Safety managers, inspectors, and operators of special equipment shall strictly comply with safety technical specifications and management systems to ensure the safety of such equipment. Explanation of this provision: This article deals with the requirement that safety managers, inspection officers, and operators of special equipment must hold relevant certificates to be allowed to work. 1. The safety management personnel for special equipment as stipulated in this Law include the production safety management personnel of production units, as well as the safety operation management personnel of operating and using units. Inspection and testing personnel include those engaged in self-inspection, testing, and inspection within production, operation, and usage units. Operators include personnel engaged in special safety-related trades within production activities, as well as those responsible for operating, maintaining, and servicing equipment during business operations. Given the inherent potential dangers of special equipment, its safety performance depends not only on the quality and safety of the equipment itself, but also on the related safety management, inspection and testing procedures, as well as the competence and skills of the personnel involved in its operation. To ensure the safety performance of special equipment, it is necessary to possess the appropriate knowledge and skills, as well as to ensure that safety management, inspection, and operations comply with the requirements of safety technical specifications, in order to guarantee the safe operation of the equipment. Therefore, relevant personnel must pass examinations and obtain the appropriate qualifications before they can engage in the corresponding work. This is an essential fundamental task to ensure the safe operation of special equipment, and it represents a key aspect of safety supervision work as well as a relevant system. Statistics on inspection cases and accidents show that approximately 40% of equipment damage or accidents are caused by poor management, unlicensed personnel performing tasks, lack of knowledge and skills for safe operation, and inadequate self-inspection and testing. Requiring special equipment safety managers, inspection and testing personnel, and operators to work with valid certificates is an important part of the daily safety supervision tasks carried out by special equipment supervision departments in various regions. It is necessary to strengthen supervision and conduct regular inspections; any issues identified should be dealt with in accordance with the law. Efforts must be made to ensure that 100% of personnel work with valid certificates, in order to completely eliminate accidents caused by those working without such certificates. This law does not specify which departments are responsible for conducting assessments of personnel qualifications, thereby leaving room for future reforms such as the delegation of licensing authority, changes in supervision methods, and the implementation of self-assessments; for example, the management of personnel qualifications could be handled by private organizations. II. The safety technical specifications for special equipment represent the mandatory technical requirements regarding the production, testing, modification, inspection, and testing of such equipment; they constitute the most fundamental requirements for ensuring the safety of special equipment.
