Recently, the Ministry of Transport, in conjunction with the Ministry of Public Security and the Ministry of Emergency Management, issued the \"Safety Management Standards for Road Transport Enterprises Handling Hazardous Goods\" (hereinafter referred to as the \"Standards\"), further standardizing the safety management practices of such enterprises. The “Specifications” shall come into force as of the date of issuance. A relevant official from the Ministry of Transport pointed out during the interpretation that in recent years, although major and extremely serious safety accidents involving the road transport of hazardous goods have been initially brought under control, accidents of a lesser severity still occur frequently. This reveals that there are still problems and shortcomings in the industry’s safety management. Therefore, it is necessary to further strengthen the safety management practices of enterprises engaged in the road transport of hazardous goods, so as to ensure the safety of such operations. The “Regulations” consist of 7 chapters and 75 articles, further standardizing the safety management of hazardous goods transportation enterprises from 5 aspects. First, strengthen the foundation for safe production. The Standards specify the criteria and requirements for establishing safety production management agencies and appointing full-time safety production managers, the safety assessment requirements for these \"two types of personnel\" (principal persons in charge and safety production managers), as well as the requirements for regular safety meetings and safety production work conferences. The scope of expenditures for work safety funds has been refined. Second, clarify the responsibilities for work safety. The Standards specify the responsibilities of the principal persons in charge of road transport enterprises handling hazardous goods, as well as those of the safety production management departments and safety production managers. Road transport enterprises dealing with hazardous goods are required to break down the safety production responsibilities among all employees at various levels, define the responsible persons, scope of responsibilities, assessment criteria, as well as mechanisms for supervision and evaluation, in order to ensure the implementation of the safety production responsibility system. Third, improve the work safety system. The “Specifications” regulate road transport enterprises for hazardous goods, their employees, vehicles and equipment, safe production operating procedures, emergency response, parking lot management, etc. Systems regarding the safety management of personnel, safety education and training for employees, vehicle technical management, management of emergency response plans, and annual assessment, rewards, and punishments related to work safety have been improved; requirements for relevant record-keeping have also been specified. The conditions for hiring drivers have been clarified; it is required to strengthen psychological support and emotional comfort for drivers, conduct regular occupational health checks for them, and prevent abnormal behavior among drivers. The requirements regarding the provision of emergency equipment, appliances, and personal protective equipment for vehicles transporting hazardous goods have been refined. The management requirements for parking lots of road transport vehicles carrying dangerous goods have been clarified. Fourth, refine the requirements for transportation management. The Standards provide systematic regulations on basic operational procedures, the creation and use of electronic waybills, as well as vehicle dynamic monitoring management systems. Road transport enterprises carrying dangerous goods are encouraged to conduct a risk assessment of the actual transport routes prior to launching new services (new routes), identify potential safety risks, formulate corresponding preventive measures, and implement them effectively. When using atmospheric-pressure tank trucks for liquid hazardous materials to transport hazardous goods, it is required that such transportation be carried out within the scope of the business categories specified in the “Road Transport Permit” of the tank truck, as well as within the list of permissible substances for the tank as indicated in the periodic inspection report of the tank body. The prohibited scenarios for filling out electronic waybills have been specified in more detail. Road transport enterprises dealing with hazardous goods are required to strengthen the precise management of road transport vehicles carrying hazardous goods assigned red or yellow codes, in accordance with rules such as those regarding the assignment of safety codes for vehicles used for passenger transport and hazardous goods transport. Fifth, strengthen the dual prevention mechanism. The “Standards” specify the detailed requirements for the hierarchical management of safety risks and the identification and resolution of potential hazards. Road transport enterprises dealing with hazardous goods are required to conduct at least one comprehensive risk identification and assessment per year, as well as at least one inspection for potential hazards related to production safety incidents on a monthly basis. They must also establish a long-term mechanism for identifying and addressing such potential hazards.
