Amendment No. 1 to the \"Rules for the Use and Management of Special Equipment\" (TSG 08-2017) (Draft for Comment): Original text of the clause numbers and revised text 1.4.11.4.44.3 **General Administration of Quality Supervision, Inspection and Quarantine** General Administration of Market Regulation 2.2 Two items are added to the first paragraph of this clause: 1. Place them after the original sequence number (3); (4) Appoint a safety director and safety officers with corresponding safety management capabilities, and clarify their job responsibilities; The safety director is generally held by the person in charge of safety management as specified in these rules, while the safety officer is generally held by the safety administrator as specified in these rules. The requirements regarding certificates for relevant personnel shall still be in accordance with the provisions of these rules. 2. After item (7), add item (9): Establish a dynamic management mechanism for preventing and controlling safety risks associated with special equipment. In light of the actual circumstances of the unit, implement self-inspection requirements, formulate a “List of Safety Risk Controls for Special Equipment”, and establish sound working systems and mechanisms for daily control, weekly inspections, and monthly coordination. 2.4.12.4.1 Principal Responsible Person The principal responsible person refers to the actual top manager of the special equipment user entity, who is fully accountable for the safety and energy efficiency of the special equipment used by that entity. 2.4.1 Principal Responsible Person The principal responsible person refers to the actual top manager of the special equipment user entity, who is fully accountable for the safety and energy efficiency of the special equipment used by that entity; he/she must organize at least one safety coordination meeting per month. 2.4.2.12.4.2.1 Person in charge of safety management: Special equipment users shall appoint a person in charge of safety management. The person in charge of special equipment safety management refers to the member of the highest management level of the using unit who is responsible for overseeing the safety management of the special equipment used in that unit. The person in charge of safety management at the entity that establishes a safety management organization in accordance with the requirements of these rules must hold the corresponding qualification certificate for safety management personnel of special equipment. The responsibilities of the person in charge of safety management are as follows: (1) Assist the principal responsible person in fulfilling the leadership duties regarding the safety of special equipment in the organization, and ensure the safe use of such equipment ; (2) Promote and implement the Safety Law of the People’s Republic of China on Special Equipment, as well as relevant laws, regulations, rules, and safety technical standards ; (3) Organize the formulation of the unit’s safety management system for special equipment, and ensure the establishment of a safety management organization as well as the assignment of safety managers ; (4) Organize the development of special emergency plans for accidents involving special equipment, and conduct regular drills ; (5) Inspect the implementation of safety management work for special equipment within the unit ; (6) Organize the identification of potential hazards and propose solutions ; (7) When the safety manager reports that a special equipment unit poses accident risks and should be stopped from use, an immediate decision to cease using that special equipment shall be made, and the matter shall be reported promptly to the person in charge of the organization. 2.4.2.1 Safety management responsible person: Units utilizing special equipment shall appoint a safety management responsible person. The person in charge of special equipment safety management refers to the member of the highest management level of the using unit who is responsible for overseeing the safety management of the special equipment used in that unit. The person in charge of safety management at the entity that establishes a safety management organization in accordance with the requirements of these rules must hold the corresponding qualification certificate for safety management personnel of special equipment. The person in charge of safety management is directly accountable to the principal responsible person of the organization, in accordance with the requirements of their duties, to ensure the safe use of special equipment within the organization. Their main responsibilities are as follows: (1) To promote and implement laws, regulations, rules, safety technical specifications, and relevant standards related to special equipment ; (2) Organize the formulation of safety management systems for the use of special equipment within the unit, implement responsibility systems for ensuring the safe use of such equipment, and carry out activities related to the safe and compliant management of special equipment ; (3) Organize the development of special emergency plans for accidents involving special equipment, and conduct regular drills ; (4) Fulfill the obligation to report accidents involving special equipment, and take measures to prevent the escalation of accidents ; (5) Provide safety education and technical training for special equipment safety managers, and supervise and guide them in carrying out their relevant tasks properly ; (6) Organize the conduct of safety risk assessments for the use of special equipment in accordance with relevant regulations, and formulate as well as ensure the implementation of measures to prevent and control safety risks associated with the use of such equipment ; (7) Conduct inspections on the safety management of the use of special equipment in the unit, organize risk assessments for such equipment at least once a week, report relevant findings to the principal responsible person in a timely manner, and propose improvement measures ; (8) When the safety manager reports that a special equipment unit poses accident risks and should be stopped from use, an immediate decision must be made to halt its use, and the matter must be reported promptly to the person in charge of the organization ; (9) Accept and cooperate with relevant departments in carrying out safety inspections, supervision and inspection, regular inspections, and accident investigations regarding special equipment, and provide relevant materials truthfully ; (10) The person in charge of safety management at the gas cylinder filling unit shall also perform the following duties: organize the establishment and ongoing maintenance of a quality and safety tracking system for gas cylinder filling ; Organize the preparation of guidelines for safe gas use or gas operation manuals ; Organize the deactivation of discarded gas cylinders and handle the cancellation of their usage registration ; If the unit has purchased insurance for liability related to cylinder filling, corresponding insurance management responsibilities must be fulfilled ; (11) If the elevator user purchases elevator insurance, it shall also establish corresponding responsibilities for insurance management ; (12) Fulfill other safety management responsibilities regarding the use of special equipment as stipulated by the authorities in charge of special equipment safety and as required by the own organization. 2.4.2.22.4.2.2 Safety Administrator 2.4.2.2.1 Responsibilities of the Safety Administrator A safety administrator for special equipment is the person who is specifically responsible for managing the safety aspects related to the use of such equipment. The main responsibilities of a safety administrator are as follows: (1) Organize the establishment of safety technical records for special equipment ; (2) Conduct registration for the use of special equipment ; (3) Organize the formulation of operating procedures for special equipment ; (4) Organize safety education and skill training for special equipment ; (5) Organize regular self-inspections of special equipment ; (6) Prepare regular inspection plans for special equipment, and ensure that regular inspections as well as the rectification of potential hazards are carried out ; (7) Report special equipment accidents as required, participate in the rescue efforts in such accidents, and assist with accident investigations and subsequent handling ; (8) Upon detecting potential hazards related to special equipment, take immediate action to address them. In emergency situations, it is possible to decide to stop using the special equipment, and this decision must be reported promptly to the person in charge of safety management at the organization ; (9) Correct and prevent illegal acts by operators of special equipment. 2.4.2.2 Safety Administrator2.4.2.2.1 Responsibilities of the Safety Administrator
A safety administrator for special equipment is a person who is specifically responsible for the safety management of the use of special equipment. In accordance with their duties, they are accountable to the chief safety supervisor for special equipment or the main person in charge of the organization. Their main responsibilities are as follows:
(1) Organize the establishment of technical safety records for special equipment and handle the registration procedures for the use of such equipment within the organization ; (2) Organize the formulation of safety operation procedures for special equipment ; (3) Organize safety education and skill training for operators and technical personnel of special equipment ; (4) Organize routine inspections of special equipment; supervise and inspect whether operators of special equipment are on duty and conducting patrol inspections, etc.; correct and prevent any violations of operating procedures ; (5) On a daily basis, conduct inspections of the special equipment in use in accordance with the \"Special Equipment Safety Risk Control List\", keep records of these inspections, and take immediate preventive measures against any identified risks (in emergency situations, it is possible to decide to stop using the special equipment). Reports should be submitted promptly to the safety director or the person in charge of the organization ; (6) Formulate a periodic inspection plan for special equipment, and supervise the implementation of periodic inspections and subsequent rectification efforts ; (7) Report special equipment accidents as required, participate in the rescue efforts in such accidents, and assist with accident investigations and subsequent handling ; (8) The safety manager of the gas cylinder filling unit shall also implement all functions of the quality and safety tracking system for gas cylinder filling within the unit, scanning each factory-exported gas cylinder’s tracking label to ensure that such cylinders meet the requirements for traceability ; Responsible for informing users about safety guidelines regarding gas use or providing gas usage instructions ; (9) Fulfill other safety management responsibilities regarding the use of special equipment as stipulated by the authorities in charge of special equipment safety and as required by the own organization. Appendix G: Diagram of the Special Equipment Use Mark (Style 2). For elevators that are put into use after installation, when applying for registration for use, the registration authority shall issue a \"Special Equipment Use Mark\" ; After the elevator undergoes renovation, supervision and inspection for major repairs, or periodic inspection, the supervision and inspection agency or periodic inspection agency shall issue the “Usage Mark for Special Equipment” ; After the elevator undergoes self-inspection, the user entity shall, in accordance with the requirements of relevant safety technical specifications, go to an inspection agency to obtain the \"Special Equipment Use Mark\".
