Chapter 1: General Provisions Article 1: These measures are formulated in light of the current conditions in the equipment manufacturing industry, with the aim of promoting its rapid development, strengthening and improving self-regulation within this sector, standardizing the production practices of equipment manufacturing enterprises, and raising the quality of equipment. Article 2 These measures shall apply to enterprises within the People’s Republic of China that hold a Business License for Enterprise Legal Persons and are engaged in equipment manufacturing and business operations. Article 3 The equipment referred to in these Measures means fixed assets such as machines, facilities, instruments, and tools that can be used for a long term in fields such as production, operation, testing, office work, and daily life. Article 4: Equipment manufacturing refers to the process of producing various types of equipment, from design based on blueprints, product finalization, component production, to the assembly into finished products. Article 5: The qualification of equipment manufacturing enterprises refers to the compliance with the requirements for such enterprises, as well as the acquisition of the \"China Equipment Manufacturing Enterprise Qualification Certificate\" issued by the qualification certification authority. This certificate specifies the category and level of qualification, the scope of business, and the certificate number. Article 6: For the qualification certification of equipment manufacturing enterprises, a system of \"one license per certificate\" is implemented; that is, the business scope of the manufacturing entity applying for qualification certification must be consistent with the contents of its Business License as a corporate entity. Article 7: The System Innovation Working Committee of the China Equipment Management Association, together with the provincial, autonomous region, municipal, central city, and industry equipment management associations entrusted with this task, serve as certification bodies for equipment manufacturing enterprises, each fulfilling its responsibilities according to its assigned role. In provinces, autonomous regions, municipalities directly under the Central Government, central cities, and industry equipment management associations that have not entrusted a certification body, a certification body shall be designated by the Committee on Institutional Innovation of the China Equipment Management Association to carry out the certification. Article 8: The examination and annual review for the qualification certification of equipment manufacturing enterprises are carried out by the qualification certification agencies of the provincial, autonomous region, municipal, central city, or industry equipment management associations that have been entrusted to do so. Article 9 Equipment manufacturing enterprises shall carry out their business in accordance with the category, grade, and scope of operations specified in the \"Qualification Certificate for Chinese Equipment Manufacturing Enterprises\" issued by the qualification certification authority. Article 10: The qualification certification process for equipment manufacturing enterprises shall earnestly implement relevant laws, regulations, and policies, rely on various functional departments, and fully play a role in serving these enterprises. Article 11: The administrative measures for the qualification certification of industry equipment manufacturing enterprises shall be formulated in accordance with these provisions and filed with the System Innovation Working Committee of the China Equipment Management Association. Chapter 2 Industry Categories and Qualification Levels for Equipment Manufacturing Enterprises Article 12 The industry classifications for equipment manufacturing enterprises are as follows: general equipment manufacturing, special equipment manufacturing, transportation equipment manufacturing, electrical machinery and equipment manufacturing, communication equipment manufacturing, computer and other electronic equipment manufacturing, and instrumentation sowie cultural and office machinery manufacturing. Article 13: The qualification levels of equipment manufacturing enterprises are divided into special grade, first grade, second grade, third grade, and fourth grade. Article 14: Managers and professional technical personnel of enterprises applying for equipment manufacturing qualification certification shall possess the corresponding qualification certificates; technical workers in special types of jobs must hold special operation permits issued by the relevant authorities. Chapter 3: Assessment Criteria for the Qualification Grades of Equipment Manufacturing Enterprises Article 14: If an equipment manufacturing enterprise wishes to obtain certification, it must submit the required documents in accordance with the regulations set forth in the certification procedures, and ensure that such documents are true, accurate, and complete. Article 15 The assessment items for qualification levels include the following main aspects: 1. The scale of the enterprise’s registered capital ； II. Total number of employees and the proportion of mid-to-senior level technical personnel ； III. Number of independent intellectual property rights held ； IV. Product market share and export earnings capacity ； 5. Whether awarded honorary titles by ** or relevant departments at the provincial or ministerial level or above ； Lu, whether subject to administrative penalties by the relevant authorities ； Is the organizational structure of the enterprise scientific and reasonable, and are all management systems sound and complete? ； Well, are there any innovations in terms of energy conservation, environmental protection, and reduced consumption in the equipment produced by enterprises? ； 9. Other materials ； Chapter 4 Procedures and Approval Authority for the Certification of Equipment Manufacturing Enterprises Article 16 The application for certification as an equipment manufacturing enterprise involves an initial application review and annual reviews conducted in accordance with relevant regulations. The review period shall be completed within 30 days from the receipt of the enterprise’s application materials. Equipment manufacturing enterprises can apply for one or more qualification categories and levels simultaneously, and can apply for qualification upgrades based on their business performance. For newly established enterprises, their qualification level is assigned at the lowest level, with a one-year probation period. The certification authority shall organize an annual audit for enterprises that have obtained the qualification certificate for equipment manufacturing, within two months prior to the expiration of each year of the certificate’s validity period. Article 17: For the examination and annual review of the qualification certification for equipment manufacturing enterprises, the qualification certification authority may charge a certain fee for such certification services. Article 18: Approval authority for the qualification certification of equipment manufacturing enterprises. (1) The authority for approving the qualification certification of equipment manufacturing enterprises follows a system of review and approval. (II) The qualification certification agencies are responsible for reviewing initial applications and conducting annual reviews for qualifications of various categories and levels. They also submit the review and annual review results along with the relevant documents of the enterprises that have obtained such qualifications to the System Innovation Working Committee of the China Equipment Management Association for record-keeping. (III) The Working Committee on Institutional Innovation of the China Equipment Management Association is responsible for reviewing certification bodies and approving their annual audit opinions. Article 19: The Working Committee on Institutional Innovation of the China Equipment Management Association has the right to inspect, supervise, and revoke the qualifications of certification bodies as well as their certification activities. Article 20: For enterprises of the top-tier and first-tier categories in each category, the on-site inspection rate by qualification certification agencies shall reach 100%; for enterprises of the second-tier, third-tier, and fourth-tier categories, on-site random inspections shall be conducted. Article 21 Procedures for the Qualification Certification of Equipment Manufacturing Enterprises (1) Any enterprise applying for equipment manufacturing qualifications shall submit the \"Application Form for Qualification Certification of Chinese Equipment Manufacturing Enterprises\" along with relevant documents to the qualification certification authority, which will then conduct a review. (II) After receiving the application materials from the enterprise, the qualification certification agency shall promptly review the materials and conduct an on-site inspection of the applying enterprise. Following a review by qualification certification experts, the agency shall fill in its opinions on the \"China Equipment Manufacturing Qualification Certification Approval Form\". (III) When the qualification certification body conducts the evaluation, the System Innovation Working Committee of the China Equipment Management Association sends representatives to participate in the review, which serves as a reference for approval and helps to organize the evaluation process. (IV) The System Innovation Working Committee of the China Equipment Management Association will announce the enterprises that have passed the review; once there are no objections, it will enter the approval remarks on the \"China Equipment Manufacturing Qualification Certification Approval Form\" and issue the \"China Equipment Manufacturing Enterprise Qualification Certificate\". Article 22: During the annual review for qualification certification, the \"Annual Review Form for Qualification Certification of Chinese Equipment Manufacturing Enterprises\" and other relevant documents must be submitted. Article 23: The “Application Form for Qualification Certification of Chinese Equipment Manufacturing Enterprises” is standardized by the Committee on System Innovation of the China Equipment Management Association; the certification authority is responsible for its printing, while the “Qualification Certificates for Chinese Equipment Manufacturing Enterprises” are printed by the Committee on System Innovation of the China Equipment Management Association. Article 24: The “Application Form for Qualification Certification of Chinese Equipment Manufacturing Enterprises” shall include the following contents: (1) General information on the enterprise ； (II) Organizational structure and manufacturing site conditions ； (III) Situation of engineering and technical personnel and skilled workers ； (IV) Condition of main equipment and tools used ； (V) Operating performance ； (VI) Ownership of intellectual property rights ； (7) Copy of the honorary title certificate ； (8) Are there any innovations in the fields of environmental protection, energy conservation, and cost reduction? ； Article 25 Enterprises applying for the certification of equipment manufacturing qualifications for the first time shall submit the following materials: (1) “Application Form for Certification of Qualifications of Chinese Equipment Manufacturing Enterprises” ； (II) Copies of the business license for corporate entities, as well as copies of the national and local tax registration certificates and the organization code certificate, all stamped with the official seal ； (III) Appointment documents, professional title certificates, and copies of ID cards of the legal representative of the enterprise, as well as the key technical, financial, and operational managers of the enterprise ； (IV) Intellectual property rights certificate ； (V) Most recent annual balance sheet and income statement ； (6) Copy of the certificate proving the right to use the factory building and premises. Chapter 5: Management of the \"Qualification Certificates for Chinese Equipment Manufacturing Enterprises\" Article 26: The \"Qualification Certificates for Chinese Equipment Manufacturing Enterprises\" are issued in both original and duplicate forms, and become valid once stamped by both the System Innovation Working Committee of the China Equipment Management Association and the certification body. Both the original and duplicate versions have equal legal validity, with a validity period of one year. Article 27 Qualification certification agencies are responsible for inspecting and supervising enterprises that have obtained equipment manufacturing qualifications. Article 28: When a equipment manufacturing enterprise that has obtained certification encounters one of the following situations, it shall apply to the original certification authority for the relevant procedures for modification or cancellation: (1) In the event of corporate restructuring, division, or merger, it may apply to the original certification authority for re-certification in accordance with the approval procedures set out in these regulations, based on the actual qualification criteria met. (II) When the legal representative of an enterprise or its registered address changes, it shall apply to the original certification authority to go through the change procedures. (III) If the equipment manufacturing business is terminated due to reasons such as corporate bankruptcy, or if no such business has been carried out for one consecutive year, the \"China Equipment Manufacturing Enterprise Qualification Certificate\" shall be revoked. Article 29: If a equipment manufacturing enterprise that has obtained certification falls under any of the following circumstances, the certification authority shall, depending on the severity of the situation, impose penalties such as a warning, downgrading of its status, or revocation of its certification, and shall report the matter to the System Innovation Working Committee of the China Equipment Management Association for record-keeping: (1) Changing its business scope without going through the necessary procedures in a timely manner ； (II) Those that have not applied for annual review or failed the annual review ； (III) Complaints from users or serious liability incidents arising due to poor equipment quality ； (IV) Producing obsolete products that result in severe waste of resources ； (5) Concealing the truth and engaging in fraud when applying for qualification certification or annual review ； (6) Altering, transferring, leasing, or lending the qualification certificate for use by other enterprises ； (7) Violation of **relevant laws and regulations on work safety and technical standards for safe manufacturing, with serious consequences ； (8) Seriously damaging the environment and causing major pollution incidents ； (IX) Being punished by the **relevant competent authorities for other reasons. Article 30 The decisions regarding warnings, demotion, or revocation of qualifications as stipulated in these Measures shall be made by the certification body that issued the qualification certificate. In cases where relevant laws and regulations are violated and a crime is committed, the qualification certification body may refer the matter to the relevant authorities for handling. Chapter 6 Supplementary Provisions Article 31 Qualification certification agencies may formulate relevant implementation rules in accordance with these measures. Article 32: These provisions shall be interpreted by the Committee on Institutional Innovation of the China Equipment Management Association. Article 33 These measures shall come into force as of the date of their publication
