is not involved, it is recommended to send the technical agreement to the design institute for review before signing; it should be revised based on their feedback before signing and coming into effect! ! !
