How should entities that cause environmental pollution and other public nuisances be punished?
Article 63 of the newly revised Environmental Protection Law stipulates that if enterprises, institutions, and other producers and operators violate legal provisions by discharging pollutants without obtaining a permit for such discharge, and refuse to stop such discharge despite being ordered to do so, and if their actions do not constitute a crime, in addition to being punished in accordance with relevant laws and regulations, the environmental protection authorities at or above the county level, or other relevant departments, shall transfer the case to the public security authorities. Those who cause damage due to environmental pollution and ecological destruction shall bear tort liability in accordance with the relevant provisions of the Tort Liability Law of the People’s Republic of China.
