Article 100 **The supervision and management of the safety of special equipment used in equipment, nuclear facilities, and aerospace vehicles are not governed by this Law. The supervision and management of the safety of railway locomotives, offshore facilities and vessels, special equipment used in mines, as well as specialized equipment at civil airports, as well as the supervision and management of the installation and use of lifting machinery at construction sites and municipal engineering sites as well as specialized motor vehicles on such sites (factories), shall be carried out by the relevant departments in accordance with the provisions of this Law and other relevant laws. Interpretation of the provision: This article contains special provisions regarding the scope of application of this law. I. The Special Equipment Safety Law is a fundamental law that regulates the safety of special equipment. In accordance with Article 2 of this Law, this Law applies to the production (including design, manufacturing, installation, modification, and repair), operation, use, inspection, testing of special equipment, as well as the supervision and management of the safety of such equipment. The special equipment referred to in this Law includes boilers, pressure vessels (including gas cylinders), pressure pipelines, elevators, lifting machinery, passenger cableways, large-scale amusement facilities, and specialized motor vehicles used within premises (factories), as well as other special equipment that is stipulated by laws and administrative regulations to be subject to this Law, due to their high risk to personal and property safety. In accordance with the above provisions, eight categories of special equipment such as boilers and pressure vessels fall within the scope of regulation under this law ; In the future, depending on the actual needs of work, other relevant laws and administrative regulations may also bring other special types of equipment outside these eight categories under the scope of application of this law. Such a provision is made primarily to maintain the consistency of legislation on the safety of special equipment, and to prevent the need to enact separate laws for each type of special equipment in the future, which could undermine the status of this law as the fundamental legislation in the field of special equipment safety. At the same time, taking into account the current division of responsibilities in the supervision and management of special equipment safety in our country, this task is not solely the responsibility of the quality inspection departments; **relevant** departments such as those responsible for nuclear facilities, railways, transportation, civil aviation, housing, and urban-rural development also bear corresponding responsibilities for overseeing the safety of special equipment within their respective fields. To this end, while upholding the unity of legislation regarding the safety of special equipment, this law also introduces some specific provisions regarding the responsibilities for supervising and managing the safety of such equipment in particular fields, thereby fully respecting the division of responsibilities for this purpose that has proven effective over the years. In other words, under the current management system, the safety of special equipment used in different fields is overseen by different departments, but uniform rules (laws) apply. II. **The supervision and management of the safety of special equipment used in equipment, nuclear facilities, and aerospace vehicles are not governed by this law.** The stipulation that these devices are not covered by this law is mainly due to the fact that the special equipment used in **military equipment, nuclear facilities, and aerospace vehicles is quite unique. Firstly, in terms of regulatory bodies, such special equipment already has its own respective oversight agencies; for example, the special equipment used in **military equipment is under the safety supervision and management of the relevant **regulatory departments ; The safety supervision and management of special equipment used in nuclear facilities are the responsibility of the environmental protection department ; The safety supervision and management of special equipment used in aerospace vehicles is the responsibility of civil aviation authorities and space administration departments. Secondly, in terms of the methods and approaches for safety supervision and management, the special equipment used in the aforementioned fields differs significantly from that used in general fields with regard to such supervision and management (including aspects such as production licensing, inspection, and testing). In some cases, the safety management requirements for this type of equipment are even stricter than those for equipment used in general fields, and therefore the supervision and management methods stipulated in these regulations cannot be fully applied. Therefore, the supervision and management of the safety of special equipment in the aforementioned fields are not governed by this law. It should be noted that the special equipment subject to this Law but not covered by the first paragraph of this article does not refer to **equipment, nuclear facilities, and aerospace vehicles themselves; rather, it refers to the special equipment used in them. For example, this includes pressure vessels used in **equipment and aerospace vehicles, as well as pressure vessels and pressure pipelines among the nuclear safety equipment in nuclear facilities (i.e., equipment used in civil nuclear facilities to carry out nuclear safety functions, including nuclear safety mechanical equipment and nuclear safety electrical equipment). III. The supervision and management of the safety of railway locomotives, offshore facilities and vessels, special equipment used in mines, as well as specialized equipment for civil airports, as well as the supervision and management of the installation and use of lifting machinery at construction sites and municipal engineering sites and of specialized motor vehicles on such sites (factories), shall be carried out by the relevant departments in accordance with the provisions of this Law and other relevant laws. To understand this provision, the following points should be noted: (1) Special equipment used in the aforementioned fields is subject to this law. In terms of their level of specificity, special equipment used in railway locomotives, marine facilities and ships, mining operations, as well as in civil airports, is less specialized than the special equipment used in **military equipment, nuclear facilities, and aerospace vehicles. In terms of methods and means of safety supervision and management, it bears great similarities to special equipment used in general fields; therefore, the relevant provisions of this Law can be applied to regulate it. (2) While applying the provisions of these regulations, other relevant laws may be applied to the safety supervision and management of special equipment used in the aforementioned fields. For example, the safety supervision and management of special equipment used in railway locomotives can be governed by the relevant provisions of the Railway Law ; The safety supervision and management of special equipment used in offshore facilities and ships can be governed by the provisions of relevant laws such as the Maritime Traffic Safety Law ; The safety supervision and management of specialized equipment at civil airports can be governed by the relevant provisions of the Civil Aviation Law. Where specialized laws are inconsistent with the provisions of this Law, in accordance with the principle that special laws take precedence over general laws, the provisions of the relevant specialized laws shall prevail. (3) The safety supervision and management of special equipment in the aforementioned fields are the responsibility of relevant departments such as those in charge of railways, civil aviation, transportation, housing, and urban-rural planning, rather than quality inspection departments. In the provisions of this article, “railway locomotive” refers to the traction part of railway transport vehicles. “\"Offshore facilities\" refer to facilities used for offshore operations, such as offshore platforms, but do not include docks. “\"Underground in mines\" refers to the areas underground in various types of mines, excluding the surface equipment of the mines. “\"Special equipment for civil airports\" refers to the equipment listed in the catalog of special equipment for civil airports issued by the civil aviation administrative department under the State Council, including vehicles such as shuttles and tractors that come into contact with civil aircraft; however, it does not include boilers, pressure vessels, elevators, lifting machinery, or specialized motor vehicles used within airport premises.
