Article 65: Safety inspectors from the departments responsible for the supervision and management of special equipment safety shall be familiar with relevant laws and regulations, possess the appropriate professional knowledge and work experience, and hold certificates for administrative law enforcement in the field of special equipment safety. Safety inspectors for special equipment shall be dedicated to their duties, adhere to principles, and enforce the law impartially. When conducting safety inspections and supervision, the departments responsible for the safety supervision and management of special equipment shall have at least two special equipment safety inspectors present, who must also present valid administrative law enforcement certificates for special equipment safety. Interpretation of the provisions: This article sets out the requirements regarding the qualifications of personnel in charge of safety supervision of special equipment, as well as the standards for safety inspection and supervision work. Safety supervision and inspection of special equipment is a highly specialized task, and those engaged in this work must possess certain professional knowledge and skills. In accordance with the provisions of this law, safety inspectors from the departments responsible for the supervision and management of special equipment must meet the following requirements: (1) Be familiar with relevant laws and regulations. Laws and regulations serve as the foundation for the departments responsible for the supervision and management of special equipment safety to carry out their duties, and they also constitute the basis for conducting inspections and assessments related to the safety of such equipment. Personnel in charge of supervising special equipment safety must be familiar with and understand these relevant laws and regulations, and they must carry out their inspection and assessment tasks in strict compliance with them. To become a qualified inspector for the safety of special equipment, one must not only be familiar with the legal regulations that directly govern the supervision and management of such equipment, such as the Law on the Safety of Special Equipment and the rules formulated by the department under the State Council responsible for overseeing the safety of special equipment, but also need to be aware of other laws and regulations related to this area of oversight, such as the Law on Administrative Licenses, the Law on Administrative Penalties, and the Law on Administrative Coercion. (II) Possess the relevant professional knowledge and work experience. The safety inspection and supervision of special equipment is both an administrative law enforcement activity and a task that requires high levels of professional expertise. **A large number of safety technical specifications and related standards have been established for the production, operation, use, inspection, and testing of special equipment. These safety technical specifications and standards are also one of the bases for us to carry out safety inspection and supervision work on special equipment; they are numerous and widespread, and involve a great deal of specialized knowledge. It is impossible to carry out safety inspection and supervision work without understanding these safety technical specifications and standards. Furthermore, due to the high level of technical expertise required, and the fact that safety inspectors often need to make judgments on-site, work experience is also very important. Therefore, this law stipulates that safety inspectors for special equipment must have a certain level of education in a field related to such equipment, or have received specialized training, as well as possess certain work experience. (III) It is necessary to obtain a administrative law enforcement certificate for special equipment safety. This assessment is based on a certain level of professional knowledge, and it evaluates the familiarity with and application of laws, regulations, rules, and safety technical standards. The assessment of special equipment safety inspectors is carried out uniformly by the department under the State Council responsible for the supervision and management of special equipment safety. II. Safety inspectors for special equipment must be dedicated to their duties, adhere to principles, and enforce the law impartially. Safety inspectors for special equipment are officials of ** agencies, and being dedicated to one’s duties, adhering to principles, and enforcing the law impartially are the most basic requirements for such officials. The power of safety inspection officers to conduct inspections is granted by law, and they must earnestly fulfill their duties from the perspective of serving the interests of ** and the people. Administrative actions must be carried out in strict accordance with legal authorities and procedures, ensuring fair and civilized law enforcement. It is strictly prohibited to replace supervision with fines or punishment with supervision in the enforcement of safety regulations regarding special equipment. It is necessary to strengthen supervision over administrative law enforcement, regularly analyze the progress of law enforcement activities, and continuously improve the standard of law enforcement. III. When conducting safety inspections and supervision, personnel responsible for the safety oversight of special equipment must be in numbers of two or more, and they must carry official credentials for administrative law enforcement related to special equipment safety. (1) At least two personnel responsible for the safety oversight of special equipment shall be involved in carrying out such inspections and supervision. This law stipulates that when conducting safety inspections and supervision, at least two special equipment safety inspectors must be involved, primarily for the following reasons: first, to ensure the fairness of law enforcement. When a single law enforcement officer carries out enforcement duties on their own, it can lead to arbitrary decision-making in the enforcement process. Moreover, the lack of oversight can result in abuses of power and other corrupt behaviors. When two or more law enforcement officers carry out enforcement simultaneously, it facilitates mutual supervision during the process, ensuring the fairness of law enforcement. The second reason is to demonstrate the authority of law enforcement. Third, it helps to ensure the safety of law enforcement. (II) When conducting safety inspection and supervision activities, personnel in charge of the safety supervision of special equipment must present valid administrative law enforcement certificates for safety to the entities being inspected. Presenting valid identification to the other party is, on the one hand, a right of the person being inspected to identify the identity of the law enforcement officers, that is, the person being inspected has the right to confirm whether those conducting the inspection possess the legal qualifications required. On the other hand, it also proves that the law-enforcing entities are legitimate, which helps to prevent criminals from engaging in fraud and disrupting the normal production and business operations of enterprises. It can be said that requiring the presentation of a valid administrative law enforcement certificate for special equipment safety is an essential procedural requirement for safety inspectors when exercising their powers of supervision and inspection. It reflects the seriousness and standardization of law enforcement activities, and helps to avoid arbitrariness in safety inspections.
