To the personnel departments (bureaus) and quality and technical supervision bureaus of all provinces, autonomous regions, and municipalities directly under the Central Government; to the personnel departments of various ministries and commissions of the State Council and its directly affiliated agencies; to the Cadre Department of the General Political Department, the Infrastructure and Barracks Construction Department of the General Logistics Department, and the Comprehensive Planning Department of the General Armaments Department; as well as to relevant enterprises under central government management: In order to strengthen the supervision and management of the quality of equipment in construction projects, ensure the quality of such equipment, improve the competence of those who supervise equipment projects, and standardize the activities related to equipment project supervision, the Ministry of Human Resources and the General Administration of Quality Supervision, Inspection and Quarantine have decided to establish a system of registered equipment supervisors in the field of equipment engineering. The Interim Provisions on the Professional Qualification System for Registered Equipment Supervisors, the Implementation Measures for the Professional Qualification Examination for Registered Equipment Supervisors, and the Assessment and Recognition Methods for the Professional Qualifications of Registered Equipment Supervisors are hereby issued to you; please comply with them. Ministry of Human Resources and Social Security **General Administration of Quality Supervision, Inspection and Quarantine, October 29, 2003 Interim Provisions on the System for Certifying Qualified Equipment Supervisors Chapter 1 General Provisions Article 1 These provisions are formulated in order to strengthen the supervision and management of the quality of equipment projects in construction projects, improve the professional competence of personnel engaged in equipment project supervision, and ensure the quality of such supervision work. They are based on the Product Quality Law of the People’s Republic of China, the Quality Promotion Outline issued by the State Council, as well as relevant regulations regarding the vocational qualification certification system. Article 2 These provisions apply to the professional technicians in equipment supervision intermediary agencies who are responsible for controlling, witnessing, inspecting, and auditing aspects such as quality and schedule during the manufacturing process of important equipment in construction projects. The important equipment referred to in these regulations denotes the complete sets of equipment and key unit devices required for large and medium-sized capital construction projects, as well as technology upgrade projects above a certain scale, in order to support industrial production processes and establish production capacity; it also includes the important hardware of key information systems along with the software necessary to support their operation. Article 3: The term \"registered equipment supervision engineer\" as referred to in these regulations denotes a professional technical personnel who has passed the national unified examination, obtained the \"Practice Qualification Certificate for Registered Equipment Supervision Engineers of the People’s Republic of China\", and after registration, carries out equipment project supervision work independently in accordance with equipment supervision contracts. Article 4 **A professional qualification system shall be implemented for the equipment supervision industry, and it shall be incorporated into the unified planning of the national professional and technical personnel qualification system. Article 5: The Ministry of Human Resources and Social Security and the General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the General Administration of Quality Inspection) are jointly responsible for implementing the national professional qualification system for registered equipment supervisors. **The General Administration of Quality Supervision, Inspection and Quarantine, in conjunction with relevant departments, provides guidance, supervision, and management over the professional activities of registered equipment supervisors. Chapter 2 Exams Article 6 The qualification exam for registered equipment supervision engineers follows a system of **uniform syllabuses, unified question setting, and centralized organization of exams. In principle, it is held once a year. Article 7 The General Administration of Quality Supervision, Inspection and Quarantine establishes an \"Expert Committee for the Professional Qualification Examination for Registered Equipment Supervisors\" to be responsible for formulating the examination subjects, compiling examination syllabuses, organizing the development of examination questions, and working on the creation of an examination question bank ; **The General Administration of Quality Supervision conducts a preliminary review of the examination subjects, syllabi, and questions, and makes overall plans for training efforts. Training is carried out on the principle of being separate from exams and on a voluntary basis for candidates. Article 8: The Personnel Department shall organize experts to review and approve the examination subjects, examination outlines, and examination questions. Together with the **General Administration for Quality Supervision, Inspection and Quarantine**, it carries out inspections, supervision, guidance regarding the professional qualification examination for registered equipment supervisors, and determines the passing standards. Article 9: Any citizen of the People’s Republic of China who abides by **laws and regulations, is appointed to an engineering professional position as an engineer in accordance with the Provisions on the Trial Implementation of Positions for Engineering and Technical Personnel, and meets one of the following conditions, may apply to take the Qualification Examination for Registered Equipment Supervisors. (1) Hold a secondary vocational diploma in engineering technology, with at least 20 years of experience in equipment engineering. (II) Hold an associate degree in engineering technology, with at least 15 years of cumulative work experience in the field of equipment engineering. (III) Hold a bachelor’s degree in engineering technology, with at least 10 years of cumulative work experience in the field of equipment engineering. (IV) Hold a master’s degree or higher in engineering technology, with at least 5 years of cumulative work experience in equipment engineering. Article 10: Those who pass the Qualification Examination for Certified Equipment Supervisors shall be issued, by the personnel departments of provinces, autonomous regions, and municipalities directly under the Central Government, the “Qualification Certificate for Certified Equipment Supervisors of the People’s Republic of China”. This certificate is uniformly printed by the Ministry of Personnel and bears the seals of both the Ministry of Personnel and the **General Administration of Quality Supervision. This certificate is valid nationwide. Chapter 3 Registration Article 11 A registration system shall be implemented for the practice qualification of registered equipment supervision engineers. Those who have obtained the \"Practice Qualification Certificate for Registered Equipment Supervisors of the People’s Republic of China\" must go through registration before they can practice in the capacity of registered equipment supervisors. Article 12 **The General Administration of Quality Supervision, Inspection and Quarantine or its authorized agency serves as the registration authority. The quality supervision departments of each province, autonomous region, and municipality directly under the Central Government, or their authorized agencies, serve as the registration authorities. Article 13: The Ministry of Personnel and personnel administrative departments at all levels are responsible for inspecting and supervising the registration and use of the professional qualifications for registered equipment supervision engineers. Article 14: Those who wish to obtain the \"Practice Qualification Certificate for Registered Equipment Supervisors of the People’s Republic of China\" and need to go through registration procedures shall submit an application on their own initiative. After obtaining approval from their employer, they shall submit the application to the provincial registration authority in their location to complete the registration process. Article 15: Applicants for registration must meet all of the following conditions: (1) Hold the \"Practice Qualification Certificate for Registered Equipment Supervisors of the People’s Republic of China\". (II) Abide by laws and regulations, and adhere to professional ethics. (III) Be in good health and able to continue working in the position of registered equipment supervisor. (IV) Pass the assessment by the employer. Article 16: Upon passing the review and being approved for registration, the registration authority shall issue the \"Registration Certificate for Certified Equipment Supervisors of the People’s Republic of China\", which is printed uniformly by the General Administration of Quality Supervision, Inspection and Quarantine, and shall affix a special registration seal in the registration section of the \"Professional Qualification Certificate for Certified Equipment Supervisors of the People’s Republic of China\". Article 17 The registration validity period for certified plant supervisors is 3 years. Three months prior to the expiration of this period, the certificate holders must apply for re-registration at the provincial registration authority where they are registered. Within the valid period of registration, those who change their practicing entity shall promptly complete the change procedures in accordance with relevant regulations. Those registering again must, in addition to meeting the requirements specified in Article 15 of these regulations, also provide proof of having received continuing education. Article 18 In any of the following circumstances, the registration of a registered equipment supervisor shall be cancelled by the original registration authority. (1) Those who do not have full capacity for civil conduct. (II) Those who have been subject to criminal punishment. (III) Causing significant economic losses to equipment projects due to negligence. (IV) Serious violation of professional ethics. (5) Having been absent from the position of registered plant supervision engineer for a continuous period of 2 years. (VI) Conducting supervision activities at more than 2 equipment supervision agencies simultaneously. Article 19: The registration authority shall promptly record any disciplinary actions taken against registered equipment supervision engineers in the remarks section of their \"Practice Qualification Certificate for Registered Equipment Supervision Engineers of the People’s Republic of China\". Article 20: Each provincial registration authority shall regularly submit reports on registration and management activities to the **General Administration of Quality Supervision, Inspection and Quarantine for record-keeping. **The General Administration for Quality Supervision, Inspection and Quarantine should regularly publish information on the registration and cancellation of the professional qualifications for registered equipment supervision engineers. Chapter 4 Responsibilities Article 21 Registered equipment supervision engineers shall, in accordance with the professional scope specified by their respective equipment supervision agencies, and in compliance with **laws, regulations, and standards as well as the requirements of the supervision contract, carry out supervision tasks for relevant professional equipment projects. Article 22 Scope of practice for registered plant engineers: To witness, inspect, and audit the quality control of important forming processes and key components in the design, processing, manufacturing, storage, transportation, material procurement, assembly, and testing of major engineering equipment; to supervise the project progress and the disbursement of funds; and to participate in the management of the project implementation process. Article 23 Registered equipment supervision engineers shall enjoy the following rights in the equipment supervision agency for which they are employed: (1) To independently carry out equipment engineering supervision tasks in their field on behalf of the equipment supervision agency, and to participate in the management at various stages of the development of important equipment. (II) Provide rationalization suggestions for the processes of equipment engineering design, procurement, manufacturing, storage and transportation, assembly, testing, and inspection. (III) Review technical documents and materials such as project contracting contracts, technical plans, regulations and standards, important and critical process procedures, and assembly and testing procedures, and provide suggestions for revisions. (IV) Witness, inspect, and audit the quality control of important processes and key components involved in the equipment’s production. (5) Provide recommendations regarding the allocation, addition, and deduction of funds during project implementation, and supervise the progress of the project. (VI) Advise against any actions during project execution that violate the contract terms or relevant laws and regulations, and report such matters to the appropriate authorities and departments. Article 24 Registered equipment supervision engineers shall fulfill the following obligations: (1) To perform their duties fairly and objectively during the contract period, and to assume corresponding responsibilities for the supervision tasks assigned to them in accordance with the duties entrusted by the equipment supervision agency they work for. (II) Provide the principal with the supervision services stipulated in the contract, thereby safeguarding the principal’s legitimate rights and interests. (III) Shall not participate in any economic or technical activities that have an impact on the equipment supervision project. (IV) Strictly safeguard the technical and commercial secrets of relevant parties. (5) Practice only for one equipment supervision unit. Article 25 Registered equipment supervision engineers shall, in accordance with **relevant regulations, voluntarily engage in continuing education to continuously update their knowledge and maintain a high level of professional expertise. Chapter 5 Supplementary Provisions Article 26 Obtaining the qualification of a registered equipment supervision engineer is a prerequisite for establishing an equipment engineering supervision agency, serving as the technical director of such an agency, or working as a member of an equipment supervision intermediary agency to carry out supervision tasks independently. Article 27: Prior to the implementation of the qualification examination for certified plant engineering supervisors, individuals who have been engaged in work related to plant engineering for a long time, possess a high level of theoretical knowledge and extensive practical experience, and hold senior professional technical positions in the field of engineering may obtain the qualification of certified plant engineering supervisor through an assessment and certification process. The assessment and certification procedures shall be formulated separately by the Ministry of Human Resources and Social Security and the **General Administration of Quality Supervision, Inspection and Quarantine. Article 28: The professional classification and number of registered equipment supervision engineers required for intermediary agencies that carry out equipment engineering supervision services shall be determined by the **General Administration of Quality Supervision, Inspection and Quarantine in consultation with the relevant industry authorities. Article 29 Foreign nationals who are employed within the People’s Republic of China with the approval of the relevant departments of the State Council, as well as professionals from Hong Kong, Macao, and Taiwan regions, may also apply to take the registered equipment supervision engineer professional qualification exam and seek registration, provided that they meet the relevant provisions and the requirements of these regulations. Article 30 These provisions shall come into force as of December 1, 2003. Implementation Measures for the Registered Equipment Supervision Engineer Professional Qualification Examination Article 1: The Registered Equipment Supervision Engineer Professional Qualification Examination is conducted under the leadership of the Ministry of Human Resources and Social Security and the General Administration of Quality Supervision, Inspection and Quarantine (hereinafter referred to as the General Administration of Quality Supervision). An expert committee for this examination is established, and together these two departments set up an office responsible for the day-to-day management of the examination; this office is located in the General Administration of Quality Supervision. The specific examination administration is handled by the Personnel Examination Center of the Ministry of Human Resources. The examination work in each region is organized and implemented by the local personnel departments in conjunction with the quality and technical supervision departments; the specific division of responsibilities shall be determined through consultation among the respective regions. Article 2: The registration examination for professional qualification as a equipment supervision engineer is held once a year, in principle, with the exam scheduled to take place in the third quarter of each year. Article 3: The subjects for the registration examination for equipment supervision engineers include four courses: \"Fundamentals of Equipment Engineering Supervision and Related Knowledge\", \"Equipment Supervision Contract Management\", \"Quality, Investment, and Schedule Control\", and \"Comprehensive Practice and Case Analysis in Equipment Supervision\". Article 4: The examination is conducted over 4 half-days. The examination time for each of the courses \"Fundamentals of Equipment Engineering Supervision and Related Knowledge\", \"Equipment Supervision Contract Management\", and \"Quality, Cost, and Schedule Control\" is 3 hours, while the examination time for the course \"Comprehensive Practice and Case Analysis in Equipment Supervision\" is 4 hours. Article 5: Persons who meet the requirements stipulated in Article 9 of the Interim Provisions may apply to take the professional qualification examination for registered equipment supervision engineers. Article 6: Those who meet the eligibility requirements for the registration exam for equipment supervision engineers and have been appointed to a senior engineer position by the end of 2002 are exempt from the exams in \"Fundamentals of Equipment Engineering Supervision and Related Knowledge\" and \"Equipment Supervision Contract Management\"; they only need to take the exams in \"Quality, Investment, and Schedule Control\" and \"Comprehensive Practice and Case Analysis in Equipment Supervision\". Article 7: Examination scores are managed on a rolling basis with a cycle of 2 years; those who take all 4 subjects must pass all of them within two consecutive examination years ; Those exempt from certain subjects must pass the required subjects within one examination year. Article 8: To take the exam, one must submit an application in person, obtain approval from their employer, and then go to the local examination authority with the relevant supporting documents to register. After reviewing the applications in accordance with the prescribed procedures and requirements, the examination authority issues admission tickets; candidates must use these tickets to take the exam at the designated time and place. Employees of centrally-administered enterprises, various departments of the State Council, and their directly affiliated units register for the exam in accordance with the principle of territorial jurisdiction. Article 9: The examination sites for the registration exam for equipment supervision engineers are located in colleges, universities, or schools designated for the college entrance examination in the provincial capitals and municipalities directly under the Central Government. Article 10 The syllabus for the registered equipment supervision professional qualification examination is compiled, published, and distributed by the **General Administration of Quality Supervision, Inspection and Quarantine. No entity or individual shall misuse the name of the **General Administration of Quality Supervision, Inspection and Quarantine to compile, publish, or distribute various examination books and review materials. Article 11 **The General Administration of Quality Supervision, Inspection and Quarantine or its authorized agencies are responsible for organizing the teacher training for the professional qualification examination for registered equipment supervision engineers. All regions should carry out training and continuing education in a planned and organized manner. Training institutions need to have facilities, teaching staff, textbooks, and other necessary resources. Article 12: Adhere to the principle of separating examinations from training. Personnel involved in test proposition and the organization and management of examinations shall not participate in any training related to the examinations nor take the examinations themselves. Voluntariness is the guiding principle for candidates to participate in the training. Article 13 The fee standards for the qualification examination and training for certified plant supervisors, as well as related programs, must be approved by the local price administrative authorities and made public to allow for public supervision. Article 14: The management of examination affairs must strictly adhere to examination discipline. It is necessary to effectively ensure confidentiality throughout the processes of test paper preparation, printing, distribution, and storage. Confidentiality regulations must be strictly observed to prevent any leaks of information. Article 15: Examination staff shall strictly implement the avoidance system for examinations, maintain strict order in the examination rooms, and strictly prohibit any form of fraud. Those who violate examination discipline and relevant regulations shall be dealt with strictly, and the responsibility of both the individuals involved and their supervisors shall be pursued. Measures for the Assessment and Certification of Qualifications for Registered Equipment Supervisors I. Requirements for Applying for Assessment and Certification: Professionals who have been engaged in equipment engineering supervision, as well as in the design and manufacturing of equipment for a long period of time, with outstanding achievements; those who abide by various laws and regulations, uphold professional ethics, are in good health; and who had been appointed to senior professional technical positions in the fields of technology or engineering economics by the end of 2002. They must currently be working in professional technical positions related to equipment engineering, and must meet one of the conditions specified in (i) and (ii) below. (I) Educational background and professional experience: 1. Hold a secondary vocational school diploma in engineering technology, with at least 25 years of continuous work in the design, manufacturing, or supervision of equipment engineering in a related field. 2. Hold a junior college diploma in engineering and technology; have continuously engaged in design, manufacturing, or supervision work related to equipment engineering for at least 20 years. 3. Hold a bachelor’s degree in engineering technology, and have at least 10 years of continuous experience in design, manufacturing, or supervision work related to equipment engineering. (II) Professional Experience: 1. Served as the main technical supervisor, responsible for the design, manufacturing, installation, inspection, or supervision of critical equipment for **large-scale capital construction projects**, **key technological renovation projects**, or **important research projects**. 2. Served as the chief technical officer, responsible for the design, manufacturing, installation, inspection, or supervision of key equipment for 2 **medium-scale capital construction projects, key equipment for provincial or ministerial-level technological transformation projects, or key equipment for provincial or ministerial-level research projects. 3. Become the main technical responsible person for **Science and Technology Progress Award projects in the field of equipment engineering. 4. The main technical responsible persons who have won two or more second-class or higher awards for scientific and technological progress (scientific and technological achievements) at the provincial (ministerial) level in the field of equipment engineering. 5. The main technical responsible persons who have won third-class or higher awards for scientific and technological progress (scientific and technological achievements) at the provincial (ministerial) level in the field of equipment engineering, for 3 such awards. II. Organization for Assessment and Certification: The Ministry of Personnel and the General Administration of Quality Supervision, Inspection and Quarantine (**AQSIQ for short) shall jointly establish a “Leadership Group for the Work on Assessing and Certifying the Professional Qualifications of Certified Plant Supervisors” (hereinafter referred to as the Leadership Group; the list of members is provided in Annex 1). This group is responsible for assessing and certifying the professional qualifications of certified plant supervisors nationwide. An office is established under the leadership group, located at the **General Administration of Quality Supervision, Inspection and Quarantine. III. Procedures for Assessment and Recognition (1) Professional and technical personnel who meet the aforementioned application requirements may submit an application to their employer. Upon approval by the employer, the employer will recommend them to the quality and technical supervision department of the province, autonomous region, or municipality where the employer is registered. The personnel from the various units under the departments of the State Council are recommended to the **General Administration of Quality Supervision, Inspection and Quarantine by their respective departments ; Enterprises under central management can be recommended directly to the **General Administration of Quality Supervision, Inspection and Quarantine. (II) The quality and technical supervision departments of various provinces, autonomous regions, and municipalities directly under the Central Government, as well as the relevant departments of the State Council, are responsible for reviewing the applicants from their respective regions and departments. After being reviewed by the personnel administration departments at the same level, they submit a list of recommended candidates to the office of the leading group. Applications are submitted by corporate professionals in centrally managed enterprises; they are reviewed by the enterprise’s quality management department, and after verification by the personnel department at the same level, a list of recommended candidates is submitted to the office of the leading group. (III) The office of the leading group organizes relevant experts to conduct a preliminary review of the materials submitted by candidates from various regions and departments, proposes a list of candidates to be recognized, and submits it to the leading group for approval. (IV) The leading group holds a meeting to review the materials of those who have passed the preliminary screening. Those who pass the review by the leadership team, after no objections arise following public announcement, are submitted to the Human Resources Department and the **General Administration of Quality Supervision, Inspection and Quarantine for approval, and the list is then made public. IV. Application materials for assessment and certification (1) Letters of recommendation from the personnel and administrative departments of various provinces, autonomous regions, municipalities directly under the Central Government, relevant departments, and centrally-administered enterprises. (II) Two copies of the completed “Application Form for Recognition of Professional Qualification as a Registered Equipment Supervision Engineer” (a sample form is provided in Attachment 2). (III) Copies of academic certificates or degree certificates, appointment letters for senior professional and technical positions, award certificates, and proof of signatures on the main documents related to the awarded projects. (IV) Proof of professional ethics from the employer, and proof from the project’s main technical supervisor indicating awards received by the organization. V. Application Time and Requirements (1) **A total quota is imposed on the number of individuals who can be recognized; no further recognition processes will take place after the examinations are conducted. (2) The quality and technical supervision as well as personnel administration departments of each province, autonomous region, and municipality directly under the Central Government, along with relevant departments, quality management agencies, and personnel departments in various enterprises, must submit the records of those who passed the preliminary review, arranged in order of merit, to the office of the leadership group by December 31, 2003. (III) When reviewing various certification documents submitted by applicants (such as academic or degree certificates, appointments for senior professional and technical positions, award certificates, etc.), all regions, relevant departments, and enterprises must examine the original documents ; When submitting to the Leading Group Office, copies may be sent. (IV) Those who have obtained other professional practice qualification certificates through licensing or assessment shall not apply under any circumstances. (5) All regions and relevant departments must strengthen leadership effectively, adhere to standards, and carry out the work of application, review, and re-examination in a thorough manner in strict accordance with the prescribed conditions and procedures. Those who fail to exercise proper oversight or engage in fraud will have their right to submit applications for that area or department revoked once it is discovered, and the individual’s eligibility to submit applications will also be canceled. (6) All regions and departments should give priority to recommending professional and technical personnel who meet the application requirements and are engaged in front-line equipment supervision work at equipment engineering supervision agencies. (7) All those applying for certification as a equipment supervision engineer must follow these procedures.
