Article 8 The production, operation, use, inspection, and testing of special equipment shall comply with the relevant safety technical specifications for special equipment as well as related standards. The safety technical specifications for special equipment are formulated by the department under the State Council responsible for the supervision and management of special equipment safety. Interpretation of the provisions: This article sets out the requirements specified in the safety technical regulations for special equipment and related standards. 1. Meaning of safety technical regulations for special equipment: The safety technical regulations referred to in this law specify the safety performance and energy-saving requirements for special equipment, as well as the corresponding requirements regarding design, manufacturing, installation, repair, modification, use management, and inspection and testing methods. Safety technical specifications are **one of the bases for departments to carry out their duties; they are mandatory regulations that provide direct guidance for the safety of special equipment. Safety technical specifications serve as **mandatory requirements; violating them entails corresponding legal responsibilities. Safety technical specifications are the basic requirements and guidelines for the safety technical management of special equipment. When formulating safety technical specifications, **mandatory requirements and other practical and effective technical standards should be incorporated, and it must be ensured that they are enforced throughout the entire process of production, operation, and use of special equipment. This law establishes the legal status of safety technical specifications, requiring that the production, operation, use, inspection, and testing of special equipment comply with such safety technical specifications and relevant standards. Safety technical specifications and technical standards complement each other, are interconnected, and are coordinated with one another. II. Formulation of safety technical specifications for special equipment: To ensure unified basic safety and energy-saving requirements across the country, this law stipulates that the department under the State Council responsible for the supervision and management of special equipment safety is authorized to formulate such safety technical specifications; the departments responsible for the supervision and management of special equipment safety in various provinces, municipalities, and regions, as well as other departments, are not permitted to do so. To ensure the quality of technical specifications, the **General Administration of Quality Supervision, Inspection and Quarantine has established procedures for formulating and revising safety technical specifications, which detail the requirements for the personnel involved in their development, the procedures for issuance and modification, as well as matters related to interpretation. At the same time, it allocates the necessary human and material resources to ensure that relevant regulations are issued in a timely manner. To date, the General Administration of Quality Supervision, Inspection and Quarantine has formulated and published over 100 safety technical specifications for special equipment; in addition, there are currently more than 2,000 standards related to special equipment. Some safety technical specifications, such as the \"Regulations on Safety Technical Inspection of Fixed Pressure Vessels\", the \"Regulations on Safety Technical Inspection of Mobile Pressure Vessels\", and the \"Regulations on Safety Technical Inspection of Boilers\", have been notified to the World Trade Organization in accordance with WTO/TBT provisions. Further strengthen the mechanisms and procedures for formulation and revision, improve the quality of safety standards for special equipment, so that safety measures for such equipment can be implemented in a scientific and effective manner. We should strive to establish China’s special equipment standards (TSG) in a short period of time, so as to be able to go global, align with various international technical regulations and standards, and better serve the safety of special equipment as well as economic and trade activities.
