\"Requirements for Access to Phosphoric Ammonium Production (Draft for Comment)\\" Phosphoric ammonium is an important fertilizer product. In order to optimize resource allocation, improve the comprehensive utilization of phosphorus ore resources, foster the development of a phosphorus fertilizer industry that is resource-efficient and environmentally friendly, and promote the healthy and sustainable growth of this industry, we have drafted the \"Requirements for Access to Phosphoric Ammonium Production (Draft for Comment)\\" in light of the current situation of China’s phosphorus fertilizer industry, as well as relevant laws, regulations, and industrial policy requirements. Contact Person: Zhang Wenming Phone: 010-68205570 Fax: 010-68205564 Department of Raw Materials Industry, Ministry of Industry and Information Technology, March 25, 2011 Attachment: “Access Conditions for Phosphoric Ammonium Production (Draft for Comment)” The access conditions for phosphoric ammonium production (draft for comment) are established in order to effectively curb reckless investment in the phosphatic fertilizer industry, prevent low-level redundant construction, regulate the development of this industry, and promote the optimization and upgrading of the industrial structure. In accordance with relevant laws, regulations, and industrial policies, and following the principles of structural adjustment, orderly competition, reduced consumption, environmental protection, and safe production, the following access conditions are set forth for the phosphatic fertilizer industry. I. Layout of production enterprises (1) Based on resource and energy conditions as well as market demands, the main provinces (autonomous regions, municipalities directly under the Central Government) that produce phosphate fertilizers should formulate development plans for the phosphate fertilizer industry, in order to guide the orderly development of this industry in their respective regions and prevent reckless expansion. (II) The establishment and expansion of new phosphate and related phosphatic ammonium fertilizer production facilities must be in line with the overall industrial plans of various provinces, autonomous regions, and municipalities directly under the Central Government, as well as the development plans for the phosphate fertilizer industry. Such facilities must also comply with the overall land use plans, environmental protection plans, or pollution control plans formulated by ** and various levels of government. (III) No new phosphorus compound fertilizer production facilities shall be established within the ecological protection areas, scenic tourism areas, nature reserves, cultural heritage protection areas, and drinking water source protection areas designated by the State Council, relevant departments, and the people’s governments at or above the county level in provinces, autonomous regions, and municipalities directly under the Central Government, as well as within the environmental protection and safety protection distances specified by the state and local authorities. Existing phosphorus compound fertilizer production facilities operating in such areas must be phased out gradually through methods such as relocation or change of production activities, in accordance with the planning requirements of those areas. (IV) Within three years, in principle, no new construction or expansion of wet-process phosphate and the associated ammonium phosphate and diammonium phosphate plants shall take place (except for projects that are relocated in accordance with regional planning). Newly built or renovated projects for relocation must comply with **industrial policies and relevant regulatory requirements. II. Process Conditions When enterprises that need to relocate according to regional planning construct new wet-process phosphate production facilities, along with associated ammonium phosphate and diammonium phosphate plants, it is necessary to ensure an adequate supply of phosphorus and sulfur resources. The use of sulfuric acid produced as a by-product of metallurgical processes is encouraged, as is the hierarchical utilization of phosphate. When such projects are developed, facilities for fluoride recovery and comprehensive utilization of phosphogypsum must also be established, with all phosphogypsum being utilized. For the sulfuric acid production plants constructed as part of the project, which use sulfur to produce acid, low-temperature heat recovery technology must be employed simultaneously ; When producing acid from pyrite, a dilute acid washing and purification process must be employed. III. Energy Consumption and Comprehensive Utilization of Resources (1) When enterprises that need to be relocated according to regional planning construct new wet-process phosphoric acid plants along with associated ammonium phosphate and diammonium phosphate production facilities, the comprehensive energy consumption per unit of product must meet the requirements specified in Table 1: Table 1: Comprehensive Energy Consumption Standards for Newly Built or Expanded Phosphatic Fertilizer and Associated Sulfuric Acid Plants Plant Name, Production Process, Product Type, Comprehensive Energy Consumption Standards Diammonium Phosphate: Traditional method – Granular form: ≤280 kgce/t·P2O5; Slurry method – Granular form: ≤208 kgce/t·P2O5 Ammonium Phosphate: Slurry method – Powder form: ≤183 kgce/t·P2O5; Granular form: ≤203 kgce/t·P2O5 Sulfuric Acid: Produced from sulfur: ≤-110 kgce/t·H2SO4; Produced from pyrite: ≤-90 kgce/t·H2SO4 (2) For existing wet-process phosphoric acid plants along with associated ammonium phosphate and diammonium phosphate production facilities, the comprehensive energy consumption per unit of product must meet the requirements specified in Table 2: Table 2: Comprehensive Energy Consumption Standards for Existing Phosphatic Fertilizer and Associated Sulfuric Acid Plants Plant Name, Production Process, Product Type, Comprehensive Energy Consumption Standards Diammonium Phosphate: Traditional method – Granular form: ≤325 kgce/t·P2O5; Slurry method – Granular form: ≤260 kgce/t·P2O5 Ammonium Phosphate: Slurry method – Powder form: For Class I phosphate ore: ≤230 kgce/t·P2O5; For Class II phosphate ore: ≤310 kgce/t·P2O5; For granular form: For Class I phosphate ore: ≤240 kgce/t·P2O5; For Class II phosphate ore: ≤340 kgce/t·P2O5 Sulfuric Acid: Produced from sulfur: ≤-80 kgce/t·H2SO4; Produced from pyrite: ≤-60 kgce/t·H2SO4 Note 1: Class I phosphate ore refers to phosphate ore or processed ore powder (or slurry) used in the production of wet-process phosphoric acid and phosphatic fertilizers, with a P2O5 content of over 28.5%, and an impurity content of Fe2O3 + Al2O3 less than 6.5%. Note 2: Class II phosphate rock refers to the phosphate rock ore or the processed powder (or slurry) used in the production of wet-process phosphoric acid and ammonium phosphate, with a P2O5 content of ≤28.5%, and a content of major impurities (Fe2O3+Al2O3) of ≥6.5%. (III) All slag generated as a by-product in existing pyrite-based acid production enterprises must be recycled ; Existing phosphate ammonium enterprises must have standardized phosphogypsum storage sites; those that do not yet have such sites must complete the construction of such sites within three years, and the utilization rate of phosphogypsum must reach 15% of the annual production volume within that same period. Enterprises that fail to meet the above requirements must be shut down. IV. Environmental Protection The production of phosphate fertilizers must meet **environmental protection standards; during normal operations, wastewater must be circulated in a closed system, and if discharge is necessary, it must be treated to meet the required standards before being released ; The fluorine recovery facility must be built within three years of its absence, and its proper operation must be ensured. The environmental protection standards for new projects or those undergoing renovation and expansion must meet the requirements specified in Table 3: Table 3 Environmental Protection Standards for New or Renovated Phosphamide Projects. Direct emission limits for pollution control measures: Waste water discharge volume (excluding fluoride processing units) ≤ 0.2 m3/t; Total phosphorus in waste water (expressed as phosphorus) ≤ 15 mg/l; Fluorides in waste water (expressed as fluorine) ≤ 15 mg/l; Ammonia nitrogen in waste water ≤ 15 mg/l; Particulates in exhaust gas ≤ 80 mg/Nm3. The environmental protection standards for existing phosphamide plants must meet the requirements specified in Table 4: Table 4 Environmental Protection Standards for Existing Phosphamide Projects. Direct emission limits for pollution control measures: Waste water discharge volume (excluding fluoride processing units) ≤ 0.3 m3/t; Total phosphorus in waste water (expressed as phosphorus) ≤ 20 mg/l; Fluorides in waste water (expressed as fluorine) ≤ 15 mg/l; Ammonia nitrogen in waste water ≤ 15 mg/l; Particulates in exhaust gas ≤ 120 mg/Nm3. As of January 1, 2013, existing phosphamide plants are also required to comply with the standards specified in Table 3; those that fail to meet these standards must cease operations. The construction of phosphogypsum storage sites shall comply with the requirements for Category II general industrial solid wastes as specified in the \"Pollution Control Standards for the Storage and Disposal of General Industrial Solid Wastes.\" Meanwhile, guidelines, standards, and other documents issued by relevant authorities should be followed to improve the construction and operational management of such sites, thereby preventing pollution caused by phosphogypsum. V. Safe Production Phosphorus fertilizer manufacturers must strictly comply with **laws and regulations regarding safe production, establish and improve safety production responsibility systems, and obtain a safe production license in accordance with the law. VI. Supervision and Management (1) Newly built or renovated/phased-out phosphate production facilities, as well as those for ammonium phosphate and diammonium phosphate, must meet the aforementioned entry requirements. Relevant departments shall adhere to these access requirements in tasks such as investment management for phosphorus compound fertilizer production projects, land supply, energy conservation assessment, environmental assessment, and credit financing. (II) Before the construction or renovation of wet-process phosphate production facilities, as well as the associated diammonium phosphate and ammonium phosphate production plants, are completed and put into operation, they must undergo supervision and inspection by a joint inspection team composed of industrial, land use, energy conservation, environmental protection, safety, quality inspection and other regulatory authorities at the provincial level or above, along with relevant experts, in accordance with the requirements set for entry qualifications. If, upon inspection, the requirements for admission are not met, the industry and information technology authorities shall order the enterprise to complete the relevant construction tasks necessary to meet those requirements within a specified time frame (by providing the required registration documents) ; Administrative departments responsible for energy conservation, safety, and environmental protection should impose stricter penalties in accordance with relevant laws and regulations, while also setting deadlines for corrective actions. (III) For those items that must be phased out in accordance with the **Industrial Structure Adjustment Catalogue** issued by the National Development and Reform Commission, enterprises should proactively choose options such as switching to other types of production or altering their production processes in order to accelerate the process of phasing them out. (IV) The competent authorities in the phosphate fertilizer industry at all levels should strengthen supervision and inspection of the compliance of diammonium phosphate and ammonium monophosphate manufacturing enterprises with the entry requirements. Intermediary organizations and industry associations at all levels should promote **industrial policies, strengthen industry self-discipline, and assist the relevant departments in carrying out industry supervision and management. (5) For new or expanded production projects of wet phosphoric acid, diammonium phosphate, and ammonium phosphate that do not meet these admission requirements, the departments responsible for energy conservation, safety, and environmental protection shall not grant approval; financial institutions shall not provide credit support, and power supply agencies shall cease power supply in accordance with the law. For enterprises ordered to close by the local people, the administrative departments for industry and commerce shall order them to go through cancellation registration or have their business licenses revoked in accordance with the law. VII. Supplementary Provisions (1) These admission requirements apply to all types of ammonium diphosphate and ammonium monophosphate manufacturing enterprises within the territory of the People’s Republic of China. (II) These admission requirements shall come into effect as of [date] in 2011, and shall be revised from time to time in light of the development of the phosphate compound fertilizer industry and **macro-control requirements. These admission requirements are interpreted by the Ministry of Industry and Information Technology of the People’s Republic of China.
There may be loopholes in the entry requirements. In the phosphorus chemicals industry chain, in addition to fertilizer-grade phosphates (ammonium phosphate), there are also feed-grade phosphates and industrial-grade phosphates. In both fertilizer-grade phosphate and feed-grade phosphate production, phosphogypsum is generated, and the two can be converted into one another. If you restrict the production of monoammonium phosphate, then these companies will say that they will not produce monoammonium phosphate, but instead will produce light calcium phosphate, or calcium dihydrogen phosphate of fertilizer grade (also known as superphosphate or heavy calcium phosphate). Either way, they are all fertilizers that provide phosphorus, and the production process is simpler since there’s no need to consider nitrogen. Therefore, if phosphatic ammonium is restricted, these companies will switch to producing heavy calcium carbonate overnight, thereby also avoiding the policies. As a result, although feed-grade phosphates also produce phosphogypsum, policies allow companies to find loopholes to take advantage of this. **If entry requirements are established, consideration should not be given only to monoammonium phosphate and diammonium phosphate; a comprehensive approach should be adopted that covers all phosphorus-based chemical products.
