Article 31: Entities and individuals importing special equipment shall fulfill the obligation of giving prior notice to the special equipment safety supervision and management department at the place of import. Interpretation of the provision: This article deals with the notification requirements when importing special equipment. Advance notification is required for the import of special equipment, so that the authorities responsible for the safety supervision and management of such equipment can be informed, thereby enabling them to provide assistance in a timely manner and carry out supervision and management in accordance with relevant regulations. Units and individuals that import special equipment include manufacturing units abroad, agencies established in China by such overseas manufacturing units, trade organizations specialized in trade both at home and abroad, as well as units and individuals in China that use special equipment. In accordance with the Provisions on the Supervision and Management of Imported and Exported Boilers and Pressure Vessels (Trial), when entering into contracts for imported boilers and pressure vessels (including those included in complete sets of equipment), foreign trade enterprises shall assign personnel familiar with the business related to boilers and pressure vessels to participate in the negotiations. The contract or its accompanying technical terms must specify the specifications and standards that govern design, manufacturing, installation, and inspection, and require compliance with the safety performance requirements set out in China’s safety technical regulations, as well as the locations for supervision and inspection. The department to which the information is to be provided can be divided into two categories based on the nature of business operations. In the case of bulk products for which the target customers are not clear, it is the foreign trade enterprise that is responsible for informing the special equipment safety supervision and management department in the location where the business operates. With direct sales targets, the foreign trade enterprise can inform the safety supervision and management department in the location where the special equipment is used.
