Notice on Issues Related to the Implementation of the 2009 \"Beijing Construction Project Time Standards\" and the 2009 \"Beijing Building Renovation Project Time Standards\" Jing Jian Fa [2010] No. 255 To all relevant units: In order to strengthen the management of construction timelines for construction projects and building renovations, and to ensure the quality and safety of such projects, and in light of the actual conditions in our city, the following provisions are hereby issued regarding the implementation of the 2009 \"Beijing Construction Project Time Standards\" and the 2009 \"Beijing Building Renovation Project Time Standards\" (hereinafter referred to as the time standards): 1. The time standards serve as a basis for preparing project bidding documents, signing construction contracts, and determining reasonable construction timelines; It also serves as a reference for construction companies to prepare construction organization plans, determine bidding deadlines, and arrange the construction schedule. II. The number of days specified in the schedule quota for the project duration (hereinafter referred to as the quota duration) refers to the total number of calendar days from the date of project commencement until the completion of all tasks stipulated in the contract, and until the conditions for completion inspection as specified in the contract are met and an application for completion inspection is submitted. III. The tenderer shall calculate the construction period based on the standard construction time schedule and specify it in the tender documents. When the tenderer requires a construction period shorter than the standard period, the additional costs must be specified in the tender documents, and the reduced duration shall not exceed 30% of the standard period. If it exceeds 30%, it shall be regarded as the employer arbitrarily reducing the reasonable construction period, and the matter shall be handled in accordance with the Regulations on the Quality Management of Construction Projects. IV. When the deadline specified in the tender documents is shorter than the standard deadline, when establishing the tender control price (base price), the tenderer shall prepare a construction plan that ensures the project is completed on time while maintaining quality and safety standards; the cost increase resulting from the shortened deadline shall be calculated based on this plan ; For those without a construction plan, the additional cost for compressing the schedule is determined in accordance with the following principles. (1) When the reduction in the scheduled construction period is within 5%, the cost reduction for each day of shortening the period is calculated by multiplying the project cost (excluding equipment costs, the same below) by the following rate: 0.2‰ for building projects and rail transit projects ; 0.6‰ for municipal engineering and building repair work. However, the cost increase for compressing the project timeline shall not exceed 2% of the project cost. (II) When the reduction in the scheduled construction period is within 5% to 10%, the cost reduction for each day of reduction is calculated by multiplying the project cost by the following rate: 0.4‰ for building projects and rail transit projects ; 1‰ for municipal engineering and building repair work. However, the cost increase for compressing the schedule shall not exceed 3% of the project cost. V. When the tenderer reduces the scheduled construction period by more than 10%, the tenderer shall organize experts from relevant fields to conduct a feasibility study of the construction plan, and bear the responsibility for ensuring the quality and safety of the project. When establishing the tender control price (base price), the tenderer should calculate the costs associated with shortening the project timeline and the expenses for accelerated work based on the approved plan ; For those without a formulated construction plan, the fees for reducing the project duration and the costs associated with accelerated work shall be determined in accordance with the following principles: for days within 10% of the prescribed project duration, the fee for reducing the duration shall be calculated as specified in point 4.(ii) of this notice ; For days other than 10%, for each day the construction period is shortened, the cost of expedited construction measures is calculated by multiplying the project cost by the following rate: 1‰ for building projects and rail transit projects ; 3‰ for municipal engineering and building repair work. VI. The additional costs resulting from the reduced construction period as calculated by the tenderer, as well as the costs associated with accelerated construction measures, shall be listed separately; only taxes will be applied to these amounts, which will then be included in the total price. VII. When submitting a bid, the bidder must meet the deadline specified in the tender documents. When the deadline required in the tender documents is shorter than the standard deadline, the construction plan included in the bidder’s submission must include measures to complete the work on time while ensuring project quality and safety. And assume responsibility for ensuring the quality and safety of the project. The costs for compressing the project timeline and for accelerating construction work should be quoted in accordance with the construction plan and listed separately, to be included in the total price. This fee shall not be used as a factor for giving discounts. VIII. Principles for determining the actual completion date of a project: (1) If a construction project passes the completion inspection, the date of passing such inspection shall be regarded as the completion date. (II) If the contractor has submitted the completion acceptance report and the employer delays the acceptance process, the date on which the contractor submitted the completion acceptance report shall be regarded as the completion date. (III) If the construction project is used by the employer without going through the completion acceptance process, the date on which possession of the construction project is transferred shall be deemed the completion date. 9. If the project does not commence as scheduled in the contract, or if the actual completion date of the project differs from the completion date specified in the contract, the employer and the contractor shall complete the written confirmation procedures within the time frame stipulated in the contract. The losses resulting therefrom shall be borne by the party at fault. 10. For construction projects not listed in the schedule of construction periods, the employer shall organize relevant experts to conduct evaluations and determine a reasonable construction period that ensures the quality and safety of the project, and submit it to the Beijing Construction Project Cost Management Office. 11. For projects awarded through direct contracting, the employer and the contractor shall comply with the provisions of this notice. XII. The standard construction period shall come into effect as of January 1, 2010. Projects for which the tender documents were filed or contracts were signed prior to January 1, 2010, will not be subject to any adjustments. This notice shall come into effect as of July 1, 2010.
