Is a chimney considered an open-flame device?

Does this chimney constitute a hot surface, and does it count as a device that produces an open flame? Ask an expert! Thank you! An open flame is definitely not an option; 140 degrees isn’t considered high either. If the amount of smoke generated is low, no one will be interested in using that waste heat.
