Article 83: If a special equipment user violates the provisions of this Law and commits one of the following acts, it shall be ordered to make corrections within a specified time limit; If the violation is not corrected within the prescribed time, the use of the relevant special equipment shall be ordered to be stopped, and a fine of not less than 10,000 yuan but not more than 100,000 yuan shall be imposed: (1) Using special equipment without completing the required registration procedures ; (II) Failing to establish safety technical records for special equipment, or such records not meeting the prescribed requirements, or failing to install and use registration marks or regular inspection marks in accordance with the law ; (III) Failing to carry out regular maintenance and periodic self-inspections on the special equipment in use, or failing to conduct regular calibration and maintenance of the safety accessories and safety protection devices of such equipment, while also failing to keep records thereof ; (IV) Failing to submit an application for inspection in a timely manner and undergo the inspection as required by the safety technical specifications ; (5) Failing to treat the boiler water (medium) in accordance with the requirements of safety technical specifications ; (6) Failing to formulate a special emergency plan for accidents involving special equipment. Interpretation of the provision: This article stipulates the legal responsibilities that shall be borne by entities using special equipment in case they violate relevant legal obligations. The legal responsibilities stipulated in this article are specifically addressed in the provisions of other chapters of this Law; entities that use special equipment and fail to fulfill their corresponding obligations as required shall bear the legal responsibilities specified in this article. I. Subjects liable under law The subjects liable under law as stipulated in this article are the users of special equipment, including natural persons, legal persons, and other organizations. Due to the widespread use of special equipment in production and daily life, the situations of entities that utilize such equipment are quite complex. In practice, some users of special equipment do not have their use of such equipment fall under the scope of regulation by this law, nor are they required to fulfill the corresponding obligations or bear legal responsibilities, as the use of such equipment generally does not pose a risk to the safety of the public or to production safety. For example, elevators used in private villas fall into this category. The users of these special equipment are not the entities subject to legal liability as stipulated in this article. II. Illegal acts subject to legal liability The illegal acts that equipment users of special equipment may be involved in are relatively complex, mainly including the following six categories: 1. Failing to complete the registration procedures as required. Article 33 of this Law stipulates that the users of special equipment shall, prior to the put into use of such equipment or within 30 days thereafter, register it with the department responsible for the safety supervision and management of special equipment in order to obtain a registration certificate. Failing to complete the registration process as required within the specified time frame prevents regulatory authorities from keeping track of the special equipment that is in use and from carrying out safety oversight, thus resulting in corresponding legal responsibilities. 2. Failing to establish safety technical records for special equipment, or such records not meeting the prescribed requirements, or failing to install and use registration marks or regular inspection marks in accordance with the law. Article 35 of this Law stipulates that entities using special equipment shall establish safety and technical records for such equipment; these records shall include technical materials and documents ensuring the safety of the equipment, as well as records of regular inspections and routine maintenance. Illegal acts include both the failure to establish safety technical records, and the situation where such records are established but their format and content do not meet relevant requirements, with significant omissions. Article 33 of this Law stipulates that the registration mark for special equipment shall be placed in a prominent position on such equipment ; Article 40 stipulates that the user of special equipment shall place the regular inspection mark in a prominent position on such equipment. Failing to install and use registration marks as well as regular inspection marks in accordance with the law prevents relevant personnel and law enforcement agencies from accurately determining whether the use of such special equipment meets safety requirements. 3. Failure to carry out regular maintenance and periodic self-inspections, or failure to conduct calibrations and repairs. Article 39 of this Law stipulates that the users of special equipment shall carry out regular maintenance and periodic self-inspections on the special equipment they use, and keep records thereof ; The safety accessories and protective devices of the special equipment used by them should be regularly calibrated, inspected, and records should be kept. The maintenance, inspection, calibration, and repair of special equipment are important measures to ensure the safe use of such equipment. Keeping records while implementing these measures provides an important reference for subsequent work. Illegal acts include both the failure to take such measures and the failure to keep appropriate records after taking those measures. If maintenance, inspection, calibration, and repair are entrusted to qualified other organizations, corresponding records or reports must be obtained. 4. Failing to submit an application for inspection in a timely manner as required by the safety technical specifications. Article 40 of this Law stipulates that the users of special equipment shall, in accordance with the requirements of safety technical specifications, submit a request for periodic inspection to the special equipment inspection agency one month before the expiration of the valid period of the inspection certificate. According to the regulations, those who fail to submit inspections in a timely manner as required shall bear legal responsibility. Even after submitting an application for inspection as required, those who refuse to accept or cooperate during the inspection carried out by the inspection agency shall also bear corresponding legal responsibilities. 5. The treatment of boiler water (medium) was not carried out in accordance with the requirements of safety technical specifications. Paragraph 1 of Article 44 of this Law stipulates that boiler users shall carry out treatment of the boiler water (medium) in accordance with the requirements of safety technical specifications, and shall undergo regular inspections by special equipment inspection agencies. Timely treatment of boiler water (medium) is an important measure to ensure the safe operation of boilers, and this law lays down specific provisions regarding its operational standards and legal responsibilities. 6. No specific emergency plan for special equipment accidents has been established. Paragraph 3 of Article 69 of this Law stipulates that entities using special equipment shall formulate special emergency plans for accidents involving such equipment, and conduct regular emergency drills. While stipulating that **regulatory authorities shall develop emergency plans, this law also requires entities that use special equipment to fulfill corresponding obligations. The aim is to ensure the integrity of the emergency response and rescue systems, and it represents an important measure for ensuring enterprises assume their primary responsibility for safety. III. Forms of legal liability: For the illegal acts listed in this article, the department responsible for the supervision and management of safety related to special equipment shall order rectification within a specified time limit; if such rectification is not carried out by the deadline, the use of the relevant special equipment shall be ordered to be stopped, and a fine of not less than 10,000 yuan but not more than 100,000 yuan shall be imposed. If the illegal acts committed by the entities using the special equipment listed in this article lead to accidents involving such equipment, or constitute crimes of major liability accidents or other crimes, criminal penalties shall be imposed in accordance with the law.
