Qualification assessment for consortia to undertake general contracting projects

Recently, the Ministry of Housing and Urban-Rural Development and the **National Development and Reform Commission jointly issued the \"Administrative Measures for General Contracting of Building and Municipal Infrastructure Projects\" (hereinafter referred to as the \"Administrative Measures for General Contracting\”), which came into effect on March 1, 2020. Article 10 of Chapter 2 of the \"Administrative Measures for EPC Projects\" stipulates: \"An EPC contractor shall possess both engineering design qualifications and construction qualifications appropriate to the scale of the project, or it shall form a consortium consisting of design and construction units with corresponding qualifications.\" ” So, how are the qualifications of a JV determined? Is it sufficient for a JV to be formed simply by having engineering design qualifications and construction qualifications?
The previous \"Administrative Measures for EPC Projects\" stipulated that, with regard to the qualification requirements for consortia, the highest standard applied, and the JV had to have the party with the higher qualifications as its lead member.
The rules are too rigid and the explanations too detailed – then what’s the need for so many regulatory agencies?
