During the project construction, the civil engineering work required a construction permit. When it came to the fabrication of storage tanks and equipment installation, local authorities stated that no construction permit was needed. However, Article 2 of the Construction Law stipulates that anyone carrying out construction activities within the territory of the People’s Republic of China must comply with this law in order for such activities to be supervised and regulated. The construction activities referred to in this law mean the construction of various types of buildings and their auxiliary facilities, as well as the installation of the associated circuits, pipelines, and equipment. It stipulates that a construction permit is required; is there any basis for this local requirement? Is there any situation in which it is not required to go through the process?

This is indeed a problem that exists in practice; it depends mainly on whether the local construction authority has the capability to supervise industrial projects. If they do have such capabilities, they can issue a construction permit for the entire project. Generally, however, local construction authorities lack the qualifications to supervise industrial projects, so they only issue permits for civil engineering works (building construction permits). As for the legal provisions, there is no very clear explanation.
