Article 7: Units engaged in the production, operation, and use of special equipment shall abide by this Law and other relevant laws and regulations, establish and improve systems for ensuring the safety and energy efficiency of such equipment, strengthen management in these areas, and ensure that the production, operation, and use of special equipment are safe and meet energy efficiency requirements. Interpretation of the Article: This article sets out the mandatory requirements regarding safety and energy conservation for entities that produce, operate, or use special equipment. 1. Entities that produce, operate, or use special equipment shall establish and improve safety and energy-saving management systems for such equipment, as well as post-specific safety responsibility systems. The safety and energy-saving management systems, as well as the safety responsibility systems for special equipment, refer to the systems for managing the safety and energy efficiency of special equipment, along with the job responsibility systems for the personnel in charge, which are established by the entities engaged in activities related to special equipment in accordance with this law and relevant laws, taking into account the specific circumstances of those entities. II. Article 16 of the Energy Conservation Law stipulates that energy conservation reviews and supervision shall be carried out on high-energy-consuming special equipment in accordance with the provisions of the State Council. The new \"Three Determinations\" plans for the ministries and directly subordinate departments of the State Council also specify the responsibilities regarding energy efficiency assessment and supervision of special equipment. The energy-saving review and supervision of high-energy-consuming special equipment involve establishing a working mechanism that combines safety supervision and management of such equipment with energy-saving oversight, based on the existing system for monitoring the safety of special equipment. This means avoiding the creation of new administrative permits and making use of the existing effective measures for safety supervision and management of special equipment, in order to create a working framework characterized by enterprise responsibility, appropriate guidance, interdepartmental coordination, focus on key areas, and priority given to service delivery, thereby achieving the dual goals of ensuring safety and reducing energy consumption. Following such an approach, the special equipment management systems and job responsibility systems established by entities that produce, operate, or use special equipment should cover not only safety aspects but also energy conservation aspects ; The person in charge of an organization must not only be fully responsible for the safety of the special equipment within that organization, but also bear full responsibility for its energy efficiency, in order to fulfill the organization’s primary responsibilities. III. Compliance with this Law and other relevant laws and regulations (1) This Law is a specialized law concerning the safety of special equipment; other laws related to the safety of such equipment include the Law on Administrative Licenses, the Law on Work Safety, the Product Quality Law, the Law on Inspection of Import and Export Goods, the Law on Energy Conservation, the Civil Procedure Law, the Law on Responding to Emergencies, the Law on Administrative Penalties, the Law on Administrative Coercion, the Law on Penalties for Public Order Violations, and the Criminal Law. Where this Law provides clear provisions, those provisions shall be given priority; where it does not provide such provisions, the relevant legal provisions shall still be complied with. (2) Regulations include administrative regulations and local regulations. As specific requirements and supplements for the implementation of this Law and relevant laws, such regulations shall not conflict with this Law and relevant laws, and certain provisions shall be in line with the authorities stipulated by law.
