Article 4: To engage in equipment supervision services, one must obtain the qualification as an equipment supervision entity in accordance with these regulations, and carry out such supervision activities within the scope of the approved qualifications. Article 5 Equipment supervision entities shall conduct their business independently in accordance with the law, and shall have no subordination or economic interest relationships with administrative organs. Article 6 **The General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the GAQSIQ) is responsible for the management of the qualifications of equipment supervision agencies nationwide within the scope of its duties. Local quality and technical supervision departments at the county level or above are responsible for the management of the qualifications of equipment supervision units within their respective administrative regions, within the scope of their duties. Chapter 2 Qualification Grades and Requirements Article 7 The qualification grades for equipment supervision units are divided into Class A and Class B. The scope of qualifications for equipment supervision agencies is divided into various equipment supervision specialties and equipment categories based on their services. Class A equipment supervision units are responsible for supervising all equipment within their area of expertise, while Class B equipment supervision units are responsible for supervising only some of the equipment within their area of expertise. The professional qualifications for equipment supervision and the categories of equipment shall be implemented in accordance with **relevant regulations**. Article 8: To obtain the qualification of a Class B equipment supervision unit, the following conditions must be met: (1) Possess the status of an enterprise legal person ； (II) The technical supervisor possesses the professional qualification of a registered equipment supervision engineer ； (III) There shall be no less than 3 registered equipment supervision engineers suitable for carrying out each type of equipment supervision task ； (4) Possess facilities or equipment suitable for carrying out each type of equipment supervision service ； (5) Having a fixed workplace ； (VI) It has a complete and effective equipment supervision quality management system. Article 9: To obtain the qualification of a Class A equipment supervision unit, one must first have obtained the qualification of a Class B equipment supervision unit, and must meet the following conditions: (1) There must be no less than 5 registered equipment supervision engineers sufficient to carry out each type of equipment supervision work ； (II) Relevant experience in supervising similar equipment. Chapter 3 Application and Approval Article 10 Those applying for the qualification as a equipment supervision unit shall submit an application form for such qualification, along with the following documents: (1) Business license of the corporate legal person ； (II) Articles of Association ； (III) Human resources status, including information on those holding the professional qualification certificate for registered equipment supervision engineers ； (IV) Proof of use in the workplace ； (V) Status of facilities and equipment ； (VI) Quality Management Manual ； (7) Those applying for the qualification of a Class A equipment supervision unit shall provide relevant performance records and supporting documents related to equipment supervision. Article 11: Applications for the qualification as a Class A or Class B equipment supervision unit shall be submitted to the provincial quality and technical supervision department where the entity is located. The provincial quality and technical supervision department shall handle such applications and may delegate relevant institutions to organize the evaluation process. Those that pass the evaluation will be approved by the provincial quality and technical supervision department, which will then issue the corresponding qualification certificate for equipment supervision units. Article 12 The relevant procedures and requirements for application, acceptance, evaluation, and approval shall be implemented in accordance with the relevant regulations on administrative permits issued by the General Administration of Quality Supervision, Inspection and Quarantine, as well as the relevant regulations on equipment supervision and management jointly promulgated by relevant departments. Article 13: The application forms for the qualification of equipment supervision units, as well as the formats for the qualification certificates for Class A and Class B equipment supervision units, shall be uniformly formulated by the General Administration of Quality Supervision, Inspection and Quarantine. Chapter 4 Changes and Termination Article 14 During the validity period of the equipment supervision unit’s qualification certificate, if any changes occur in the matters specified on the certificate, an application for amendment shall be submitted to the original approving authority. Article 15 In the event of a division or merger of a equipment supervision unit, it shall return its equipment supervision unit qualification certificate to the original approving authority and submit a new application for approval in accordance with the relevant provisions of these measures. Article 16 Where a equipment supervision entity is terminated in accordance with the law, the approving authority shall go through the procedures for canceling its qualifications in accordance with the law. Chapter 5 Management and Supervision Article 17 The validity period of the qualification certificate for equipment supervision units is five years. If a equipment supervision unit continues to engage in equipment supervision activities after the expiration of its validity period, it shall submit an application for renewal 3 months before the expiration of the certificate’s validity ； The approving authority shall conduct re-approval in accordance with the relevant provisions of these measures. Article 18 Equipment supervision units shall establish an annual self-inspection system to record the performance of their equipment supervision activities. Article 19: Quality and technical supervision departments at the county level and above shall, in accordance with laws, regulations, and the provisions of these measures, strengthen the supervision and inspection of the qualifications of equipment supervision units. Article 20: If an equipment supervision entity fails to continuously meet the qualification requirements after obtaining such qualifications, the quality and technical supervision department at or above the county level shall order it to make corrections in a timely manner ； If the violation is not corrected within the prescribed time, the approving authority shall revoke the approval of its qualification as a equipment supervision unit. If a equipment supervision unit obtains its qualification certificate through improper means such as fraud or bribery, the approving authority shall revoke it. Article 21: If a equipment supervision unit wishes to expand the scope of its qualifications, it shall submit an application for qualification expansion to the approving authority ； Those that pass the evaluation shall be approved by the approving authority, which will then reissue the qualification certificate. Article 22: If a equipment supervision unit loses its qualification certificate for equipment supervision, it shall declare it invalid in national media before applying to the authorities responsible for approval for a replacement certificate. Article 24: If a equipment supervision unit carries out activities that, according to laws and regulations, should be performed by other entities, it shall be dealt with in accordance with the relevant laws and regulations ； Those who undertake equipment supervision services beyond the scope of their approved qualifications shall be ordered by the quality and technical supervision departments at or above the county level to make corrections, and shall be fined between 10,000 yuan and 30,000 yuan. Article 25: Those who forge, alter, lease, or transfer the qualification certificates of equipment supervision entities shall be given a warning by the quality and technical supervision department at or above the county level, and shall also be fined not less than 10,000 yuan but not more than 30,000 yuan ； If it constitutes other illegal or criminal acts, relevant legal responsibilities shall be pursued in accordance with the law ； Those who cause losses to the property owner shall bear liability for compensation in accordance with the law.
