Notice from the State Council Work Safety Committee on Issuing the \"Division of Responsibilities for Work Safety Tasks among the Member Units of the State Council Work Safety Committee\" – Anwei [2015] No. 5 To the work safety committees of all provinces, autonomous regions, municipalities directly under the Central Government, and the Xinjiang Production and Construction Corps, as well as to all member units of the State Council Work Safety Committee: The \"Division of Responsibilities for Work Safety Tasks among the Member Units of the State Council Work Safety Committee\" was approved at the full meeting of the State Council Work Safety Committee on July 28, 2015. With the approval of the leaders of the State Council, it is now issued herein; all member units are requested to comply with it. All regions and departments must earnestly implement the important directives of **** regarding the establishment of a work safety responsibility system characterized by shared responsibilities between the Party and government, dual responsibilities for each position, and joint oversight. In accordance with the unified arrangements of the State Council, they should strengthen work safety efforts in all industries and sectors. I. Industry authorities responsible for safety supervision must, in accordance with the principle that \"those who are in charge of an industry must also be responsible for its safety, those who are in charge of specific operations must ensure safety, and those who are in charge of production and business activities must prioritize safety,\" ensure the \"five aspects of implementation\" regarding safety responsibilities: First, it is necessary to implement the principle that \"the Party and government share equal responsibility,\" with the main Party and government leaders of these departments bearing overall responsibility for safety work ； Second, it is necessary to implement the principle of \"dual responsibilities for each position\" among the members of the leadership team; members of the departmental leadership teams must assume their respective responsibilities in their areas of oversight ； Third, it is necessary to implement responsibilities for safety production supervision and management in the industry, improve relevant working mechanisms, clarify job responsibilities, and strengthen professional capabilities ； Fourth, it is necessary to fulfill the duties of routine supervision, inspection, guidance, and oversight; strengthen law enforcement regarding work safety in the respective industry; carry out effective prevention and control measures for accidents; and in the event of any major or extremely serious accidents, promptly dispatch personnel to the scene to provide guidance and participate in rescue efforts and accident investigations ； Fifth, implement systems such as assessments, rewards, and punishments for work safety, as well as the “one-vote veto” mechanism. Establish a long-term mechanism for self-restraint and continuous improvement in work safety. In accordance with the principles of “whoever is in charge is responsible” and “whoever approves is responsible”, ensure that enterprises fulfill their primary responsibilities regarding work safety, and improve the work safety responsibility system within the respective industries. II. Other relevant departments must earnestly fulfill their responsibilities related to work safety, strengthen the implementation of work safety responsibilities, and provide support and guarantees for work safety efforts. III. Further improve the assessment mechanism for responsibility targets in work related to work safety, strengthen the implementation of work safety responsibilities by people’s governments at all local levels and relevant departments, and make sustained and steady progress in improving the work safety situation. Safety Production Committee of the State Council, August 27, 2015 – Division of Responsibilities for Safety Production Work among the Member Units of the Safety Production Committee of the State Council. I. General Provisions: Adhere to the philosophy of putting people first and pursuing safe development, as well as to the principles of giving top priority to safety, focusing on prevention, and adopting comprehensive management approaches. Efforts should be made to establish a mechanism in which production and business units take responsibility, employees participate, **supervision bodies oversee the situation, industry associations practice self-discipline, and society exercises oversight; each party shall perform its duties and responsibilities to jointly advance safety production efforts. The work safety supervision and management department of the State Council shall, in accordance with the law, exercise comprehensive supervision and management over work safety nationwide ； The relevant departments of the State Council responsible for safety production supervision and management carry out supervision and management of safety production in the corresponding industries and sectors within the scope of their respective responsibilities ； The relevant departments of the State Council responsible for industry regulation should regard work related to safe production as an important part of their regulatory duties. They must take on the responsibility of guiding safety management, assist production and business entities in carrying out safe production practices, formulate and implement policies and measures that promote safe production, advance the adjustment and upgrading of the industrial structure, enforce strict entry requirements for the industry, and raise the overall level of safety production within it ； Other relevant departments, in line with their own responsibilities, provide support and assurance for work related to safe production. II. Division of responsibilities for work related to work safety (1) **Development and Reform Commission. 1. Incorporate work on work safety and the prevention of occupational diseases into national economic and social development plans. In conjunction with the State Administration of Work Safety, a plan for improving the supervision and inspection capabilities of work safety regulatory agencies and coal mine safety inspection bodies was issued and implemented. Efforts were made to determine the central budgetary funds required for infrastructure related to work safety supervision and inspection, law enforcement equipment, vehicles for law enforcement and emergency rescue, information technology development, technical support systems, emergency rescue frameworks, as well as measures to address potential hazards. Supervision and inspection were also carried out on the implementation of these investment plans. 2. In accordance with the division of responsibilities, participate in supervising and guiding the closure of mines that do not conform to relevant mining industry development plans and overall plans, fail to comply with industrial policies, or have an unreasonable layout, as well as ensuring that such closures are carried out properly. (II) Ministry of Education. 1. Responsible for the safety supervision and management of the education system. Guide local authorities to strengthen the supervision and management of safety in various types of schools (including kindergartens), urge these schools to establish safety management systems and emergency response plans, and implement safety prevention measures. 2. Incorporate safety education into school curricula, guide schools in carrying out safety education activities, disseminate safety knowledge, and strengthen safety management during practical training sessions as well as extracurricular social practice activities. 3. Strengthen the development of disciplines related to safety science and engineering as well as occupational health, and accelerate the training of professionals in areas such as safe production and occupational health in coal mines and the chemical industry. 4. Work together with relevant departments to carry out tasks related to the safe management of school buses in accordance with the law. 5. Responsible for the statistical analysis of safety management in the education system; participating in the investigation and handling of relevant accidents in accordance with the law; and conducting supervision and inspections, according to their duties, on the implementation of preventive and corrective measures by entities where accidents have occurred. (III) Ministry of Science and Technology. 1. Incorporate progress in safety production technology into science and technology development plans as well as central government science and technology programs (special projects, funds, etc.), and organize their implementation. 2. Responsible for organizing and guiding major scientific and technological efforts related to work safety, as well as basic and applied research; works with relevant departments to promote the transformation and application of research results in the field of work safety. 3. Increase investment in major scientific research projects related to work safety, encourage enterprises to allocate more funds to research and development in this area, and help them gradually become the main actors in terms of investment in work safety technologies and provision of technical support. 4. In the work related to scientific and technological awards, increase support for significant research achievements in the field of work safety, and encourage societal entities to participate in scientific and technological efforts related to work safety. (IV) Ministry of Industry and Information Technology. 1. Guide the industry to strengthen safety management in production. Safety in production is taken into account comprehensively in aspects such as industry development plans, policies and regulations, and standards; industry norms and access controls are tightened; technological upgrades are carried out in traditional industries to phase out outdated processes and production capacities; key industries are guided in identifying and addressing potential hazards; industrial structure upgrading and layout adjustments are promoted; the deep integration of industrialization and informatization is facilitated; and relevant industries are guided to improve the inherent safety levels of their enterprises at the source. 2. Responsible for the supervision and management of safety in the communications industry and the construction of communication facilities, as well as in the manufacturing of civil aircraft and ships; in charge of overseeing the quality and safety aspects of shipbuilding. It formulates relevant rules, regulations, standards and norms for safety in these industries and ensures their implementation, while also coordinating emergency communications in the event of production safety accidents. 3. Responsible for the safety supervision and management of the production and sales of civilian ** goods, and organizing the investigation and handling of acts involving the illegal production, sales (including storage) of such goods in accordance with the assigned responsibilities. 4. In accordance with the division of responsibilities, it is responsible, in accordance with the law, for the industry planning and layout related to **chemical production and storage. Strictly regulate the licensing for road motor vehicle manufacturers and their products. Work with relevant departments to promote the development of the safety industry and emergency response industry. 5. Responsible for the statistical analysis of work safety in related industries, participating in the investigation and handling of relevant accidents in accordance with the law, and conducting supervision and inspections on the implementation of preventive and corrective measures by the units where accidents occur, in line with assigned responsibilities. (5) Ministry of Public Security. 1. Responsible for overseeing and regulating fire safety efforts across the country, as well as guiding and supervising local public security agencies in carrying out fire supervision, firefighting operations, emergency rescue efforts in cases of major disasters and accidents, with a focus on saving human lives. 2. Responsible for national road traffic safety management, guiding and supervising local public security agencies in preventing and handling road traffic accidents, maintaining road traffic order, as well as managing motor vehicles and drivers, and carrying out road traffic safety education and publicity. 3. Guide, coordinate, and supervise local public security organs in carrying out safety supervision over the purchase, transportation, blasting operations involving civilian explosives, as well as the transportation and detonation of fireworks and firecrackers. Monitor the flow of civilian explosives, and in accordance with their respective responsibilities, organize efforts to investigate and punish acts involving the illegal purchase, transportation, or use (including storage) of civilian explosives, as well as illegal transportation and detonation of fireworks and firecrackers. 4. Guide and supervise local public security agencies in issuing **chemicals purchase permits** and **chemicals road transport permits** in accordance with the law, and be responsible for the traffic safety management of **chemicals transport vehicles** on roads. 5. Guide and supervise local public security agencies in carrying out safety management for relevant large-scale mass events in accordance with the law. 6. Participate in the investigation and handling of relevant accidents in accordance with the law ； Responsible for guiding and supervising local public security agencies in organizing or participating, in accordance with the law, in the investigation and handling of accidents such as road traffic accidents and fire accidents; conducting statistical analyses; and, in line with assigned responsibilities, overseeing the implementation of preventive and corrective measures by the units responsible for such accidents ； Guide local public security agencies in investigating relevant criminal and public order cases. (VI) The Supervision Ministry. 1. Strengthen supervision over the entities subject to administrative oversight to ensure they fulfill their responsibilities for work safety supervision and management in accordance with the law. 2. Participate in accordance with the law in the investigation and handling of major production safety accidents, and investigate and deal with illegal and disciplinary acts such as dereliction of duty, abuse of power for personal gain, and power-money transactions involved in such accidents. 3. Urge the implementation of decisions and recommendations regarding the holding accountable of those responsible for major and severe production safety accidents. (7) Ministry of Justice. 1. Include laws and regulations on work safety as an important part of civic legal education, and work with relevant departments to widely promote and disseminate knowledge regarding such laws and regulations ； Provide guidance on legal representation, notarization, and grassroots legal services, as well as offer legal services related to safe production for enterprises and production units. 2. Responsible for the management of prison safety across the country, guiding and supervising the safety management of drug rehabilitation facilities within the judicial administration system; implementing laws, regulations, and standards related to work safety, enforcing work safety responsibility systems, improving work safety conditions, and eliminating potential accident hazards. 3. Responsible for the statistical analysis of work safety in the judicial administration system. (8) Ministry of Finance. 1. Improve economic policies such as fiscal, tax, and credit measures that support safe production, strengthen the mechanisms for ensuring investment in safety measures, and enhance support for the prevention of safety hazards, as well as for improving capabilities in supervision and oversight. 2. Guide local authorities to improve the mechanism for securing funding for work safety supervision and law enforcement, and include such funding within the financial support provided at the corresponding fiscal level. (IX) Ministry of Human Resources and Social Security. 1. Incorporate laws, regulations on work safety as well as knowledge related to work safety into the vocational education, continuing education, and training programs for employees of relevant administrative agencies and public institutions, and implement these programs; meanwhile, consider the performance in terms of work safety as an important factor in determining rewards, punishments, and evaluations for such employees. In conjunction with relevant departments, evaluations and awards are given, in accordance with **relevant regulations**, to advanced collectives and individuals in the field of work safety, as well as to organizations and individuals that have made outstanding contributions to accident rescue efforts. 2. Formulate policies, plans, and standards for work-related injury insurance; guide and supervise the implementation of relevant policies and measures for enterprises to participate in such insurance. In conjunction with departments such as those in charge of finance, health administration, and work safety supervision under the State Council, determine specific methods for determining the proportion of funds allocated to work-related injury prevention, as well as for the use and management of these funds, in order to increase investment in work-related injury prevention. Based on the results of occupational disease diagnosis, ensure proper social security for workers suffering from occupational diseases. 3. Responsible for supervising and inspecting the implementation of laws and regulations regarding labor contracts and work-related injury insurance; urging employers to conclude labor contracts in accordance with the law and enroll in work-related injury insurance, thereby regulating labor practices within enterprises ； Guide the training and education work for migrant workers. 4. Formulate policies regarding working hours, rest, and leave, and establish special labor protection policies for female employees and underage workers in accordance with their respective responsibilities. 5. Work with relevant departments to formulate and implement policies related to the planning, training, continuing education, assessment, rewards, and penalties for various professional and technical talents as well as skilled workers in the field of work safety. 6. Guide the safety management work in technical schools and vocational training institutions. Guide technical schools and vocational training institutions in carrying out education and training on safety knowledge and skills, formulate emergency response plans, and implement safety prevention measures. 7. Work with relevant departments to formulate policies regarding professional qualifications in the field of work safety, and jointly with the work safety supervision and management department of the State Council and other relevant State Council departments, develop specific measures for the classified management of registered safety engineers by specialty. (10) Ministry of Land and Resources. 1. Responsible for investigating and dealing with illegal activities such as major unauthorized exploration and mining, mining in violation of the exploration permit, and mining beyond the approved mining area boundaries, in order to maintain an orderly environment for mineral resource development. 2. In accordance with their responsibilities, they are responsible for supervising and guiding the closure of mines that operate without a mining license, engage in illegal over-limit mining, have nearly exhausted their resources, or do not comply with mineral resources planning; they also ensure that such closures are carried out properly ； Work with relevant departments to organize, guide, supervise, and inspect the remediation of abandoned mines across the country. 3. Responsible for the management of mineral resource development, organizing the formulation and implementation of mineral resource plans, and ensuring a rational allocation of exploration rights and mining rights. Responsible for managing the geological exploration industry and related qualifications, as well as strengthening supervision and inspection of geological exploration activities. (11) Ministry of Environmental Protection. 1. Responsible for the supervision and management of nuclear safety and radiation safety. Formulate relevant policies, plans, and standards; participate in emergency response to nuclear accidents; and be responsible for handling emergencies related to radiation-related environmental incidents. Supervise and manage the safety of nuclear facilities and radioactive sources, as well as prevent pollution in the areas of nuclear facility operation, application of nuclear technology, electromagnetic radiation, and the exploitation of radioactive mineral resources. Supervise and manage the control of nuclear materials and the design, manufacture, installation, and non-destructive testing of civil nuclear safety equipment. Responsible for the safe supervision and management of radioactive waste nationwide, and for overseeing nuclear and radiation safety in the transportation of radioactive materials. 2. In accordance with the division of responsibilities, it is responsible for supervising and guiding the closure of mines that cause damage to the ecological environment or cause severe pollution, as well as ensuring that such closures are carried out properly. 3. Supervise and manage the collection, storage, disposal, etc. of hazardous waste such as discarded **chemicals in accordance with the law. Organize, in accordance with the law, the assessment of the environmental hazards of **chemicals and the evaluation of their environmental risk levels, in order to identify those **chemicals that require focused environmental management; responsible for the registration of **chemicals under environmental management regulations as well as the registration of new chemical substances under such regulations ； Investigate relevant **chemical environmental pollution incidents and ecological damage events in accordance with assigned responsibilities, and be responsible for emergency environmental monitoring at the sites of **chemical accidents. 4. In accordance with the division of responsibilities, take the lead in coordinating the investigation and handling of major environmental pollution incidents and ecological damage incidents, and guide and coordinate local authorities in carrying out emergency response and early warning measures for such major sudden environmental incidents. (12) Ministry of Housing and Urban-Rural Development. 1. To exercise supervision and management over work safety in construction projects across the country in accordance with the law (with the exception of railway, transportation, water resources, civil aviation, power, and telecommunications-related construction projects for which responsibilities are defined by the State Council). Responsible for formulating policies and regulations regarding construction safety, overseeing their implementation, and investigating and dealing with any violations of laws and regulations related to construction safety in accordance with the law. Supervise the installation and use of lifting machinery and specialized motor vehicles at building sites and municipal engineering sites. 2. Organize the formulation and implementation of urban and rural planning in accordance with the law, integrate it with safety production plans and pipeline development plans, and strengthen safety oversight at the planning stage of relevant construction projects. Guide the local urban and rural planning authorities to incorporate pipeline construction route plans into local urban and rural planning management in accordance with the law, and issue planning permits for pipeline construction projects based on such planning. Guide the formulation and implementation of town, township, and village planning, as well as rural housing construction, rural housing safety, and the renovation of dilapidated houses. 3. Guide the construction, safety, and emergency management of urban municipal public facilities; oversee the safety supervision of urban water supply, gas supply, heating systems, landscaping, urban environmental management, greening in urban planning areas, sewage treatment facilities and pipelines, the development and utilization of urban underground spaces, as well as scenic spots. Work with relevant departments to strengthen guidance and supervision over the construction and management of underground pipelines, and guide local housing and urban-rural development departments to work together with relevant parties to undertake the comprehensive management of urban underground pipelines. Guide the safety supervision and management of urban subway and rail transit planning and construction. 4. Responsible for the supervision and management of work safety in the construction industry, including building construction, building installation, building decoration, surveying and design, and construction supervision, as well as in the real estate industry, covering real estate development, property management, and house expropriation and demolition. Responsible for guiding and supervising the access management for work safety of construction enterprises under the jurisdiction of provincial construction authorities, as well as overseeing the work safety education and training for employees in such construction enterprises. 5. Responsible for the statistical analysis of work safety in the construction industry, real estate sector, and housing and urban-rural development sectors; organizing or participating in investigations into relevant accidents in accordance with the law; and conducting supervision and inspections to ensure that the entities responsible for such accidents implement preventive and corrective measures as required by their duties. (13) Ministry of Transport. 1. Guide the work related to safe production and emergency management in the road and waterway industries. Formulate and supervise the implementation of safety production policies, plans, and emergency response plans for the road and waterway industries; guide the development of relevant safety production and emergency response systems; take charge of the organization and coordination of responses to major incidents in road and waterway transportation; and oversee the safety production supervision of enterprises engaged in road and waterway transportation. 2. Responsible for the supervision and management of water traffic safety. Responsible for waterway traffic control, inspection, registration of ships and related waterborne facilities, pollution prevention and control, water firefighting, navigational support, salvage operations, communication and navigation, as well as the security of ships and port facilities. Responsible for the supervision and management of the safe water transport of hazardous goods. Responsible for tasks related to crew management. Responsible for the emergency response to water traffic safety accidents in centrally managed waters, as well as pollution incidents involving ships and related waterborne facilities; also provides guidance on local supervision and management of water traffic safety. 3. Responsible for road transportation management. Guide the management of transportation routes, operating vehicles, hubs, and transportation stations ； Responsible for formulating safety standards for the operation of commercial motor vehicles and overseeing their implementation; guiding the management of vehicle maintenance and comprehensive performance testing of operational vehicles; participating in the development of policies and standards regarding vehicle retirement; in charge of managing motor vehicle driver training institutions and driver training programs ； It oversees the safety supervision and management of bus, urban subway, and rail transit operations, as well as taxi and car rental services. 4. Responsible for the supervision and management of work safety in highway and waterway construction projects. Formulate policies, systems, and technical standards related to the construction of road and waterway projects in accordance with regulations, and supervise their implementation. Organize and coordinate the supervision and management of work safety in the construction of key highway and waterway projects, guide the management and maintenance of transportation infrastructure, and take charge of the management and maintenance of relevant important facilities. 5. Guide and organize special rectification efforts for work safety in the transportation industry in accordance with assigned responsibilities. Guide various regions in organizing the implementation of highway security projects and strengthening the construction of road traffic safety facilities ； Responsible for investigating and addressing issues such as overloading of ships, as well as cracking down on illegal activities involving the operation of ships without licenses, permits, or that are already scrapped ； Guide or cooperate with relevant departments in investigating and dealing with illegal activities such as vehicle overloading, as well as the operation of vehicles without licenses, permits, or that are already scrapped. 6. Guide the licensing for the road and water transport of hazardous goods, as well as the safety management of transportation vehicles and the qualification assessment of personnel. Formulate standards related to dangerous goods in accordance with the scope of responsibilities. 7. Responsible for managing the impacts of river sand mining on waterway safety and navigation. 8. Guide safety assessments for transportation enterprises, the development of safety production standardization, as well as safety training and education for employees. 9. Responsible for the statistical analysis of work safety in the transportation industry; organizing or participating in the investigation and handling of related accidents in accordance with the law; and conducting supervision and inspections to ensure that the units responsible for such accidents implement preventive and corrective measures as required by their duties. (14) Ministry of Water Resources. 1. Responsible for work related to safe production in the water resources sector, organizing and guiding the safety supervision and management of reservoirs, hydropower dam projects, rural hydropower stations, and their associated power grids. 2. Organize and implement supervision and management of work safety in water conservancy project construction; formulate, in accordance with relevant regulations, policies, systems, technical standards for water conservancy project construction, as well as emergency response plans for major accidents, and supervise their implementation. 3. Responsible for organizing, coordinating, and guiding the unified management and supervision of sand mining activities in the main streams of the Yangtze River downstream of Yibin ； Take the lead in overseeing the supervision and management of sand mining in rivers, and be responsible for ensuring that such activities do not affect flood control safety, river flow stability, or dike safety. 4. Responsible for the risk mitigation and reinforcement of dangerous reservoirs. 5. Guide and supervise the training, education, assessment of work safety for professionals in the water resources sector. 6. Responsible for the statistical analysis of work safety in the water resources sector, participating in the investigation and handling of related accidents in accordance with the law, and conducting supervision and inspections to ensure that the units responsible for such accidents implement preventive and corrective measures as required by their duties. (15) Ministry of Agriculture. 1. Guide safe production in the agricultural sector, formulate policies, plans, and emergency response plans for safe production in this sector, and implement them. 2. Guide the safe production of fisheries. It represents **the authority to exercise supervision and management over fishery policies, fish ports, and fishing vessels; to supervise and manage traffic safety in fish port waters in accordance with the law; and to be responsible for the supervision and management of fish ports, fishing vessels, and fishery workers.** 3. Guide the safe production of agricultural machinery. Guide the safety of agricultural machinery operations and maintenance management ； In accordance with the division of responsibilities, it provides legal guidance on agricultural machinery registration, safety inspections, accident handling, as well as the training, assessment, and certification of agricultural machinery drivers. 4. Guide grassland fire prevention work. Responsible for the supervision and management of pesticides, and provides guidance on safety in their use. Guide the comprehensive development and utilization of renewable energy in rural areas. Guide the safe production in the livestock and poultry slaughtering industry. 5. Responsible for the statistical analysis of work safety in the agricultural sector; organizes or participates in the investigation and handling of related accidents in accordance with the law; and conducts supervision and inspections to ensure that the units responsible for such accidents implement preventive and corrective measures as required by their duties. (16) Ministry of Commerce. 1. Collaborate with relevant departments to carry out supervision and management of work safety in the commerce and service industries (including the catering and accommodation sectors); supervise and manage industries such as auctions, pawnbroking, leasing, automobile distribution, second-hand goods circulation, as well as the distribution of refined petroleum products, in accordance with relevant regulations; and provide guidance on the recycling of renewable resources. Guide and supervise trade and distribution enterprises to implement laws and regulations on work safety, strengthen safety management, and put in place safety prevention measures. 2. In conjunction with relevant departments, guide and urge the domestic entities of enterprises engaged in foreign investment and cooperation to strengthen work on safety production in their overseas investment and cooperation projects. 3. Cooperate with relevant departments in investigating and dealing with violations of work safety laws and regulations by commercial and distribution enterprises. (17) Ministry of Culture. 1. Within the scope of its responsibilities, it oversees and supervises work related to safe production in the cultural industry in accordance with the law, formulates policies on safe production in this sector, organizes the development of emergency response plans for incidents in the cultural industry, and strengthens emergency management. 2. Within the scope of its duties, it shall, in accordance with the law, conduct supervision and inspections on the compliance of Internet access service establishments, entertainment venues, as well as commercial performances and cultural and artistic activities, with relevant laws and regulations regarding work safety. 3. Responsible for the supervision and management of safety in institutions under the cultural sector, guiding cultural organizations such as libraries, museums, cultural centers (stations), and cultural heritage sites, as well as major cultural events and grassroots cultural activities, to strengthen safety management and implement safety precautions. 4. Strengthen the promotion of laws, regulations, and knowledge related to work safety, and work with relevant departments to carry out major campaigns on work safety. 5. Responsible for the statistical analysis of work safety in the cultural market and cultural systems; participating in the investigation and handling of related accidents in accordance with the law; and conducting supervision and inspections to ensure that the units responsible for such accidents implement preventive and corrective measures as required by their duties. (18) **National Health and Family Planning Commission. 1. In accordance with the division of responsibilities, be responsible for the supervision and management of occupational health and radiation health. 2. Responsible for the safety management work within the health and family planning system. Guide medical and health institutions, family planning technical service agencies, etc. in formulating safety management systems and emergency response plans, implementing safety prevention measures, and ensuring the proper handling of medical waste and radioactive materials. 3. Coordinate and guide medical and health rescue efforts in case of production safety accidents, and organize emergency medical assistance for severe and major production safety accidents. (19) State-owned Assets Supervision and Administration Commission of the State Council. 1. In accordance with the responsibilities of the owners of state-owned assets, it is tasked with overseeing and ensuring that central state-owned enterprises implement the Party’s and the state’s guidelines and policies on work safety, as well as relevant laws, regulations, and standards. It also guides and urges these enterprises to strengthen work safety management and assume full responsibility for work safety matters. 2. Urge the principal officials of central state-owned enterprises to fulfill their responsibilities as the primary persons in charge of work safety as well as the enterprise’s work safety responsibility system, and conduct assessments of these officials regarding work safety. 3. In accordance with relevant regulations, participate in or organize inspections and audits regarding the safety production and emergency management of central state-owned enterprises, and urge such enterprises to implement various safety prevention measures and actions to address potential hazards. 4. Participate in the investigation of particularly serious production safety accidents in central state-owned enterprises, and be responsible for implementing the relevant regulations regarding the pursuit of accountability for such accidents. 5. Urge central state-owned enterprises to carry out comprehensive planning, incorporate work safety into their medium- and long-term development plans, and ensure the health and safety of their employees. (20) State Administration for Industry and Commerce. 1. Handle industrial and commercial registration for matters related to pre-approval requirements for work safety strictly in accordance with the law. 2. Cooperate with relevant departments in carrying out special campaigns for safe production, and investigate and deal with illegal activities such as operating without a license in accordance with legal provisions and division of responsibilities ； For production and business entities whose licenses or other approval documents have been revoked or canceled by the relevant licensing authorities in accordance with the law, or whose licenses or other approval documents have reached their expiration date, such entities shall, upon notification from the relevant departments, carry out change registration or cancellation registration in accordance with the law. In cases where they engage in related business activities without authorization on a serious scale, their registration shall be revoked or their business licenses shall be cancelled in accordance with the law; meanwhile, cooperation shall be provided to the relevant departments in order to investigate and shut down production and business entities that operate without proper safety production (operational) permits. 3. Work with relevant departments to strengthen safety inspections of commodity trading markets and encourage market organizers to enhance safety management in accordance with the law. (21) General Administration of Quality Supervision, Inspection and Quarantine. 1. Responsible for overseeing and managing the safety of special equipment nationwide, and bearing the responsibility for comprehensively managing the inspection and supervision of such equipment. Manage the safety inspection and supervision of special equipment such as boilers, pressure vessels, pressure pipelines, elevators, lifting machinery, passenger cableways, large-scale amusement facilities, and specialized motor vehicles used within sites (factories). 2. Supervise and manage the production (including design, manufacturing, installation, modification, repair), operation, use, inspection, testing, and import/export of special equipment. 3. Supervise and manage the qualifications of special equipment inspection and testing institutions, as well as those of inspection and testing personnel and operators. 4. Be responsible, in accordance with the law, for the supervision and management of the quality and safety of products that ensure occupational safety as well as those that affect production safety. Responsible for managing the industrial product production licenses of enterprises that manufacture **chemicals and their packaging and containers, and for supervising the quality of such products in accordance with the law; also responsible for inspecting imported and exported fireworks, **chemicals, and their packaging. 5. Responsible for, in conjunction with relevant departments, organizing the formulation and revision of work safety **standards in line with the needs of technological progress and industrial upgrading. 6. Responsible for the statistical analysis of safety production in special equipment, organizing or participating in the investigation and handling of related accidents in accordance with the law, and conducting supervision and inspections to ensure that the units responsible for such accidents implement preventive and corrective measures as required by their duties. (22) National Press and Publication, Radio, Film and Television Administration. 1. Responsible for guiding and supervising the safety management of news, publishing, broadcasting, film, and television institutions as well as their facilities and equipment; assisting in overseeing safe production practices in the printing industry; guiding and coordinating major national broadcasting, television, and film events; promoting the development of emergency broadcasting systems; formulating safety regulations related to news, publishing, broadcasting, film, and television, as well as plans for dealing with major emergencies, and implementing these plans. 2. Organize and guide news, publishing, broadcasting, film, and television institutions as well as news media to carry out publicity and education on work safety; cooperate with relevant departments in carrying out major campaigns on work safety; and exercise public opinion supervision over actions that violate work safety laws and regulations. (23) General Administration of Sport. 1. Responsible for the supervision and management of the safe operation of public sports facilities. 2. In accordance with relevant regulations, it is responsible for supervising and guiding the safety management of high-risk sports events, major sports competitions and activities, as well as the issuance of sports lottery tickets. 3. Be responsible for the safety management of the units under this system, supervise and inspect the implementation of relevant safety laws and regulations by these units, and ensure that safety precautions are put in place. (24) **Forestry Bureau. 1. Fulfill the responsibilities for supervision and management of forestry safety production in accordance with the law. Responsible for guiding the safety supervision and management of units such as forest areas, forestry farms, nature reserves, and forest parks. 2. Responsible for the statistical analysis of safety production in the forestry sector, participating in the investigation and handling of related accidents in accordance with the law, and conducting supervision and inspections to ensure that the units responsible for such accidents implement preventive and corrective measures as required by their duties. (25) **Tourism Bureau. 1. Responsible for the supervision and management of tourism safety, and carries out oversight of tourism safety within the scope of their duties. Guide local authorities in carrying out supervision and inspections of travel agency companies regarding work safety and emergency management, and guide scenic areas to establish safe conditions suitable for opening in accordance with the law. 2. Work with **relevant departments to implement comprehensive management of tourism safety, and cooperate with them to strengthen the safety management of tourist transport services. 3. Responsible for publicity, education, and training related to national tourism safety management. 4. Responsible for the statistical analysis of safety production in the tourism industry, participating in the investigation and handling of related accidents in accordance with the law, and conducting supervision and inspections to ensure that the units responsible for such accidents implement preventive and corrective measures as required by their duties. (26) Legislative Affairs Office of the State Council. 1. Responsible for reviewing the draft laws and administrative regulations on work safety submitted by relevant departments to the State Council, and for drafting or organizing the drafting of important draft laws and administrative regulations on work safety. 2. Responsible for the filing and review of local regulations on work safety, local rules, and departmental rules issued by the State Council. 3. Responsible for the specific handling of matters related to the interpretation of administrative regulations on work safety, handling administrative reconsideration cases regarding work safety that are submitted for decision by the State Council, and providing guidance and supervision over administrative reconsideration work related to work safety across the country. (27) China Meteorological Administration. 1. Establish and improve a coordinated mechanism for the monitoring, forecasting, and early warning of meteorological disasters; based on weather and climate changes as well as the needs of disaster prevention and mitigation efforts, provide relevant regions and departments with information on meteorological disaster monitoring, forecasting, early warning, and disaster risk assessment in a timely manner. Responsible for providing meteorological support for the prevention and control of safety production incidents as well as emergency rescue in case of accidents. 2. Perform, in accordance with the law, the duties of supervision and management regarding the safety prevention of lightning disasters; organize the formulation of policies and measures related to safe production and supervise their implementation; participate, as required by law, in investigations into relevant accidents; and provide guidance to provincial meteorological authorities in their supervision and management tasks. 3. Work together with relevant departments to guide the supervision and management of safe production for unmanned free balloons and tethered balloons, organize the formulation of policies and measures related to safe production, and supervise their implementation. Responsible for safety inspections and accident prevention during human-induced weather modification operations. (28) **Energy Bureau. 1. Formulate and implement energy development strategies, plans, and policies; organize the development of industrial policies and relevant standards for various forms of energy such as coal, oil, natural gas, electricity, new energy, and renewable energy, as well as for industries related to oil refining, coal-based fuels, and fuel ethanol. Formulate and implement policies and measures conducive to work safety; guide and urge the energy industry to strengthen work safety management, strictly enforce industry entry requirements, and improve the overall level of work safety in the industry. 2. Coordinate relevant parties in carrying out coalbed methane development, phasing out outdated coal production capacity, and managing and utilizing gas from coal mines; formulate relevant standards and policy measures, and work with relevant departments to promote the merger and restructuring of coal enterprises. 3. Responsible for compiling recommendations regarding the allocation of central government funds for energy-related construction projects; approving and reviewing energy investment projects that fall within the planned scope and annual budget limits in accordance with established authorities; and incorporating the requirement of simultaneous installation of safety facilities into the project management process. 4. Responsible for nuclear power management, and organizing emergency response efforts in case of nuclear accidents at nuclear power plants. 5. Responsible for the supervision and management of safe electricity production, reliability management, and electricity emergency response; formulates regulations regarding the safety of electricity operation, the safety of electricity infrastructure construction, and the supervision and management of project quality, excluding nuclear safety, and organizes the enforcement of these regulations. It is also responsible for the supervision and management of the safety of hydropower station dams. Guide and supervise the training, education, assessment work related to safe production in the power industry, and organize the promotion and application of new technologies for safe power production. 6. To be responsible, in accordance with the law, for the protection of oil and gas pipelines nationwide, and to coordinate major issues related to pipeline protection across provinces, autonomous regions, and municipalities directly under the Central Government. The organization approves oil and gas pipeline construction projects that cross provinces, autonomous regions, and municipalities directly under the Central Government. Organize the formulation and implementation of national plans related to pipeline development, and coordinate the integration of pipeline plans across provinces, autonomous regions, and municipalities directly under the Central Government with other specific plans. Draft or revise standards and specifications related to oil and gas transmission pipelines within the scope of responsibilities. It organizes the advancement of research and development on major equipment in the oil and gas pipeline industry, guides scientific and technological progress as well as the introduction, adaptation, and innovation of complete sets of equipment, and coordinates relevant major demonstration projects as well as the adoption of new processes, technologies, and equipment. It directs and supervises the energy authorities of various provinces, autonomous regions, and municipalities directly under the Central Government to oversee pipeline protection work within their respective administrative areas in accordance with the law, and to coordinate the resolution of major issues related to pipeline protection in those areas. Guide and supervise oil and gas pipeline companies to fulfill their primary responsibilities for safe production, strengthen daily safety management, and ensure the safe operation of the pipelines. 7. Responsible for statistical analysis related to safe production in the power industry and the protection of oil and gas pipelines; organizing or participating in investigations into relevant accidents in accordance with the law; and conducting supervision and inspections to ensure that the entities responsible for such accidents implement preventive and corrective measures as required by their duties. (29) **State Administration of Science, Technology and Industry for National Defense. 1. Responsible for the supervision and management of work safety in the nuclear, aerospace, aviation, shipbuilding, arms, and military electronics industries (excluding civilian nuclear facilities, civilian aircraft, and civilian ships), as well as in the military systems; it also provides guidance, coordination, and oversight regarding work safety in these relevant industries and military systems. 2. Organize the formulation of safety production policies, standards, and regulations for the military industry sector, and oversee their implementation; guide the advancement of safety production standardization and the development of a credibility system within this sector. 3. Take the lead in **emergency management for nuclear accidents, and be responsible for the safety supervision and management of military nuclear facilities. 4. Responsible for the statistical analysis of work safety in related industries and the military industry sector; participating in the investigation and handling of relevant accidents in accordance with the law; and conducting supervision and inspections to ensure that the units responsible for such accidents implement preventive and corrective measures as required by their duties. (30) **Oceanic Administration. 1. Responsible for conducting fishery law enforcement inspections outside the no-fishing zone lines for bottom trawling on motorized fishing vessels, as well as in fishing areas where specific fishery resources are found; and organizing investigations to handle disputes related to fishery production. Participate in maritime emergency rescue operations, organize or take part in the investigation and handling of accidents that occur in marine fishery production in accordance with the law, investigate and handle related marine environmental pollution incidents within the scope of authorized powers, and conduct supervision and inspections to ensure that the units responsible for such incidents implement preventive and corrective measures as required by their duties. 2. Responsible for formulating systems for marine observation and forecasting, surveillance and monitoring of sea areas and islands, as well as marine disaster alerts, and overseeing their implementation; organizing the development and execution of plans for marine observation networks; issuing marine forecasts, results of surveillance and monitoring of islands and their surrounding sea areas, marine disaster alerts, and related reports; establishing a system to ensure marine environmental safety; and participating in the emergency response to major marine disasters. (31) **Railway Bureau. 1. Responsible for the supervision and management of safe railway operations; formulating regulations for the supervision and management of railway transportation safety, project quality safety, and equipment quality safety, and implementing such regulations. It also carries out the administrative permits stipulated by law, provides guidance and oversight over railway administrative law enforcement, and investigates and deals with any illegal or irregular activities that pose a threat to railway safety in accordance with the law. 2. Organize the supervision of railway transportation safety, handle administrative permits related to railway transportation in accordance with the conditions and procedures stipulated by laws and regulations, and assume corresponding responsibilities; organize the formulation of policies and measures to regulate the order of the railway transportation market and supervise their implementation. 3. Organize the formulation of policies and measures to regulate the market order in railway engineering construction, and supervise their implementation; also organize the supervision of the quality and safety of railway projects as well as the bidding processes for such projects. 4. Organize the supervision of the quality and safety of railway equipment products; handle administrative approvals such as those related to the design, production, maintenance, and import of railway locomotives and vehicles, as well as the certification of enterprises that produce railway transportation safety equipment, in accordance with the conditions and procedures stipulated by laws and regulations, and assume corresponding responsibilities. 5. Responsible for the safety supervision and management of the railway transport of hazardous goods and their transport vehicles. 6. Responsible for organizing the monitoring and analysis of railway operation safety, conducting statistical analyses on safety production in the railway industry; organizing or participating, in accordance with the law, in emergency rescue efforts and investigations related to accidents; and overseeing, within the scope of one’s responsibilities, the implementation of preventive and corrective measures by the units involved in such accidents. (32) Civil Aviation Administration of China. 1. Responsible for the supervision and management of work safety in the civil aviation industry. Draft relevant laws, regulations, rules, policies, and standards; formulate relevant plans and programs as required, and supervise their implementation. Organize the development and application of major safety-related science and technology projects in civil aviation, advance the informatization of safety management, and provide guidance on safety education and training as well as safety-related science and technology activities in the civil aviation industry. 2. Assume responsibility for overseeing flight safety and ground safety in civil aviation. Responsible for the approval and supervision of civil aircraft operator qualifications, aviation personnel qualifications, qualifications of aviation training institutions, flight training equipment, maintenance unit qualifications, and civil aviation products; in charge of regulating the air transport of hazardous materials and conducting evaluations of civil aircraft operations; responsible for overseeing airport flight procedures and minimum operational standards. 3. Responsible for overseeing air traffic management in civil aviation, as well as for managing and supervising civil aviation communication, navigation, and surveillance services, aeronautical information services, and aeronautical meteorological services. 4. Undertake the responsibilities for civil aviation air defense safety supervision. Responsible for the supervision and management of civil aviation security, civil aviation safety inspections, as well as the supervision and management of airport fire fighting and rescue operations. 5. Formulate standards for civil aircraft accidents, and organize and coordinate emergency responses to civil aviation incidents. 6. Responsible for the supervision and management of the construction and safe operation of civil airports. Responsible for the management of site selection, master planning, approval of engineering designs, and issuance of usage permits for civil airports; undertakes management related to emergency rescue at civil airports, protection of the airspace around them, and supervision over the safe operation of fuel supply enterprises within airports. Also responsible for the supervision and management of the quality and safety of civil aviation-related construction projects. 7. Responsible for the statistical analysis of work safety in the civil aviation industry; organizes or participates in the investigation and handling of relevant accidents in accordance with the law; and, according to its responsibilities, supervises and inspects the implementation of prevention and rectification measures by entities where accidents have occurred. (33) **Post office. 1. Responsible for the supervision and management of work safety in the postal industry, as well as for the monitoring, early warning, and emergency management of operational safety within this sector, in order to ensure the security of postal communications and information. 2. Regulate the postal market in accordance with the law, be responsible for determining the market access conditions for postal services such as express delivery, supervise and inspect whether delivery companies comply with relevant laws and regulations as well as implement safety measures, and investigate and deal with illegal activities related to the delivery of chemicals, flammable and explosive substances, etc., in line with the law. 3. Responsible for the statistical analysis of safety production in the postal industry, participating in the investigation and handling of related accidents in accordance with the law, and conducting supervision and inspections to ensure that the units responsible for such accidents implement preventive and corrective measures as required by their duties. (34) National Federation of Trade Unions. 1. Supervise work related to work safety and the prevention of occupational diseases in accordance with the law, reflect the demands of workers, put forward suggestions and opinions, protect the legitimate rights and interests of workers, and supervise enterprises and individual industrial and commercial households regarding their compliance with labor protection laws and regulations. 2. Investigate major issues related to the legitimate rights and interests of employees in work safety, and participate in the drafting of policies, measures, systems, as well as draft laws and regulations concerning work safety that affect the vital interests of employees. 3. Guide local trade unions to participate in training and education activities related to workers’ labor safety and health. Carry out mass-based activities for work safety and health, mobilize employees to engage in collective supervision of work safety and the identification of potential hazards, implement safety responsibilities at each employee’s post, and promote community-based prevention and control. 4. Participate in accordance with the law in the investigation and handling of especially serious production safety accidents and severe occupational disease hazard incidents, and represent employees in supervising the implementation of preventive and corrective measures by the entities responsible for such incidents. (35) General Administration of Work Safety. 1. Organize the drafting of comprehensive laws and regulations on work safety, formulate policies and plans for work safety, guide and coordinate work safety efforts across the country, manage overall work safety statistics nationwide, analyze and predict the work safety situation across the country, release information on work safety, and coordinate the resolution of major issues related to work safety. 2. Assume the responsibility for comprehensive supervision and management of work safety; exercise comprehensive supervision and management powers in accordance with the law; guide, coordinate, and supervise the work safety efforts of relevant departments of the State Council as well as the people’s governments of various provinces, autonomous regions, and municipalities directly under the Central Government; monitor and assess the implementation of work safety targets and report thereon; and oversee the investigation of accidents and the enforcement of accountability measures. 3. Assume responsibility for the supervision and management of work safety in the industrial, mining, and commercial sectors; in accordance with the principles of hierarchical classification and territorial jurisdiction, conduct legal inspections to ensure that enterprises in these sectors comply with work safety laws and regulations, as well as to oversee their work safety conditions and the proper use of relevant equipment (including special equipment used in offshore oil drilling and in underground operations in non-coal mines, excluding other types of special equipment), materials, and personal protective equipment. It is also responsible for supervising the work safety of enterprises in these sectors that are under central government oversight. 4. Assume responsibility for the management of safety access requirements for non-coal mining enterprises under central oversight, as well as for enterprises engaged in the production and operation of chemicals and fireworks; organize, guide, and supervise the implementation of the safety access system in accordance with the law ； Responsible for the comprehensive supervision and management of chemical safety, as well as the supervision and management of work safety in the production and operation of fireworks and firecrackers. 5. Responsible for drafting regulations related to occupational health supervision, formulating rules and regulations concerning occupational health supervision for employers, and organizing the development of relevant standards within **occupational health standards. Responsible for conducting inspections and supervision regarding occupational health in employers, and overseeing, in accordance with the law, the implementation by employers of relevant laws, regulations, and standards related to the prevention and control of occupational diseases. Organize the investigation and handling of occupational disease hazard incidents as well as illegal and irregular acts. Responsible for supervising and managing the declaration of occupational disease hazard projects by employers. Responsible for the supervision and management of technical service agencies that conduct occupational health testing and evaluation. 6. Work with relevant departments to formulate and implement development plans and annual plans for safety production standards. Formulate and issue regulations, standards, and procedures for safe production in the industrial, mining, commercial, and trade sectors, and implement them; supervise and inspect the development of safety production standards, the monitoring of major hazard sources, as well as the identification and rectification of potential serious accidents; and, in accordance with the law, take action against industrial, mining, commercial, and trade enterprises that do not meet the requirements for safe production. 7. Responsible for organizing comprehensive safety inspections and special audits by the State Council; authorized by the State Council, to carry out investigations into particularly serious production safety accidents in accordance with the law and to handle such cases to conclusion, while overseeing the implementation of measures taken to address these accidents and hold those responsible accountable. Conduct supervision and inspection, in accordance with the division of responsibilities, on the implementation of preventive and corrective measures by entities involved in accidents in the industrial, mining, commercial, and trade sectors. 8. Responsible for the comprehensive supervision of emergency management in work safety, organizing, directing, and coordinating emergency rescue efforts related to work safety; working with relevant departments to enhance the emergency response capabilities for work safety incidents, and improving the national emergency rescue system for work safety. 9. Responsible for the comprehensive supervision and management of coal mine safety inspections; formulating major policies related to work safety in the coal industry; establishing norms and standards for this industry as required; guiding coal mining enterprises in achieving work safety standardization, promoting relevant technological development, and carrying out the consolidation and closure of coal mines; providing opinions on major coal mining construction projects; and reviewing projects related to technical upgrades for coal mine safety as well as the comprehensive management and utilization of methane gas, in conjunction with relevant departments. 10. Guide and supervise the implementation of the principle of \"simultaneous design, construction, and commissioning\" for safety facilities and occupational health measures in construction projects within the scope of responsibilities. 11. Organize, guide, and supervise the assessment of operational qualifications for special operation personnel (excluding those working in coal mines and those involved in special equipment operations), as well as the assessment of safety production knowledge and management skills for the principal persons in charge and safety production managers of production and business units in sectors such as non-coal mines, **chemicals, fireworks, and metal smelting. It also oversees safety production training in industrial, mining, commercial, and trading enterprises, as well as occupational health training provided by employers. 12. Guide and coordinate national safety assessment and work related to safety production testing and inspection; supervise professional service agencies in the field of safety production, such as those engaged in safety assessments, safety production testing and inspection, and the issuance of safety signs; oversee and guide the qualification examinations for registered safety engineers as well as their registration processes. 13. Guide, coordinate, and supervise administrative law enforcement efforts related to work safety across the country. 14. Organize the formulation of scientific and technological plans for work safety, and guide and coordinate major scientific and technological research and dissemination efforts related to work safety, as well as the informatization of work safety. 15. Carry out international exchanges and cooperation in the field of work safety. 16. Undertake the daily work of the State Council Work Safety Committee and the main responsibilities of its office. (36) **Coal Mine Safety Supervision Bureau. 1. Formulate policies for safe coal mining operations, participate in the drafting of laws and regulations related to safe coal mining, develop relevant rules, procedures, and safety standards, establish industry norms and standards for the coal sector as required, and propose plans for safe coal mining operations. 2. Assume **responsibilities for coal mine safety supervision, and inspect and guide local** coal mine safety supervision and management work. Supervise and inspect the local authorities’ implementation of laws, regulations, and standards related to coal mine safety production, the consolidation and closure of coal mines, safety inspections and law enforcement in this area, special campaigns to improve coal mine safety, the rectification of potential accident hazards and subsequent reviews, as well as the holding accountable of those responsible for coal mine accidents; meanwhile, provide suggestions and recommendations to the local authorities and relevant departments. 3. Assume responsibility for the supervision and management of access to safe coal mining operations; implement the system for ensuring safe coal mining in accordance with the law; guide and manage the assessment and issuance of certificates related to coal mining safety, as well as carry out inspections; and oversee relevant safety training programs. 4. Responsible for formulating regulations related to the supervision of occupational health in coal mines, and organizing the drafting of standards related to occupational health in such mines. Responsible for the supervision and inspection of occupational health in coal mines, and oversees, in accordance with the law, the implementation by coal mines of relevant laws, regulations, and standards regarding the prevention and control of occupational diseases. Organize the investigation and handling of occupational disease hazards and illegal and irregular activities in coal mines. Responsible for reviewing the professional capabilities of technical service institutions engaged in occupational health services in the coal mining and processing industry, as well as for guiding and supervising occupational health training in coal mines. Responsible for guiding and supervising the submission of applications related to occupational disease hazards in coal mines. 5. Responsible for carrying out focused, special, and regular inspections on the safe production in coal mining enterprises; monitoring, in accordance with the law, the compliance of such enterprises with safety production laws and regulations, as well as the safety conditions of their production facilities and equipment (including special equipment used underground in coal mines), and taking legal action against any illegal or non-compliant activities. 6. Organize or participate in the investigation and handling of coal mine production safety accidents in accordance with the law, supervise the implementation of such investigations and handling, and analyze the situation of coal mine production safety accidents and occupational disease hazards across the country. 7.
