Article 26 **Establish a recall system for defective special equipment. If special equipment develops identical defects that pose a safety risk due to production issues, the manufacturer of such equipment shall immediately cease production and take proactive steps to recall it. When the department of the State Council responsible for the supervision and management of the safety of special equipment discovers that such equipment needs to be recalled but has not been done, it shall order the manufacturer of the special equipment to carry out the recall. Interpretation of the provisions: This article establishes a recall system for defects in special equipment, specifies the conditions for such recalls, sets out the obligations of manufacturers to initiate recalls, and grants the regulatory authorities responsible for special equipment safety the power to order recalls. Producers are responsible for the quality of the special equipment they manufacture. Specifically, if the products manufactured and sold within China are defective, the manufacturer is responsible for recalling them; if imported products are defective, the agent is responsible for recalling them. This product recall system, which originated abroad, has been gradually applied to other major product categories that may cause harm to the public, ranging from automobiles to food, children’s toys, and pharmaceuticals. Special equipment refers to devices and facilities that are related to the safety of people and property, and that pose risks and potential hazards. Defects may arise during their production, creating hidden dangers of accidents; such defects must be eliminated immediately once they are detected. The recall system is generally used for batch-produced products or those with defects of the same nature, and these basic requirements also apply to special equipment. Special equipment can be produced in batch or non-batch quantities. For pressure vessels produced in batches (such as air storage tanks, pharmaceutical machinery, papermaking machinery, gas cylinders, etc.), elevators, lifting equipment, and specialized motor vehicles used on sites (factories), defects of the same nature may occur within products from the same batch. Implementing a recall system for special equipment further strengthens the responsibilities of manufacturers, enabling them to identify and eliminate defects in a timely manner during the production process, which contributes to improving the quality of such equipment. Producers are the entities responsible for ensuring the quality and safety of special equipment, and they should take the initiative to recall any defective special equipment they produce. The department of the State Council responsible for the supervision and management of the safety of special equipment shall order the manufacturer to carry out a recall if it discovers or determines through investigation that the product has defects. The specific implementation measures for the special equipment recall system stipulated in these regulations shall be further detailed in administrative regulations and rules.
