Be patient and keep reading. . . 1 General Provisions 1.1 Purpose These rules are formulated in order to standardize the management of the use of special equipment and ensure its safe and economical operation, in accordance with the Law of the People’s Republic of China on Safety of Special Equipment, the Law of the People’s Republic of China on Work Safety, the Law of the People’s Republic of China on Energy Conservation, the Regulations on Safety Supervision of Special Equipment, and the Provisions on the Supervision and Management of the Implementation of Primary Safety Responsibilities by Users of Special Equipment. 1.2 Scope of Application These rules apply to the safety and energy-saving management of special equipment listed in the \"Catalogue of Special Equipment\". 1.3 Primary responsibility of the user unit: The entity that uses special equipment shall, in accordance with the provisions of these rules, be responsible for the safety and energy-saving management of such equipment, and bear the primary responsibility for ensuring its safe use and energy efficiency. 1.4 Supervision and Management 1.4.1 Division of Responsibilities The departments responsible for the supervision and management of special equipment safety in local people’s governments at or above the county level (hereinafter referred to as special equipment safety supervision departments) are tasked with overseeing the safe use of special equipment and the implementation of energy-saving measures for energy-intensive special equipment within their respective administrative areas. **The State Administration for Market Regulation oversees and provides guidance on the supervision and management of the safety of special equipment usage across the country, as well as energy conservation efforts related to high-energy-consuming special equipment. 1.4.2 The safety supervision department responsible for the registration of special equipment shall, in accordance with its statutory duties and the requirements of these rules, handle the registration process for the use of such equipment, except for those special equipment cases for which registration is not required as specified in these rules and other safety technical specifications for special equipment (hereinafter referred to as safety technical specifications). 1.4.3 Supervision and inspection: The authorities responsible for overseeing the safety of special equipment determine the key areas for supervision and inspection based on the risk level of such equipment, in accordance with the principle of categorized supervision. They formulate plans for these inspections, and conduct on-site checks to ensure the safe use of special equipment within their jurisdiction, as well as to monitor energy efficiency in equipment that consumes a large amount of energy. 1.4.4 Disclosure of information on informatization and safety conditions: The safety supervision department responsible for handling registration procedures for special equipment shall, in accordance with the regulations on informatized management of special equipment, establish a management information system for such equipment and enter and update relevant data in a timely manner. **The State Administration for Market Regulation and the provincial special equipment safety supervision departments shall publish annually to the public an overview of the safety situation regarding special equipment. Special equipment safety supervision departments at the level below the provincial level (excluding the provincial level) shall, as necessary for their work, publish information on the safety situation of special equipment within their respective administrative regions from time to time. 2 Using Units and Their Personnel 2.1 Meaning of Using Units 2.1.1 General Provisions The using units referred to in these rules are those entities that have the authority to manage the use of special equipment (Note 2-1), or natural persons with full capacity for civil conduct. These are generally the owners of the special equipment (hereinafter referred to as the property owners), or they may be the actual managers of such equipment, as determined through contractual relationships that comply with legal provisions. Special equipment is considered common property, and the co-owners may entrust a property management company or another manager to oversee such equipment; the recipient of this assignment acts as the user of the equipment ; If the co-owners have not appointed anyone, the actual manager is the entity that uses it ; In the absence of an actual manager, the co-owners serve as the using entity. When special equipment is leased out, during the lease period, the leasing party is the user ; If otherwise provided by law or agreed upon in the parties’ contract, such provisions or agreements shall prevail. Note 2-1: Entities include companies, subsidiaries, government agencies and public institutions, social organizations and other entities with legal person status, as well as branch offices with business licenses, individual industrial and commercial households, etc. 2.1.2 Special provision: For newly installed elevators whose ownership has not been transferred, the project construction unit is the user ; For elevators with a single ownership structure and managed by the owner themselves, the owner of the elevator is the entity that uses it ; For elevators managed by entities such as property service companies, the party entrusted with management is the user unit ; For elevators that are subject to shared ownership, the co-owners must entrust an entity such as a property service company, maintenance unit, or professional firm to manage the elevator, with the entrusted party acting as the user. The user of a gas cylinder generally refers to the filling unit, while for vehicle gas cylinders, non-refillable gas cylinders, and gas cylinders used in respirators, the user is the owner of the cylinder. 2.2 Main obligations of the user unit The main obligations of the user unit for special equipment are as follows: (1) Establish and effectively implement safety management systems for the use of special equipment, as well as energy-saving management systems for special equipment with high energy consumption, along with operating procedures ; (2) Special equipment that has been purchased, used, and produced with a license (including design, manufacturing, installation, modification, and repair; the same applies hereafter), and has passed inspection shall not be purchased if it has exceeded its designed service life. The use of special equipment that has been explicitly ordered to be phased out or that is already scrapped is prohibited ; (3) Establish a safety management organization for special equipment, assign appropriate safety managers and operators, and ensure that relevant personnel hold the required certificates to work ; Establish a personnel management record system, carry out safety and energy-saving training and assessments, and keep records of personnel training and assessments ; (4) Go through the registration process to obtain the \"Special Equipment Use Registration Certificate\" (the format is shown in Attachment A; hereinafter referred to as the registration certificate), and return it when the equipment is deregistered ; (5) Establish registers and technical archives for special equipment ; (6) Inspect the work performance of personnel operating special equipment, and promptly correct any illegal working practices ; (7) Establish a dual-prevention mechanism for the hierarchical control of safety risks and the identification and resolution of potential hazards related to special equipment. Develop a \"List of Safety Risk Control Measures for Special Equipment\" based on the actual conditions of the organization, and establish sound work systems for daily monitoring, weekly inspections, and monthly reviews in accordance with relevant safety management standards (guidelines and instructions) ; (8) Conduct regular maintenance and periodic self-inspections (self-testing) on in-use special equipment, in order to promptly identify and eliminate potential accident hazards ; Regularly calibrate (inspect and calibrate, the same hereafter) and maintain the safety accessories, safety protection devices, and related instruments of special equipment in use; promptly submit applications for regular inspections and energy efficiency tests, undergo such inspections and tests, and provide necessary cooperation ; (9) Develop special emergency plans for accidents involving special equipment, and conduct regular emergency drills ; Report any accidents promptly and cooperate with the investigation and handling of such incidents ; (10) Necessary investments to ensure the safety of special equipment and energy efficiency ; (11) Other obligations stipulated by laws and regulations. The user unit shall accept the supervision and inspection carried out in accordance with the law by the special equipment safety supervision authorities. 2.3 Special Equipment Safety Management Agencies 2.3.1 Responsibilities A special equipment safety management agency refers to an internal department within a user organization that is responsible for the safety management of special equipment. Units that operate high-energy-consuming special equipment can delegate their energy-saving management responsibilities to specialized agencies for the safety management of such equipment. The responsibility of the special equipment safety management agency is to implement laws, regulations, safety technical specifications, and relevant standards related to special equipment, as well as to ensure that the main obligations of the users are fulfilled ; The agencies responsible for the energy-saving management of high-energy-consuming special equipment shall also be tasked with carrying out regular energy-saving inspections and implementing energy-saving responsibility systems. 2.3.2 Special equipment users whose organizational structure meets one of the following conditions shall establish a special equipment safety management department based on factors such as the type, variety, purpose, and quantity of their special equipment, and assign a safety responsible person for each unit (set): (1) Those that use power station boilers or petrochemical and chemical processing units ; (2) Those that use elevators provided for public service operations (Note 2-2), or those that use 30 or more elevators (including 30) in places where people gather (Note 2-3) ; (3) Those that use 10 or more (including 10) large amusement rides, or 10 or more (including 10) non-road tourist vehicles that provide operational services to the public ; (4) Using a passenger aerial cableway, or a passenger cable car ; (5) Those using pressure pipelines of 50 kilometers or more (including 50 kilometers) ; (5) Use of 50 or more (including 50) special equipment units (excluding gas cylinders) (Note 2-4). Note 2-2: Entities that provide operational services to the public and use special equipment refer to those entities that utilize such equipment as a means of conducting business. Note 2-3: Public gathering places refer to schools, kindergartens, medical institutions, stations, airports, passenger terminals, shopping malls, food and beverage establishments, sports venues, exhibition halls, parks, hotels, theaters, libraries, children’s activity centers, public baths, nursing homes, etc. Note 2-4: Refers to special equipment that requires registration for use (see also clause 2.4.3.2). 2.4 Safety management personnel: The safety management personnel in entities that use special equipment include the principal responsible person, safety director, safety officers, and energy conservation managers. 2.4.1 Principal Responsible Person The principal responsible person refers to the legal representative, the person authorized by the legal representative, or the actual controller of the entity that operates special equipment; this person is fully responsible for the safety and energy efficiency of such equipment, and must organize at least one safety meeting per month. 2.4.2 Safety Director 2.4.2.1 Responsibilities of the Safety Director The safety director for special equipment refers to the person in the highest management level of the using entity who is responsible for overseeing the safety management of the use of such equipment. The concept of a safety management supervisor has been eliminated. I strongly support this; it finally frees up the person in charge of safety management, as there is no longer a need to appoint a separate person for that role in addition to the chief safety officer. The main responsibilities of the Safety Director are as follows: (1) Promote and implement laws, regulations, rules, safety technical specifications, and relevant standards related to special equipment ; (2) Organize the formulation of safety management systems for the use of special equipment in the unit (including filling, the same below), and implement a responsibility system for ensuring the safety of such equipment usage ; (3) Organize the development of special emergency plans for accidents involving special equipment, and conduct regular drills ; (4) Fulfill the obligations regarding the reporting of accidents involving special equipment and providing rescue services, and take measures to prevent the expansion of such accidents ; (5) Provide safety education and technical training for special equipment safety officers and energy conservation managers, and supervise and guide them in carrying out their relevant tasks properly ; (6) Organize the conduct of safety risk assessments for the use of special equipment in accordance with relevant regulations, and formulate and implement measures to prevent and control safety risks associated with the use of such equipment ; (7) Conduct inspections on the safety management of the use of special equipment in the unit, organize risk assessments for such equipment at least once a week, report relevant findings to the principal responsible person in a timely manner, and propose improvement measures ; (8) When the safety officer reports that a special equipment unit poses accident risks and should be taken out of use, an analysis and assessment should be conducted, appropriate measures taken, and the matter reported promptly to the person in charge of the unit ; (9) Accept and cooperate with relevant departments in carrying out safety inspections, supervision and inspection, regular inspections, and accident investigations regarding special equipment, and provide relevant materials truthfully. 2.4.2.2 Safety directors: Entities that use special equipment shall appoint safety directors. These regulations require that the safety directors of special equipment users who have established safety management organizations must hold the corresponding qualification certificates for special equipment safety managers; however, safety directors of other special equipment users are not required to hold such qualification certificates. 2.4.3 Safety Officers 2.4.3.1 Responsibilities of Safety Officers A special equipment safety officer is the person who is specifically responsible for ensuring the safety in the use of special equipment. The main responsibilities of the safety officer are as follows: (1) Organize the creation of safety technical records for special equipment, and handle the registration for their use ; (Merged) (2) Organize the formulation of safety operation procedures for special equipment ; (3) Organize safety education and skill training for operators and technical personnel of special equipment ; (4) Organize regular inspections of special equipment and keep inspection records; supervise and inspect the work of personnel operating such equipment, including their presence at their posts and the conduct of routine inspections, and correct or prevent any illegal operations ; Immediate preventive measures should be taken against any identified risks, and these issues must be reported promptly to the safety director or the person in charge of the organization ; I think this positioning is quite accurate, and it’s more practical to implement! (5) Prepare plans for regular inspections and self-inspections (self-testing) of special equipment, and ensure that such inspections, self-inspections (self-testing), as well as subsequent corrective actions are carried out ; (6) Report special equipment accidents as required, participate in the rescue efforts for such accidents, and assist with accident investigations and post-incident handling. 2.4.3.2 Safety officers: Entities that use special equipment shall assign an appropriate number of safety officers, depending on the quantity and characteristics of such equipment in their possession. These regulations require that safety officers in special equipment utilization units that have established safety management organizations, as well as those in special equipment utilization units that meet one of the following conditions, must obtain the corresponding qualification certificates for special equipment safety managers: (1) Those using boilers with a rated working pressure of 2.5 MPa or higher ; (2) Those using 5 or more (including 5) Class III fixed pressure vessels ; (3) Those engaged in the filling of mobile pressure vessels or gas cylinders ; (4) Those using pressure pipelines of 10 kilometers or more (including 10 kilometers) and less than 50 kilometers (excluding 50 kilometers) ; (5) Those that use mobile pressure vessels, or passenger towing cable cars, or less than 10 (not including 10) large-scale amusement facilities, or less than 10 (not including 10) non-highway tourist vehicles that provide operational services to the public ; (6) Entity owning the vehicle gas cylinder (excluding individual ownership) ; (7) The total number of various special equipment (excluding gas cylinders) is 20 or more (including 20). Safety officers of special equipment users who meet one of the following conditions are not required to obtain a qualification certificate for special equipment safety management personnel: (1) Those using boilers with a rated working pressure of less than 2.5 MPa ; (2) Those using 5 or fewer (not including 5) Class III fixed pressure vessels ;  (3) Those using industrial pipelines of 10 kilometers or less (not including 10 kilometers) ;  (4) The total number of various special equipment (excluding gas cylinders) is 20 or less (not including 20). Reduce the burden of evidence collection for businesses? 2.4.4 Energy conservation managers: Units that operate high-energy-consuming special equipment shall appoint energy conservation managers to be responsible for promoting and enforcing the laws and regulations regarding energy conservation in such equipment. The energy conservation managers of the boiler-using entity shall organize the formulation of the entity’s own boiler energy conservation policies, and conduct inspections on the progress of boiler energy conservation management efforts ; Establish a technical archive for boiler energy-saving measures, and organize training on boiler energy conservation ; Prepare a boiler energy efficiency testing plan to ensure the regular performance testing of boilers is carried out. 2.5 Operators 2.5.1 Responsibilities of Operators Special equipment operators must obtain the corresponding qualification certificates as required by relevant regulations. Their main responsibilities are as follows: (1) Strictly abide by the safety management regulations related to special equipment and operate in accordance with the operating procedures ; (2) Fill in records for tasks, shift handovers, etc. as required ; (3) Participate in safety education and skill training ; (4) Carry out regular maintenance, address any abnormal conditions that are detected promptly, and keep records ; (5) If potential accident hazards or other unsafe factors are identified during operation, emergency measures must be taken immediately, and reports must be submitted to the special equipment safety management personnel and the relevant responsible persons of the unit in accordance with the prescribed procedures ; (6) Participate in emergency drills to master the corresponding emergency response skills. Boiler operators shall strictly implement the boiler energy-saving management system and participate in energy-saving education and technical training for boilers. 2.5.2 Personnel Allocation: The entity operating special equipment shall assign appropriate personnel based on the quantity and characteristics of such equipment, and ensure that they work with the required certificates. When using special equipment, it is necessary to ensure that at least one operator is on duty per shift. 3 Requirements for Use Management 3.1 Safety and Energy Conservation Management Systems Equipment users of special equipment shall establish and improve management systems for ensuring safety and energy conservation in the use of such equipment, in accordance with the requirements of relevant laws, regulations, rules, and safety technical standards related to special equipment. The management system should at least include the following: (1) the safety management organization for special equipment (if necessary) and the job responsibilities of relevant personnel ; (2) Regular maintenance of special equipment, periodic self-inspections (self-testing), and related record-keeping systems ; (3) System for the registration of special equipment use, regular inspections, and applications for boiler energy efficiency testing ; (4) Systems related to the identification of safety risks associated with special equipment, the detection of potential hazards, the mitigation of such hazards, as well as the implementation of the requirements for \"daily monitoring, weekly inspections, and monthly reviews\" ; (5) Management and training system for safety managers and operators of special equipment ; (6) Management systems for the procurement, installation, modification, repair, and disposal of special equipment ; (7) Emergency rescue management system for special equipment ; (8) System for reporting and handling accidents involving special equipment ; (9) Energy-saving management system for high-energy-consuming special equipment. 3.2 The user of special equipment shall formulate operating procedures based on the operating characteristics of the equipment being used, among other factors. Operating procedures generally include equipment operating parameters, operating procedures and methods, maintenance requirements, safety precautions, regulations for periodic inspections and handling of abnormal situations, as well as corresponding records, etc. 3.3 The entities that use the technical records for the safety and energy efficiency of special equipment shall establish such records for each piece of special equipment individually. The safety technical file shall include at least the following contents: (1) Registration certificate for use ; (2) “Registration Form for the Use of Special Equipment” (format as shown in Appendix B, hereinafter referred to as the registration form) ; (3) Technical data and documents for the design and manufacture of special equipment, including design documents, product quality certification (including certificates and their data sheets, quality certificates), instructions for installation, use, and maintenance, supervision and inspection certificates, type test certificates, etc ; (4) Technical documents such as plans and drawings for the installation, modification, and repair of special equipment (Note 3-1), material quality certificates and construction quality certification documents, supervision and inspection reports for installation, modification, and repair, and acceptance reports ; (5) Records (reports) of regular self-inspections for special equipment and regular inspection reports (self-testing reports) ; (6) Records of the daily usage status of special equipment ; (7) Maintenance records for special equipment and its associated instruments and meters ; (8) Records of calibration, maintenance, and replacement of safety accessories and protective devices for special equipment, along with relevant reports ; (9) Records of operational failures and accidents involving special equipment, as well as accident handling reports. The energy-saving technology records for special equipment include boiler energy efficiency test reports, as well as technical documents related to the energy-saving renovation of high-energy-consuming special equipment. The user unit shall keep at the location where the equipment is used the documents specified in items (1), (2), (5), (6), (7), (8), and (9) of section 2.5, as well as the original or copies of the energy-saving technical records for special equipment, for future reference. Note 3-1: Pressure pipeline drawings refer to the piping single-line diagram (axonometric view). 3.4 Regular maintenance The entity using the special equipment shall carry out regular maintenance on it in accordance with the characteristics of such equipment and its condition of use; such maintenance must comply with the requirements of relevant safety technical specifications as well as the instructions provided for the use and maintenance of the product. Any abnormal conditions detected must be addressed promptly and recorded, to ensure that the special equipment in use remains in proper working condition at all times. Where the law imposes specific qualification requirements on the maintenance units, the user entity shall select entities with the appropriate qualifications to carry out the maintenance. Other users of special equipment are encouraged to choose professional and specialized maintenance organizations with the appropriate capabilities for such maintenance work. 3.5 Regular self-inspections (self-testing): To ensure the safe operation of special equipment, the entities that use such equipment shall carry out regular self-inspections (self-testing) based on the category, type, and characteristics of the special equipment in use. The timing, content, and requirements for regular self-inspections (self-testing) shall comply with the provisions of relevant safety technical specifications as well as the requirements outlined in the product’s usage and maintenance instructions. 3.6 Safety accessories and safety protection devices: The users of special equipment shall, in accordance with the requirements of safety technical specifications, organize regular calibration and maintenance of the safety accessories and safety protection devices of such equipment to ensure their reliability and effectiveness. 3.7 Periodic Inspection (1) The user unit shall submit an application for periodic inspection to the special equipment inspection agency 1 month before the expiration of the valid period for periodic inspection of the special equipment, and carry out the relevant preparatory work ; (2) For mobile (itinerant) special equipment that cannot be returned to the place where it was registered for use in order to undergo regular inspections, such inspections can be carried out at another location (i.e., not at the place of registration). After the inspection, the user entity shall submit a copy of the inspection report to the registration authority within 30 days from the date of receiving the report ; (3) After the regular inspection is completed, the user entity shall organize tasks such as the connection of pipelines, sealing, installation of accessories (including components, safety accessories, safety protection devices, instruments, etc.), and installation of internal parts for the special equipment, as well as carry out trial operations, and shall be responsible for its safety ; (4) When the inspection conclusion is satisfactory (Note 3-2), the user shall operate the special equipment in accordance with the parameters determined by the inspection conclusion. Note 3-2: In the safety technical specifications, inspection results such as “qualified”, “re-inspection qualified”, “meets requirements”, “basically meets requirements”, and “approved for use” are collectively referred to as qualified. 3.8 Risk Control and Hazard Identification 3.8.1 Risk Identification Special equipment users shall identify the sources of risk based on the specific conditions of the special equipment and its operational characteristics, conduct risk identification and grading for each source, and establish a \"Safety Risk Control List\". When the parameters of special equipment change, after modification or major repair, or when the manufacturing process changes, it is necessary to re-identify the risk sources in order to conduct risk assessment and determine their levels. 3.8.2 The safety officer responsible for identifying potential hazards shall, in accordance with the \"Safety Risk Control List\" and in compliance with relevant safety technical specifications as well as the unit’s safety management regulations, conduct daily inspections of the special equipment that is in use, and prepare a \"Safety Inspection Record\" as a result. For any identified safety risks, preventive measures should be taken immediately, and the situation should be reported promptly to the safety director or the person in charge of the organization. The Safety Director organizes risk assessments at least once a week, analyzes the status of safety management, addresses the issues identified during daily oversight, and prepares a \"Safety Assessment and Remediation Report\". The person in charge shall listen to a report on the safety management of special equipment at least once a month, summarize the daily management efforts as well as the identification and resolution of potential risks, make arrangements for the key tasks for the following month, and prepare a \"Monthly Safety Coordination Meeting Minutes\" document. 3.8.3 The entity responsible for addressing potential hazards shall, in accordance with relevant laws, regulations, rules, safety technical specifications, standards, and requirements related to risk management, promptly eliminate the accident hazards identified through inspections. For identified general accident hazards, measures should be taken promptly to prevent them from expanding or escalating ; Upon identifying potential serious accident hazards, the Safety Director shall immediately organize analysis and assessment, take corrective actions, and eliminate such hazards. Normal use can be resumed only after the hazards have been eliminated. 3.9 Handling of Abnormal Situations: When abnormal conditions are detected during the use of special equipment, the operators or maintenance personnel must immediately take emergency measures, and report to the safety management personnel in charge of special equipment at the using unit, as well as to the relevant responsible persons within the unit, in accordance with the prescribed procedures. The user unit shall promptly conduct a comprehensive inspection of the special equipment in case of malfunctions or abnormalities, identify the causes of such issues, and take effective measures immediately; if necessary, it should stop operating the equipment and arrange for inspections and tests. The equipment must not be operated while faulty or under risky conditions, and it can only be used again after the malfunctions or abnormalities have been resolved. 3.10 Emergency Plans and Accident Handling 3.10.1 Units that, in accordance with the requirements of these regulations, establish special equipment safety management departments and appoint full-time safety officers, shall develop specific emergency plans for special equipment accidents. Such plans should be tested at least once a year, with records kept of those tests ; Other user units can include provisions for emergency response to special equipment accidents in their comprehensive emergency plans, conduct emergency drills for such accidents at appropriate times, and keep records of them. 3.10.2 In the event of an accident involving special equipment, the entity using such equipment shall, in accordance with the emergency plan, take immediate emergency measures and organize rescue efforts to prevent the accident from spreading, reduce casualties and property losses. It shall also report the incident to the authorities responsible for supervising special equipment safety and relevant departments, as required by the Regulations on the Reporting, Investigation, and Handling of Special Equipment Accidents, and shall cooperate with the investigation of the accident as well as with the subsequent settlement of matters. When a natural disaster endangers the safety of special equipment, the user entity shall immediately evacuate the relevant personnel, take necessary measures to prevent the expansion of the hazard, and at the same time report to the regulatory authorities responsible for special equipment safety as well as other relevant departments. 3.11 After the relocation of special equipment, the user entity shall go through the procedures for changing the registration details. For those that are relocated as a whole, the user unit shall conduct its own inspections, and shall provide records of these inspections (self-tests) when applying for a change in registration details ; In the case of removal and reinstallation, the user entity shall select a unit that holds the appropriate permits for the installation, and shall urge the installation unit to submit a construction notification prior to carrying out the installation. In accordance with the requirements of relevant safety technical specifications, if inspection is necessary after disassembly and relocation, an application for inspection should be submitted to a special equipment inspection agency. 3.12 For safety assessment: When a special equipment unit reaches its designed service life (Note 3-3), if the user entity believes it can still be used, it must, in accordance with the requirements of safety technical specifications and relevant standards, undergo inspection or a safety assessment. Only after obtaining approval from the safety director of the user entity and authorization from the person in charge can the equipment continue to be used, following the completion of the necessary procedures for changing its registration status.
