Analysis of the differences between full-process engineering consulting and engineering general contracting; Definition and characteristics of engineering general contracting; The EPC model originated in the United States in the 1980s, and has developed and matured rapidly in the international engineering construction market; it is now a commonly used approach for organizing engineering construction projects worldwide. Based on the different stages involved in the value chain, the engineering general contracting model can be mainly divided into the following types: 1. Design+Procurement+Construction (EPC) general contracting: The contractor is responsible for the entire process of designing, procuring, constructing, and installing the project, delivering a completed facility ready for use to the owner. This is the most typical general contracting model. 2. Design + Construction turnkey contract (DB): The contractor is responsible for the design and construction services of the project. 3. “Design + Procurement” EPC: The contractor is responsible for the design and procurement of the project; they may also provide consulting services to the owner during the construction phase, or take charge of construction management. The construction work is carried out by other contractors. 4. “General Contracting” (GC): The contractor is primarily responsible for construction and installation, and does not participate in other stages of the value chain. 5. “Turnkey” project general contracting: It is an extension of EPC project general contracting, extending backward to feasibility studies and forward to commissioning operations. Compared with several other models of construction project management, the EPC model has the following characteristics: 1. It adopts a fixed-price contract. The EPC contract is a fixed-price contract, meaning the final settlement price for the project is the total contract price plus any possible adjustments. Under normal circumstances, owners rarely allow contractors to adjust the contract price due to changes in costs; such adjustments can only be made when the owner changes the scope of work or the details of the construction. Therefore, the EPC model places high demands on the contractor’s bidding capability and risk management ability. In practice, in order to properly manage the risks associated with fixed-price contracts, the EPC model is generally used for projects where the scope of construction, scale, standards, and functional requirements are well defined. 2. The project is managed by the owner or a representative appointed by the owner. Under the EPC model, the owner primarily uses the engineering general contract to hold the general contractor accountable, ensuring the achievement of the project objectives. Under this model, the owner involves little in the management work themselves; typically, they handle project management either personally or by assigning a representative of the owner. Under normal circumstances, the owner’s representative will be considered to have all the rights of the owner as stipulated in the contract, in order to carry out the tasks assigned to him by the owner. Regarding the specific work carried out by the contractor, the owner intervenes little or not at all, and only provides overall, principled, and goal-oriented coordination and control for the entire turnkey project. 3. The contractor bears most of the risks. Under the EPC model, the engineering general contractor assumes most of the responsibilities and risks, and is fully accountable for the project’s safety, quality, schedule, and cost. The definition and scope of services for whole-process engineering consulting are described in the pilot work plans for whole-process engineering consulting in some provinces. For example, the \"Work Plan for Piloting Full-Process Engineering Consultancy in Hunan Province\" issued by Hunan Province states that \"full-process engineering consultancy refers to the practice where the project owner entrusts all engineering consultation services to a single company during the project construction phase; this company is then responsible for providing services such as project planning, feasibility studies, environmental impact assessments, engineering surveys, design work, project supervision, cost consulting, and bidding agency services.\" ”The pilot plan for Fujian Province lists the services provided under full-process engineering consulting: these services include, but are not limited to, project decision-making and planning, preparation of project proposals and feasibility studies, overall project implementation planning, project management, handling of approvals and permit applications, surveying and design management, planning and design optimization, project supervision, bidding agency services, cost consultation, post-evaluation, and assistance with audits – all of which are part of engineering management activities. They may also include engineering design activities such as planning, surveying, and design. The Jiangsu Provincial Department of Housing and Urban-Rural Development’s “Guiding Opinions on Promoting Project Management Consulting Services throughout the Entire Construction Process” (Su Jian Jian Guan [2016] No. 730) provides a clear definition of full-process project management, which refers to the comprehensive integration of various consulting services required during the construction process, such as preliminary consultation, bidding agency services, cost estimation, project supervision, and other related services. It encourages project owners to entrust all project management consulting services for the entire process to a single company, so as to obtain comprehensive project management support that covers all stages, from preliminary planning and preparation before construction, through the construction phase itself, to completion inspection and post-construction maintenance. ”In summary, whole-process engineering consulting provides engineering consultation services that cover all aspects related to organization, management, economics, and technology, including design and planning, throughout the entire life cycle of engineering construction projects – from the preliminary research and decision-making stages to project implementation and operation. It encompasses both engineering management activities and production-related tasks such as design, and involves management services at various stages of a construction project’s life cycle, including planning and consultation, preliminary feasibility studies, engineering design, bidding agency services, cost consultation, project supervision, preparation before construction, management during construction, completion acceptance, and operation and maintenance. The relationship between full-process engineering consultation and EPC 1. Full-process engineering consultation provides engineering consultation services that cover all aspects related to organization, management, economics, and technology, including design and planning, throughout the entire life cycle of a construction project – from the initial research and decision-making stages to project implementation and operation. Although it involves activities such as planning, surveying, and design, it leans more towards engineering management services and constitutes a type of project management approach. 2. EPC contracting refers to a production organization method in which an enterprise engaged in EPC contracting, entrusted by the owner, undertakes the entire process or certain stages of a project, including investigation, design, procurement, construction, and commissioning (final acceptance), in accordance with the contract terms, and assumes full responsibility for aspects such as the quality, safety, schedule, and cost of the project. 3. From the perspective of the contractual relationship, full-process engineering consulting involves taking on the task of managing and providing services for the entire project on behalf of the client; it is more akin to a commission contract, as it entails providing paid consulting services to the client. In contrast, under the general contracting model, the contractor and the client enter into a contract that specifies the rights and responsibilities of both parties. 4. In terms of the scope of management and the nature of the work, companies that provide end-to-end consulting services have a broader scope of management; their duties encompass all management and consulting services throughout the entire life cycle of a project. In addition to assisting clients with opportunity analysis, project proposals, feasibility studies, and the selection of appropriate partners in the early stages, these companies are also responsible for managing and supervising those partners, as well as providing consultation on bidding processes, cost estimation, supervision, and other related aspects. The EPC contractor, based on the results of negotiations with the owner, participates in certain stages of the project value chain as stipulated in the contract; the most typical ones are the design, procurement, and construction phases. 5. In terms of the risks assumed, the general contractor is responsible for all aspects of the project, including quality, cost, and timeline, which means they face greater risks. On the other hand, engineering consulting firms provide a range of consulting services for the entire project, receive compensation as agreed in the contract, and assume certain management responsibilities, thus facing relatively lower risks. The two models of whole-process engineering consulting and engineering general contracting complement each other and promote one another. According to the \"Several Opinions on Further Promoting the Development of EPC Projects\" (Jian Shi [2016] No. 93) and the latest issued \"Draft Measures for the Management of EPC Projects in Housing Construction and Municipal Infrastructure Projects (for Comment)\" (Jian Shi She Han [2017] No. 65), which set out requirements regarding project management by the project owners, it is clearly stated that \"project owners should strengthen the overall management of EPC projects throughout their lifecycle and ensure that the EPC contractors fulfill their contractual obligations.\" Based on its own resources and capabilities, the project owner can manage the EPC project on its own, or it can entrust a project management company to manage the EPC project in accordance with the contract. The project management unit can be the entity that conducted the feasibility study, conceptual design, or preliminary design for this project, or it can be another entity involved in engineering design, construction, or supervision; however, the project management unit must not have any conflicts of interest with the general contractor for the project. This means that for a project construction, the EPC model can be adopted, or a project management company can be hired to oversee it as well. Companies that provide full-process engineering consulting services utilize their expertise in management, technology, law, and other areas. Entrusted by project owners, they ensure the smooth progress of projects through supervision, management, and consulting services for general contractors, which contributes to the healthy development of the general contracting market.
