Hello everyone. The \"Code for Fire Protection Design of Oil and Gas Engineering Projects\" GB50183-2015 keeps getting postponed. Although the Ministry of Housing and Urban-Rural Development has stated that the 2004 version should be used until a new standard is released, design firms and safety assessment agencies still refer to the provisions of the 2015 version. Is this considered an error? Or do the requirements in the new standard exceed those of the old standard, and can they be cited even though they have not been officially implemented?

Anything that has not been formally implemented does not have legal validity; the current standards and regulations must be followed. Even if a notice has been approved, it is the date of implementation rather than the date of issuance that matters. The legal standards applicable to all design documents are based on the date the contract is signed. If standards and regulations are updated before the design documents are delivered, in principle the design agency should try to follow the new standards, but this is not mandatory. For example: It takes several years to complete the construction of a large chemical plant. If updated regulations suddenly change the requirements regarding fire safety distances, and the design does not provide enough extra space for these distances, it is not possible to ask the builders to demolish everything and start over. However, not all enforcement officers are aware of the requirements set out in the documents issued by the Ministry of Construction; they always try to apply the new standards.
