[Fire Warning] Investigation Report on the “12·15” Major Fire at Crown Karaoke in Changyuan County

At 00:26 on December 15, 2014, a serious fire broke out at the Crown Karaoke Hall in Changyuan County; the area affected by the fire was 123 square meters. The incident resulted in 12 deaths, 28 injuries, and direct economic losses of 9.5764 million yuan. Description of how the accident occurred and emergency response measures (1) Description of how the accident occurred: At around 11:00 on December 14, 2014, Guo Donglan received five boxes of air fresheners delivered by a courier. She then placed them on the floor inside the bar counter. Around 1 p.m., while cleaning, Li Yuan moved the package to a corner inside the bar counter, near the east partition wall and a speaker; there was a turned-on electric heater nearby. During operations, staff members moving around behind the counter repeatedly touched the electric heater, causing it to press against the package containing air freshener. At around 0:26 on the 15th, Yin Junwei was sitting on a chair at the bar when an explosion and fire suddenly occurred behind him. Upon noticing the fire, those present—Yin Junwei, Kong Weizhuang, and Kong Weikai—failed to take effective measures to extinguish it immediately. They merely kicked and stepped on the burning objects and poured a small amount of water on them, but were unable to bring the fire under control. Multiple explosions and fires occurred one after another within 1 minute, and the fire spread rapidly. The hot smoke generated by the fire spread to other areas on the same floor and rapidly moved upward to the upper floors via stairwells, resulting in 12 deaths (8 men and 4 women) and 28 injuries (including 4 people who evacuated on their own and were taken to hospitals for treatment). (II) On-site inspection and determination of the site of the explosion and fire 1. Determination of the site of the explosion and fire: Upon inspection, the decorative materials in the lobby and corridors on the first floor of the building were severely burned and carbonized. The degree of damage to the decorative materials on the south wall of the lobby was greater at the bottom and less at the top, with the remaining damaged material being lower in the east and higher in the west. The surface of the sofa in the southwest corner of the hall was carbonized due to high temperatures. All of the decorative glass on the cylindrical surface of the central column has shattered and fallen off; the wooden materials on the upper part of the column and its base on the northeast side (facing the bar) have been burned and damaged. On the northeast side of the pillar, a small number of crystal pendants attached to the chandelier facing the bar area have fallen off; some have become deformed and elongated due to heat. The pendants in other directions remain largely intact. The ceiling surface above the bar shows overall signs of clean burning; in the central area, part of the plaster has fallen off, exposing the rebar inside. The cement plaster layer on the crossbeams running in the north-south direction, facing the bar side, has suffered severe deterioration. On the west side of the bar, near the north wall, the metal casing of the indoor air-conditioning unit shows signs of deformation and discoloration due to heat, with the effects being more severe on the east side than on the west. The wooden bar was completely engulfed in flames and suffered severe damage. The gypsum board on the partition wall on the east side of the bar has suffered extensive damage from fire, forming a \"V\"-shaped pattern; the exposed lightweight steel framework is deformed and discolored. “At the bottom of the “V”-shaped mark, the floor tiles were shattered; in this area, the remnants of an electric heater and numerous fragments of air freshener cans were found and recovered. The rest of the area was not affected by fire; however, there are heavy signs of smoke damage. II. The walkways and private rooms on the second and third floors were not affected by fire; there were obvious signs of smoking, with the degree of smoking being greater on the second floor than on the third floor, and greater in the walkways than in the private rooms. There is mild smoke damage in the corridors and rooms on the fourth floor, while there are no signs of smoke damage in the corridors and rooms on the fifth floor. Upon on-site inspection, various traces such as charring of combustibles, smoke staining, deformation and discoloration, cracking and detachment of floor slabs, and collapse of objects formed a complete trace system, proving that the explosion and fire originated at the location where air fresheners were stacked inside the bar counter. 2. Distribution of casualties and causes of death: 2 people on the first floor, located in the employee lounge and the south staircase on the east side ; 20 people on the second floor, distributed across 6 private rooms ; 14 people in 3 floors, distributed across 5 private rooms ; 4 people escaped on their own. The cause of death for all individuals was suffocation resulting from the inhalation of ashes and CO; among them, 9 people had blood ethanol levels exceeding the drunkenness threshold of 80 mg/100 ml. (III) Emergency response situation
1. Rescue efforts by fire services
At 00:28 on December 15, 2014, upon receiving the alarm, the Public Security Fire Brigade of Changyuan County immediately dispatched 5 fire trucks and 18 firefighters to the scene to extinguish the fire. At the same time, a report was submitted to the Xinxiang City Fire Command Center as well as the Party Committee, **, and Public Security Bureau of Changyuan County. The Xinxiang Fire Brigade dispatched 5 fire trucks and 26 firefighters to provide support, and reported the situation to the provincial fire department’s command center immediately; as a result, the command centers at both the provincial and local levels were activated. At 00:38, the rescue forces from the Changyuan County Fire Brigade arrived at the scene, forming 1 fire-fighting team and 2 rescue teams. The fire-fighting team had two water guns: one was used to combat the fire in the hall from the front, while the other was used to enter the second floor via the west staircase in order to control the fire and support the rescue team in saving people. One rescue team searched for trapped people on the first and second floors, while another team carried out demolition work to clear smoke and search for people on floors above the third. At 1:05, the open flames at the scene were extinguished. A total of 36 people trapped were rescued, 2 on the first floor, 20 on the second floor, and 14 on the third floor; they were taken to hospitals by medical teams for treatment. The search and rescue operation ended at 2:10. 2. Emergency response by the accident-affected unit: At the time of the fire, Yin Junwei and Kong Weizhang were both in the bar area on the first floor of the karaoke hall. After the first explosion and fire broke out, Yin Junwei focused only on checking the damage to his own clothes and did not put out the fire immediately. Upon arriving, Kong Weikai kicked and stamped on the burning material, but was unable to bring the fire under control. The on-site staff failed to handle the initial fire properly at the first moment, delaying the opportunity to extinguish it. The people in the rooms on the second and third floors were not notified of the fire or the need to evacuate; by the time hot smoke filled the corridors, it was already too late to escape. At the time of the fire, there were over 50 customers and employees in the club; 36 of them were rescued by the firefighters, while more than 20 people escaped through the north exit, west exit, and the south window of the bar on the first floor. 3. Upon receiving the notification regarding the local emergency situation, the leaders of Changyuan County rushed to the scene promptly, activated the emergency plan for fire incidents, and organized departments such as public security, fire services, health authorities, and safety supervision agencies to carry out firefighting efforts and provide medical assistance to those affected. At 00:38, the county’s 120 Emergency Command Center received an alarm. At 00:47, the first ambulance arrived at the scene. In total, 10 ambulances from three hospitals, along with 78 medical personnel, participated in the rescue efforts. The injured and deceased were taken to Changyuan County People’s Hospital, Hongli Hospital, and the County Traditional Chinese Medicine Hospital for treatment. After the fire broke out, the Pudong Police Station of the Changyuan County Public Security Bureau as well as patrol officers from nearby areas arrived at the scene to assist with the rescue efforts. The Special Operations Unit, the Public Order Unit, the Traffic Police Unit, the Inspection Unit, and other police stations followed suit, setting up barriers to maintain order at the scene and creating emergency lanes to ensure that rescue vehicles could pass through first. At 3:20, the county party committee and the county ** held an emergency meeting to establish an emergency command center for the fire incident, and a working group for post-incident handling was set up at 1:00 p.m. After the accident, Changyuan County **promptly released information on its website and in Changyuan News**, and held press conferences for news media such as China Central Television, Xinhua News Agency’s Henan branch, and China News Service’s Henan branch. 4. Evaluation conclusions: After the accident occurred, ** and the relevant departments promptly mobilized rescue forces to carry out on-site rescue operations, fire control, treatment of the injured, and efforts to provide comfort to those affected. As a result, the fire was effectively brought under control, preventing the accident from escalating and avoiding the occurrence of any secondary incidents. Crown Karaoke made incorrect judgments regarding the situation, used improper methods for extinguishing the fire, failed to respond promptly in the initial stages, and did a poor job in evacuating people. The main reasons for this were the lack of an emergency response plan, no fire safety training, weak awareness of fire safety issues, inadequate management of flammable and explosive materials, and blocked fire safety exits. III. Cause Analysis and Nature Determination (1) Direct cause: The convective electric heater with silicon crystal heating film used at the bar in Crown Karaoke overheated the large number of flammable and explosive canned air fresheners that were placed there in close proximity, resulting in the explosion and combustion of those air fresheners and thereby triggering the fire. Cause analysis: As a public entertainment venue, Crown Karaoke placed air fresheners with properties of being flammable, explosive, and hazardous chemicals at its bar counter, which is an illegal act. The English label on the air freshener collected from the fire scene indicates that the storage temperature should not exceed 49°C. Through on-site experiments, the maximum temperature of the heating element of the space heater can reach 235.2°C, while the maximum temperature on the back side of the corrugated cardboard placed against the protective mesh of the space heater can reach 99°C. However, the karaoke hall managers and their staff lacked awareness of the chemical hazards of air fresheners; they placed them near electric heaters, which directly led to the explosion and combustion of the air fresheners. At the time of the fire, there were 60 bottles of 18L air fresheners in the bar, representing a large quantity. Within 1 minute after the explosion and fire started, multiple explosions and fires occurred in succession, causing the fire to spread rapidly – this was the direct cause of the accident. (II) Indirect causes 1. Failure to fulfill the primary responsibility for safe production at Crown Karaoke (1) Failure to obtain a fire safety inspection certificate. Since it began operating on its own, Crown Karaoke has never obtained a fire safety inspection certificate, constituting illegal operation. (2) Fire safety responsibilities are unclear. Crown Karaoke has no fire safety management organization in place, no designated fire safety officers, and no clear definitions of the fire safety responsibilities for various positions. (3) The fire safety management systems are not effectively implemented. In the early days of its operation, Crown Lounge established fire safety protocols and emergency evacuation plans under the guidance of the county’s fire department. However, throughout its operation, it failed to comply with various fire safety regulations and procedures, including fire safety training and education, regular fire inspections, maintenance of fire-fighting equipment, proper management of heating and electrical systems, drills for firefighting and emergency evacuations, as well as mechanisms for rewarding or punishing those who violated fire safety rules. (4) No fire safety training and education was conducted. During its operation, Crown Karaoke failed to provide fire safety education and training to its employees. It did not organize any fire extinguishing or emergency evacuation drills for them. As a result, the employees were unaware of their fire safety responsibilities at their respective posts, as well as the names and purposes of the fire-fighting facilities and equipment within the premises. They also lacked the ability to operate such equipment and had poor self-rescue and escape capabilities. (5) Operating in violation of regulations by exceeding the approved number of private rooms. The Culture, Radio, Television and Tourism Bureau of Changyuan County has approved 14 private rooms, while Crown Karaoke has 19 rooms available for business use. 2. The public security and fire control authorities in Changyuan County failed to exercise strict scrutiny and oversight in their daily supervision. (1) The Pudong Police Station in Changyuan County did not effectively implement fire safety laws and regulations; it neglected its duties regarding fire safety inspections and supervision. Its inspection records and archives were incomplete. Moreover, it failed to take legal action regarding the Crown Karaoke Bar, which operated illegally for a long time without obtaining a fire safety inspection certificate ; There was inadequate supervision of fire safety units within the jurisdiction, as well as insufficient efforts in fire safety awareness campaigns and training. Failure to properly urge and guide the Crown Karaoke Hall to ensure proper fire safety measures, and failure to conduct thorough inspections of the fire safety hazards present there and order corrective actions to be taken. (2) The Changyuan County Fire Brigade failed to effectively implement fire safety laws and regulations, and provided inadequate guidance on fire safety work to the Pudong Police Station. There was a lack of strict oversight regarding the acceptance of the interior renovation work at Crown Karaoke; fire safety inspections and supervision were not carried out diligently. No legal action was taken concerning Crown Karaoke’s long-term illegal operation despite its lack of a fire safety inspection certificate. Furthermore, no measures were taken to urge Crown Karaoke to promptly eliminate potential safety hazards ; The internal fire protection records are poorly managed; the fire protection records for the Crown Lounge are missing, and the records of fire safety inspections are irregular and incomplete. (3) The Changyuan County Public Security Bureau has failed to properly implement fire safety laws and regulations; it has not adequately carried out the tasks related to addressing fire safety hazards as assigned by higher authorities and relevant departments, and it has failed to provide proper supervision and guidance to the Changyuan County Public Security Fire Brigade and the Pudong Police Station in regard to fire safety matters. 3. The Culture, Radio, Television and Tourism Bureau of Changyuan County failed to fulfill its duties related to approval and supervision; it did not conduct proper scrutiny of the fire safety approval documents for Crown Karaoke and issued entertainment operation licenses in violation of regulations ; Inadequate supervision regarding the illegal operations at Crown Lounge prior to obtaining a entertainment business license, as well as the operation of more private rooms than those permitted by the license ; Daily management is chaotic; the approval documents for Crown Karaoke’s entertainment business license are missing, and the relevant supervision and inspection records are incomplete ; The fire prevention and control measures in Changyuan County were not properly implemented; during the fire safety inspections carried out in December 2014 in entertainment venues, no fire safety hazards such as blocked fire exits, non-functional fire protection equipment, or the absence of emergency fire safety plans were found at the Crown Karaoke. 4. The Changyuan County Administration for Industry and Commerce failed to exercise strict scrutiny during the process of industrial and commercial registration. It did not verify the fire safety approval documents provided by Crown Karaoke, and contrary to regulations, it proceeded to register Crown Karaoke in Changyuan County as a sole proprietorship. 5. The Pudong Office failed to adequately fulfill its duties regarding fire safety supervision; it provided insufficient guidance and oversight for fire safety efforts in its jurisdiction, and did not promptly urge Crown Karaoke to appoint a fire safety manager ; The measures taken to clarify departmental responsibilities were inadequate, and no target responsibility agreements were signed with the various functional departments of the office ; The Office of the Fire Prevention Committee and the Work Safety Supervision Institute failed to adequately promote fire safety knowledge; their inspections and checks were ineffective, and they did not inspect key fire safety sites such as karaoke bars. 6. The people’s government of Changyuan County fails to properly implement fire safety laws and regulations, as well as the fire safety directives issued by the State Council and the provincial authorities ; Failing to urge the **department to implement the fire safety responsibility system properly, and failing to detect issues such as the inadequate performance of supervisory duties by the Pudong Office, as well as by departments responsible for fire safety and culture. (III) Nature of the incident: Upon investigation, it was determined that the “12·15” major fire at Crown Karaoke in Changyuan County was an accident resulting from failures in production safety responsibilities. IV. Determination of responsibilities and recommendations for handling (1) Persons against whom judicial authorities have taken measures 1. Kong Weikai, the owner of Crown Karaoke, was criminally detained on December 15, 2014, by the Public Security Bureau of Changyuan County on suspicion of committing a crime involving gross negligence resulting in serious consequences. On December 27, 2014, he was approved for arrest by the People’s Procuratorate of Changyuan County. 2. Yin Junwei, manager of Crown Karaoke Hall, was criminally detained on December 15, 2014, by the Public Security Bureau of Changyuan County on suspicion of committing a crime involving gross negligence resulting in serious consequences. On December 27, 2014, his arrest was approved by the People’s Procuratorate of Changyuan County. 3. Guo Donglan, cashier and purchaser at Crown Karaoke, was criminally detained on December 15, 2014, by the Public Security Bureau of Changyuan County on suspicion of committing a crime involving gross negligence resulting in serious consequences. On December 27, 2014, she was approved for arrest by the People’s Procuratorate of Changyuan County. 4. Li Yuan, a cashier at Crown Karaoke, was placed under criminal detention by the Changyuan County Public Security Bureau on December 15, 2014, on suspicion of committing a serious duty-related accident crime; he was approved for arrest by the Changyuan County People’s Procuratorate on December 27, 2014. 5. Kong Weiwei, the legal representative of Crown Karaoke, was placed under criminal detention by the Changyuan County Public Security Bureau on December 15, 2014, on suspicion of committing a serious duty-related accident; she was released on bail pending trial on December 27, 2014. 6. Jiao Luyao, the manager of Crown Karaoke, was placed under criminal detention by the Changyuan County Public Security Bureau on December 15, 2014, on suspicion of committing a serious duty-related accident; he was released on bail pending trial on December 27, 2014. 7. Jiao Lipeng, the manager of Crown Karaoke, was placed under criminal detention by the Changyuan County Public Security Bureau on December 15, 2014, on suspicion of committing a serious liability accident; he was released on bail pending trial on December 27, 2014. 8. Zhao Yongbo, a staff member of the Changyuan County Culture, Radio, Television and Tourism Bureau; from January 2006 to May 2012, he served as the head of the Cultural Market Management Office within that bureau. On January 14, 2015, he was placed under investigation and detained criminally by the People’s Procuratorate of Changyuan County on suspicion of dereliction of duty. 6. Wang Shengli, **Party member, staff member of the Changyuan County Culture, Radio, Television and Tourism Bureau; served as deputy director of the bureau from May 2010 to July 2014. On January 18, 2015, he was placed under investigation and detained criminally by the People’s Procuratorate of Changyuan County on charges of dereliction of duty. (III) Recommendations for Party and administrative disciplinary actions: 1. Hua Zhiqiang, a Party member and the head of the Pudong Police Station in Changyuan County, is responsible for overall operations of the station. Poor implementation of the fire safety hazard rectification efforts mandated by higher authorities and relevant departments; inadequate leadership in overseeing fire safety efforts at Pudong Police Station; failure to detect the illegal operation of Crown Karaoke, which was operating without a valid fire safety inspection certificate, as well as its associated fire safety hazards. Given the primary leadership responsibility for the accident, it is recommended to impose a severe warning within the party and dismiss the individual from their position. 2. Liu Yan, **Party member, currently serving as the acting deputy head of the Huixian City Public Security Fire Brigade. In May 2008, he served as a fire prevention officer in the Changyuan County Public Security Fire Brigade. In October 2011, he became the deputy head of the brigade and acting head. From October 2012 to March 2014, he held the position of head of the Changyuan County Public Security Fire Brigade. Insufficient efforts were made to implement fire safety laws and regulations and to address potential safety hazards; the issue of Crown Karaoke operating illegally for a long time without a fire safety inspection certificate, as well as its associated safety hazards, were not properly investigated or dealt with in accordance with the law. Additionally, inadequate supervision and guidance were provided regarding fire safety efforts at Pudong Police Station. As the person primarily responsible for the accident, a severe reprimand is recommended. 3. Zhou Fazhen, **Party member, fire prevention officer at the Changyuan County Public Security Fire Brigade; responsible for fire prevention supervision within that brigade. Failing to properly implement the directives from higher authorities and the Xinxiang City Public Security Fire Brigade regarding the elimination of fire safety hazards; during the fire safety inspection of the Crown Karaoke in February 2014, insufficient effort was put into the task, and it was not detected that the establishment lacked a fire safety inspection certificate or had any fire safety hazards. As the person primarily responsible for the accident, a severe reprimand is recommended. 4. Ma Zhengjun, **Party member, currently serves as a fire prevention officer in the Xinxiang Public Security Fire Brigade. From June 2012 to March 2014, he held the position of deputy team leader in the Changyuan County Public Security Fire Brigade. Failing to properly implement the directives from higher authorities and the Xinxiang City Public Security Fire Brigade regarding the elimination of fire safety hazards; during the fire safety inspection of the Crown Karaoke in February 2014, insufficient effort was put into the task, and it was not detected that the establishment lacked a fire safety inspection certificate or had any fire safety hazards. Asholding significant leadership responsibility for the accident, a reprimand is recommended. 5. Li Xiaoming, **Party member, Deputy Head of the Comprehensive Law Enforcement Team for the cultural market under the Changyuan County Culture, Radio, Television and Tourism Bureau; responsible for comprehensive law enforcement in the cultural market. No issues were found regarding Crown Karaoke operating more private rooms than permitted under its business license ; During the fire prevention and control inspection in Changyuan County, the work arrangements set by the county authorities as well as the Culture, Radio, Television and Tourism Bureau were not properly implemented; no obvious safety hazards such as blocked fire exits or the absence of emergency fire safety plans were detected at the Crown Karaoke. Given the primary leadership responsibility for the accident, it is recommended to impose a severe warning within the party and dismiss the individual from their position. 6. Mao Jianfeng, **Party member, member of the Party Committee and deputy section chief of the Culture, Radio, Television and Tourism Bureau in Changyuan County, as well as head of the personnel department. At the end of 2013, he assisted in overseeing the management of the cultural and entertainment industry; in August 2014, he was in charge of regulating this industry. Inadequate supervision and guidance were provided regarding the daily operations of the Cultural Market Comprehensive Law Enforcement Team under the Culture, Radio, Television and Tourism Bureau of Changyuan County; no issues were detected regarding Crown Karaoke Hall operating more private rooms than permitted by its business license ; The Comprehensive Law Enforcement Team for the cultural market failed to take adequate measures for inspecting fire prevention and control in entertainment venues. Asholding significant leadership responsibility for the accident, a reprimand is recommended. 7. Lin Jianwen, a Party member and senior staff member; former Secretary of the Party Leadership Group (Committee) and Director of the Changyuan County Culture, Radio, Television and Tourism Bureau. From April to July 2010, while serving as Secretary of the Party Leadership Group (Committee) and Director of that bureau, he failed to provide adequate supervision and guidance regarding administrative approvals and comprehensive law enforcement efforts; he also failed to detect issues such as the issuance of entertainment business licenses in violation of regulations, as well as the fact that the Crown Karaoke Bar was operating beyond the approved scope. Asholding significant leadership responsibility for the accident, a reprimand is recommended. 8. Wang Aimin, **Party member, head of the Supervision and Management Section at the Changyuan County Administration for Industry and Commerce; served as head of the Registration Section from July 2004 to October 2011. Without a fire safety inspection certificate for Crown Karaoke, lax oversight was exercised, and its registration as a sole proprietorship was processed in violation of regulations. Given the primary leadership responsibility for the accident, it is recommended to impose a severe warning within the party and a demotion as punishment. 9. Cheng Jingxuan, **Party member, Deputy Director of the Changyuan County Administration for Industry and Commerce. Inadequate supervision over the improper processing of business registration for Crown Karaoke. Asholding significant leadership responsibility for the accident, a reprimand is recommended. 10. Feng Haibing, **Party member, member of the Party Working Committee of Pudong Office in Changyuan County, responsible for fire safety matters. Insufficient supervision and guidance were provided regarding fire safety efforts in the jurisdiction; departmental responsibilities were not clearly defined, and no target responsibility agreements were signed with the various functional departments of the office ; Inspections and checks were inadequate; relevant agencies were not organized to conduct inspections of key fire safety sites such as karaoke bars. Asholding significant leadership responsibility for the accident, it is recommended to impose a severe reprimand. 11. Li Xiaowei, **Party member, Director of Pudong Office in Changyuan County.
