Article 58 The department responsible for the safety supervision and management of special equipment shall, when carrying out the licensing tasks stipulated in this Law, conduct examinations in accordance with the conditions and procedures set forth in this Law and other relevant laws and administrative regulations, as well as the requirements of safety technical specifications； Those that do not meet the requirements shall not be approved. Interpretation of the provision: This article sets out the requirements for the safety supervision and administration authorities responsible for special equipment to carry out administrative licensing tasks. I. The licensing of special equipment is carried out by the departments responsible for the supervision and management of special equipment safety. (1) Administrative licensing, also known as administrative approval, is currently a means of market access; it represents an important tool through which administrative authorities exercise prior supervision and management over socio-economic affairs in accordance with the law. It refers to the act by which an administrative authority, upon receiving an application from a natural person, legal entity, or other organization and after conducting a lawful review, grants them permission to engage in specific activities, recognizes their qualifications, or determines their status as a particular subject with specific qualifications or identities. (II) In accordance with the provisions of this law, the licensing of special equipment is carried out by the departments responsible for the supervision and management of special equipment safety. This law does not clarify the division of responsibilities between the department responsible for such supervision and management at the national level and the departments at the provincial level in terms of administrative licensing. With the gradual establishment of the service-oriented ** concept, the regulatory methods employed by departments responsible for the safety supervision of special equipment must also evolve. Looking at the overall development trend, certain areas currently under administrative licensing will have such licensing abolished, delegated, or have their management methods changed; administrative licensing will be retained only in necessary areas. The ongoing reform of the administrative approval system by the State Council is in line with this trend of change; some administrative permits may undergo changes such as being delegated or abolished as part of this reform. The law does not provide detailed regulations in this regard in order to leave room for such reforms, with the specific agencies responsible to be determined once the reform is completed. II. In accordance with the provisions of this law, the departments responsible for the supervision and management of the safety of special equipment shall conduct reviews strictly in line with the conditions and procedures for administrative licensing, and shall not abuse their approval powers. The conditions and procedures for administrative licensing mainly consist of three aspects: (1) The licensing conditions and procedures stipulated by this law: This law sets out clear regulations regarding the licensing conditions and procedures for producers of special equipment (including those involved in design, manufacturing, installation, modification, and repair), units that handle mobile pressure vessels and gas cylinders, as well as institutions responsible for the inspection and testing of special equipment. (II) Conditions and procedures stipulated by other laws and administrative regulations: The department responsible for the safety supervision and management of special equipment shall also examine permission applications in strict accordance with the conditions and procedures specified by laws such as the Administrative License Law and other administrative regulations. In accordance with the provisions of the Administrative License Law, the following conditions and procedures must be met: 1. Submission of an application for an administrative license. Administrative licensing is an administrative act that is based on an application; without an application from the applicant, the authority responsible for granting licenses cannot take action to issue such licenses on its own initiative. Applications for administrative permits should generally be submitted in written form or in a format that complies with the regulations on administrative permits. The application for administrative licensing shall meet the requirements of the public announcement model text. An application for administrative permission is a legal act; when an applicant submits such an application, the department responsible for the supervision and management of safety related to special equipment must examine the application and make a decision on whether to grant permission within the statutory time limit. 2. Acceptance of administrative license applications. Upon receiving the application for administrative permission submitted by the applicant, the department responsible for the supervision and management of safety in special equipment shall examine the application and decide whether to accept it. The main aspects considered in the application review include whether the matter in question falls under the jurisdiction of this authority, whether the applicant meets the statutory requirements, and whether the application and other documents meet the required standards, among others. The department responsible for the supervision and management of special equipment safety that meets the requirements shall accept the application; if it does not meet the requirements, it shall request the applicant to make corrections or provide additional information. If such corrections or additional information cannot be provided, the department responsible for the supervision and management of special equipment safety shall refuse to accept the application and inform the applicant in writing. 3. Examination of administrative licenses. After accepting the applicant’s application for a license, the department responsible for the safety supervision and management of special equipment must conduct a review within the specified time frame and decide whether to grant or deny the license. The review following acceptance is a substantive examination of the license application, focusing on whether the applicant’s application meets the statutory requirements and standards. The verification and review of substantive contents shall comply with the relevant provisions of the Administrative Licensing Law. The department responsible for the supervision and management of the safety of special equipment shall, upon conducting a thorough review and finding that the applicant meets the statutory requirements, issue a decision granting permission and issue the administrative license in accordance with the provisions of the Administrative License Law. For those that do not meet the statutory requirements, a written decision denying approval shall be issued to the applicant within the statutory time limit, stating the reasons and informing the applicant of their rights to administrative litigation or appeal. 4. Requirements of safety technical specifications: Where the safety technical specifications set forth clear requirements regarding qualifications, these must also be strictly complied with. As stipulated in the \"Requirements for Licensing the Manufacturing of Boilers and Pressure Vessels,\" the requirements for obtaining such a license, the requirements related to quality management systems, and the safety and quality standards for boiler and pressure vessel products are outlined. Manufacturing enterprises must meet both the basic conditions specified in these documents and the relevant specific requirements in order to obtain the license. (III) In accordance with the provisions of this article, where the requirements mentioned above are not met – for instance, if the applicant’s application materials do not satisfy the legal requirements or if it is verified that the applicant has provided false information – the department responsible for the supervision and management of special equipment safety will decide not to grant the approval.
