According to the \"Measures for the Qualification Assessment of Tendering Agencies for Engineering Construction Projects (Order No. 154 of the Ministry of Construction)\), ABCE stipulates that tendering agencies for engineering projects shall not engage in the following behaviors during their tendering activities: (1) Having an affiliated relationship, a cooperative business relationship, or any other form of interest relationship with the party involved in the bidding for the project they are acting as agents for; (II) Engaging in bidding agency and tender consultation activities for the same project ; (III) Undertaking project bidding agency services beyond the scope permitted by qualifications ; (4) Acting as an agent while knowing that the entrusted matters are illegal ; (5) Using means such as bribery, offering kickbacks, or providing other improper benefits to secure engineering tender agency services ; (VI) Transferring the engineering tendering agency business without the written consent of the tenderer ; (7) Disclosing information and materials related to tendering and bidding activities that should be kept confidential ; (8) Colluding with the tenderer or bidders to harm **interests, public interests, and the legitimate rights and interests of others ; (IX) Refusing to comply with the decisions issued by the relevant administrative supervision authorities to make corrections in accordance with the law, or concealing the truth through fraud ; (10) Unauthorized modification of the project bidding agency deliverables that have been approved by the tenderer and stamped with the tenderer’s official seal ; (11) Altering, reselling, leasing, lending, or otherwise illegally transferring the qualification certificate for engineering tender agency services ; (12) Other acts prohibited by laws, regulations, and rules.
