Announcement by the General Administration of Quality Supervision, Inspection and Quarantine on Repealing the Revised Safety Technical Specifications and Documents Related to Administrative Licenses for Special Equipment

(No. 102, 2017) In accordance with the \"Notice of the General Office of the State Council on Cleaning Up and Regulating Intermediary Services for Administrative Approval by State Council Departments\" (Guo Ban Fa [2015] No. 31) and the \"Decision of the State Council on the Third Batch of Matters Related to Cleaning Up and Regulating Intermediary Services for Administrative Approval by State Council Departments\" (Guo Fa [2017] No. 8), the evaluation and assessment of special equipment manufacturing units, as well as the evaluation and assessment by inspection agencies and the examinations for inspection and testing personnel, have been transformed from intermediary services into technical services. Applicants are no longer required to entrust relevant agencies to carry out these evaluations, assessments, and examinations; instead, the approval authorities assign such tasks to relevant technical service agencies. The General Administration of Quality Supervision, Inspection and Quarantine has issued a letter adjusting the procedures for assessment and evaluation of special equipment manufacturing units and inspection and testing institutions, as well as the examination processes for inspection and testing personnel, along with the fee structures, as stipulated by this administration. To further implement the requirements of the State Council, the General Administration of Quality Supervision, Inspection and Quarantine has reviewed the relevant safety technical specifications, regulatory documents, and policy documents for special equipment. The results of the cleanup are now being made public, and the relevant matters are announced as follows: 1. The \"Announcement by the General Administration of Quality Supervision, Inspection and Quarantine on Publishing the List of Agencies for Appraisal and Evaluation in Connection with Administrative Licenses for Special Equipment and the List of Agencies for Appraising Design Documents for Special Equipment\" (No. 2, 2016) and the \"Rules for the Management and Supervision of Appraisal and Evaluation in Connection with Administrative Licenses for Special Equipment\" (Guo Jian Zhi Te [2005] No. 220) are repealed. II. For the appraisal and evaluation of special equipment manufacturing units and inspection and testing institutions, as well as the examinations for inspection and testing personnel, it is no longer required that applicants entrust relevant agencies to carry out these tasks; instead, the special equipment administrative approval authorities are responsible for entrusting relevant technical service agencies to handle them. In the event that the safety technical specifications for special equipment, regulatory documents, and policy documents conflict with this announcement, this announcement shall prevail. III. The General Administration of Quality Supervision, Inspection and Quarantine and the provincial departments in charge of the safety supervision and management of special equipment are responsible, within the scope of their administrative licensing duties and in accordance with relevant laws and regulations, for entrusting qualified technical service institutions to carry out the assessment and evaluation of special equipment manufacturing units and inspection and testing agencies, as well as the examination of inspection and testing personnel. They shall make public the names, addresses, contact numbers, and scope of services of these assessment and evaluation institutions and examination agencies to allow for public oversight. For each administrative licensing item, there must be no fewer than 2 appraisal and evaluation agencies appointed by the General Administration of Quality Supervision, Inspection and Quarantine and the provincial special equipment safety supervision and management departments. The appraisal and evaluation agency is responsible for the appraisal and evaluation tasks it has been entrusted with. Once the provincial departments in charge of the safety supervision and management of special equipment announce the accredited inspection and evaluation agencies as well as examination institutions, they should promptly report this to the Special Equipment Bureau of the General Administration of Quality Supervision, Inspection and Quarantine. IV. Technical service institutions entrusted with carrying out appraisal and evaluation tasks for special equipment manufacturing units and inspection and testing agencies, as well as examination tasks for special equipment inspection and testing personnel, should strengthen the training and assessment of their staff, and organize them to participate in training on relevant regulations and standards in a timely manner. The administrative departments responsible for the approval of special equipment should strengthen supervision and inspection of the appraisal and evaluation agencies as well as examination institutions that they have entrusted with such tasks. Those agencies that no longer meet the required standards should have their mandates revoked, in order to maintain the quality of appraisal, evaluation, and examination services.
