Circumstances in which an injury should not be considered a work-related injury: Answer: An employee’s injury, disability, or death resulting from one of the following circumstances should not be regarded as a work-related injury: (1) Crime or illegal activity； (2) Suicide or self-harm ； (3) Fights ； (4) Alcoholism ； (5) Deliberate violation of regulations ； (6) Other circumstances stipulated by laws and regulations.
Situations that cannot be recognized as work-related injuries: Even if other conditions for recognizing a work-related injury are met, cases falling under the following circumstances shall not be recognized as work-related injuries or treated as such: (1) Injuries or deaths resulting from crimes or violations of public order and safety regulations. (II) Injuries or deaths caused by intoxication. (III) Those who self-harm or commit suicide. (IV) Other circumstances stipulated by laws and administrative regulations.

(2) Under the influence of alcohol or drugs. “Those who are drunk or under the influence of drugs cannot have their injuries recognized as work-related injuries or treated as such; this means that even if an injury occurs as a result of drug use and meets other criteria for recognizing work-related injuries, it still cannot be considered a work-related injury or treated as one. (3) Those who engage in self-harm or suicide. Some employees, in order to achieve a certain goal or for some reason, use their working time to harm themselves or commit suicide.
