Several Provisions on the Efficient Use of Land in the Construction of Chemical Enterprises Article 1 These provisions are formulated in order to implement the basic national policy of \"making full use of and rationally utilizing every inch of land, as well as effectively protecting arable land,\" so as to ensure rational and efficient use of land in chemical industry construction and to improve land utilization rates. Article 2 These provisions apply to the construction of new, expanded, and renovated chemical enterprises. Article 3: Land used for chemical industry construction shall be governed by the “Land Administration Law of the People’s Republic of China” and the “Interim Measures for the Management of Construction Land Planning” jointly issued by the **Planning Commission and the **Land Administration Bureau. It must also comply with all relevant current standards and specifications promulgated by ** and other competent authorities. Article 4: Chemical construction (production) units and design firms shall earnestly implement the ‘five modernization’ guidelines of ‘integrated plant layout, open-air production facilities, lightweight buildings and structures, socialized utility systems, and localization of imported technologies’. Article 5: The land use plan for chemical construction projects shall follow the following principles: 1. Land use for chemical construction projects (including technical renovation projects that require additional land). It must comply with the provisions of the Interim Measures for the Management of Construction Land Planning. Formulate a land use plan for construction purposes ; II. Various construction lands included in the land use plan. It must comply with the relevant provisions of the Land Administration Law of the People’s Republic of China. Implement comprehensive planning and integrated balancing for various construction lands, giving priority to key areas while also taking into account general ones ; III. Make rational use of land and practice conservation, and effectively protect arable land; where there is unused or substandard land available, arable and high-quality land should not be occupied. Article 6 Land use for chemical construction projects (including new construction, expansion, and renovation projects). The design unit shall prepare the land acquisition plan based on the general layout plan approved by the design approval authority, and the land can be acquired only after it is approved by the relevant departments. When a factory is built in phases, land should be acquired in phases as well. Land shall not be requisitioned in advance for future use; it is strictly prohibited to requisition land without utilizing it. Moreover, illegal occupation of land is absolutely forbidden. Article 7 Chemical engineering construction (production) units shall, in accordance with **the relevant regulations on quota indicators for land use in construction projects**, describe the various land use aspects of the project in the project construction proposal. And is responsible for the rational use of the expropriated land. Article 8: The entity responsible for preparing the feasibility study report or design shall, during the preparation of the project’s feasibility study report and preliminary design, organize relevant professionals to propose measures for conserving land, in conjunction with the construction plan or design plan. The design documents should contain a dedicated section discussing the economic viability of the land used for the project as well as the options for land use (including comparisons of different plans regarding the area of land required for the construction, the current cropping conditions and yields of the land in question, and any demolition activities that may be necessary). Otherwise, the feasibility study report and the authorities responsible for approving the design should refuse to give their approval. Article 9: The transportation planning department of the design unit shall play a leading role in the rational use of land and the improvement of land utilization efficiency. The overall layout and the site plan should be developed on the basis of a comparison of multiple options. Designers in various fields should meet the requirements of integrated plant layout. Propose planar layout conditions that facilitate land conservation. Otherwise, the general transportation specialist has the right to request the relevant specialists to make modifications. Article 10 The design of chemical plants shall adhere to the following principles of combined and centralized layout. 1. Chemical production facilities should be arranged in a centralized manner based on factors such as the nature of production, scale, operating conditions, level of automation, and safety measures, in order to enhance integration. II. When obtaining permits for production processes, fire protection, explosion prevention, and hygiene requirements, production and auxiliary production buildings (structures) should be constructed together. III. Blocks should be reasonably divided, and pipelines, pipe corridors, roads, and green spaces within the passages should be arranged in a compact and logical manner to reduce the land used for passages. IV. The space available in the pipe galleries and frames within the open-air production facilities should be fully utilized to install equipment such as heat exchangers and pumps, as well as facilities like control rooms and rest areas. V. Various warehouse facilities should be combined into large-scale, multi-story warehouses based on the nature and requirements of the materials to be stored, or silos should be used for storage. High-rise automated storage warehouses can be used when conditions permit. For the storage of bulk materials, mechanical handling equipment should be used to increase the stacking height and reduce the land area required. VI. The layout of railway lines, loading and unloading facilities, warehouses, and open storage areas should be arranged in a relatively concentrated manner, taking into account their nature and functional purposes. VII. For facilities related to administrative management, production management, and welfare services, a reasonable combination of layout and space should be made based on their functions, with the design aiming to create multi-functional complex buildings. VIII. Facilities for storage and transportation, maintenance, fire protection, public transportation, power supply, sewage treatment, etc., for the main goods in chemical industrial zones (including industrial areas or complexes primarily engaged in chemical production). It should be planned uniformly in accordance with the principle of integrated factory layout. Article 11: Auxiliary production facilities, utility facilities, transportation facilities, and welfare facilities for chemical enterprises should make full use of existing local facilities or be jointly constructed with other sectors, so as to promote greater social collaboration. Article 12: The residential areas, living welfare facilities, and public utility facilities newly constructed by chemical enterprises shall be located in a centralized manner and shall comply with the local urban planning. Its land use and various control indicators must strictly comply with the current relevant regulations issued by **or local** authorities. Article 13: The area occupied by the pre-factory zone shall be determined based on the scale of the factory and the components of the pre-factory zone. It generally accounts for 4–8% of the factory’s total land area (the lower limit applies to large and medium-sized factories, while the upper limit applies to small factories); for large chemical complexes, it should not exceed 3%. When there are very few buildings in the area in front of the factory, it is not advisable to create a separate area for that purpose. The layout of the area in front of the factory should be simple and practical, and can be improved gradually as production develops. The pedestrian plaza and parking lot in the area in front of the factory should not be too large. Article 14: The division of chemical plant districts and the size of these districts should be determined based on production and safety requirements. It is necessary to take into account the needs of different types of production and various functional zones, while also avoiding overly small district divisions that would increase the area occupied by pathways within the plant complex. Article 15: The width of the passages within the factory area shall be determined through calculation, taking into account the requirements regarding fire and explosion prevention, as well as the distance required from such passages to buildings, structures, and outdoor equipment; the functional requirements of the passages; and the required reserved width. Its reserved width is 10–20% of the calculated channel width, and the channel width must not be increased arbitrarily. Article 16: For pipelines within the corridor, except for water supply and drainage pipes, other pipelines should preferably be arranged in multiple layers above ground. When land is scarce, water supply pipes may be laid beneath sidewalks, while stormwater drainage pipes may be laid beneath roads. Article 17: In freight truck garages located in areas without heating, except for the maintenance rooms and spaces reserved for vehicles under repair, vehicles should primarily be parked outdoors, with the proportion of vehicles stored inside the garage not exceeding 15%. In heating areas, when the outdoor heating calculation temperature is above –20°C, the vehicle entry rate should not exceed 30% ; When the outdoor heating calculation temperature is below –20°C, the vehicle entry rate should not exceed 50%. Article 18: The area of storage facilities shall be determined based on local conditions, material supply, product sales, and the specific details of transportation methods, in order to shorten the storage period and reduce the required storage space. Article 19: A chemical plant may erect a wall. When a second fence is required within the plant area due to special conditions (such as highly toxic production facilities), a barrier type fence should be used; its height shall not exceed 1.5 m, and no peripheral roads shall be constructed along such barriers. Article 20: Off-site trestles, railways, roads, pipe galleries, open channels, etc. should be arranged in a concentrated and compact manner, avoiding passage through fertile fields and preventing the creation of land that is difficult to cultivate between these facilities. Article 21: The waste from chemical enterprises shall be comprehensively utilized. For waste that cannot be comprehensively utilized temporarily and is non-polluting, burial measures should be taken or it can be piled up in abandoned valleys and infertile lands. Article 22: For the overall layout of a factory constructed in phases, the projects in the earlier stages should be arranged compactly together, while the land required for later-stage construction should be reserved outside the factory. Land within the factory can be set aside only when the subsequent construction is closely related to the preliminary work in terms of production processes, pipeline installation, transportation requirements, etc., and it is necessary to reserve space within the factory. Development land may be reserved within an urban area only if there is a reliable expansion plan, or if it is necessary to reserve such land based on technical and economic evaluations. Article 23: For expansion and renovation projects of chemical enterprises, full use should be made of the land already available at the plant, as well as the existing production and auxiliary production facilities, storage and transportation facilities, loading and unloading facilities, and utility facilities. Article 24: The management system and staffing structure of chemical enterprises shall contribute to land conservation and must meet the following requirements. 1. Newly established chemical enterprises shall set up management organs in accordance with a two-level management system comprising the factory and workshop levels. Except in special circumstances approved by the competent authority, no staffing quotas shall be set for branch factories. II. The staffing levels for newly established chemical enterprises shall comply with the current relevant regulations issued by ** and the Ministry of Chemical Industry. III. For expansion and renovation projects of existing plants, the required staffing levels should be met by reallocating existing personnel from the old plant. The newly constructed residential and social welfare facilities should generally be calculated based on the number of new inhabitants. IV. Chemical enterprises should have a sound management system for general plant layout and should employ personnel responsible for such management. Responsible for the comprehensive management of land use within the approved industrial land areas. Article 25: In the overall layout of chemical enterprises, construction land shall be planned uniformly. Construction units must develop a construction organization design based on the approved construction land, and strictly control the construction of temporary facilities; the construction of permanent facilities is strictly prohibited. Construction sites should be arranged within the land acquisition scope for construction projects. Should it be necessary to allocate additional temporary land, it must be leased and returned promptly after the completion of the project. Article 26 Within the factory premises, any permanent production and auxiliary production facilities that can be utilized for construction purposes may be constructed in advance for such use, so as to reduce the amount of land required for construction. Article 27: During project acceptance, it is necessary to verify the actual amount and boundaries of land occupied by the project against the approved quantity and boundaries of land designated for the design. Article 28 These provisions shall take effect as of the date of issuance, and the Infrastructure Bureau of the Ministry of Chemical Industry shall be responsible for their interpretation.
