Within how long after an injury at work does death qualify as a work-related death?
According to the provisions of China’s Work-related Injury Insurance Regulations, the death of an employee resulting from work is considered a work-related injury death. As for the time frame for determining death resulting from a work-related injury, there is no clear specification regarding how much time is required for it to be considered a work-related death. In practice, a comprehensive assessment must be carried out based on the actual circumstances, taking into account various factors such as the severity of the injury, the medical treatment received, and the time of death, in order to determine whether it constitutes a work-related death. In the event of a dispute, it can be resolved through methods such as filing complaints, seeking mediation, or going to arbitration with the relevant authorities. .
Death within 48 hours of a work-related injury is considered a work-related death. If an employee dies from a sudden illness at the workplace during working hours, or dies despite emergency treatment within 48 hours, it is considered an occupational injury
