Issues regarding penalties for excessive levels of non-methane hydrocarbons
In accordance with Article 99, Paragraph 2 of the Law of the People’s Republic of China on the Prevention and Control of Air Pollution: Those who emit air pollutants in excess of the permitted emission standards or beyond the set total emission limits for key air pollutants shall be ordered by the environmental protection authorities at or above the county level to make corrections, or to limit production or suspend operations for rectification; in addition, they shall be fined between 100,000 yuan and 1,000,000 yuan.
In accordance with Article 108, Item (1) of the Law of the People’s Republic of China on the Prevention and Control of Air Pollution: \"Whoever violates the provisions of this Law and commits one of the following acts shall be ordered by the ecological and environmental protection department of the people’s government at or above the county level to make corrections, and shall be fined not less than 20,000 yuan but not more than 200,000 yuan\"; For those who fail to make corrections, they shall be ordered to suspend production for rectification: as stipulated in cases where production and service activities that generate waste gases containing volatile organic compounds are not carried out in enclosed spaces or equipment, pollution control facilities are not installed or used as required, or measures to reduce gas emissions are not taken.
Actually, this law is contradictory; if everything is supposed to take place within enclosed equipment or spaces, then there would be no uncontrolled emissions of VOCs. So what does it mean to test for uncontrolled emissions at the factory boundary? Or does unorganized emission allow a certain amount of emissions, as long as it doesn’t exceed the limits? I can control it within my factory’s boundaries. .
