On July 27, 2016, the Beijing Environmental Protection Bureau conducted an investigation into Beijing Yujia Tiancheng Auto Parts Co., Ltd. and found that the company had piled up industrial solid wastes such as waste mineral oil and empty containers contaminated with waste mineral oil in an arbitrary manner, without establishing any storage facilities for such wastes. The aforementioned actions by Beijing Yujia Tiancheng Auto Parts Co., Ltd. violate the provisions of Article 33, Paragraph 1 of the Law of the People’s Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes. In accordance with Article 68, Paragraph 1, Item (2) and Paragraph 2 of the Law of the People’s Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes, the Beijing Environmental Protection Bureau has decided to order Beijing Yujia Tiancheng Auto Parts Co., Ltd. to cease its illegal activities, to make corrections within 30 days, and to pay a fine of 20,000 yuan. According to available information, used mineral oil is oil that has become unusable due to contamination by impurities, as well as oxidation and thermal effects, which have altered its original physical and chemical properties, and thus needs to be replaced ; Primarily derived from sludge and residues generated by oil extraction and refining ; Precipitates formed during the storage of mineral oils ; Oil for replacement in machinery, power, transportation, and other equipment, as well as oil residues and filtering media from the regeneration process. It is classified as hazardous waste in accordance with the provisions of the **List of Hazardous Wastes**. When handling used mineral oil, it is necessary to attach a label to the container in which it is stored, at an appropriate location; the label must be clear and legible, and must not be obscured or contaminated in any way. Waste mineral oils such as waste diesel, waste kerosene, waste gasoline, waste dispersed oil, and waste rosin oil, whose closed-cup test flash point is 60°C or lower, shall be labeled as “flammable”. Law of the People’s Republic of China on the Prevention and Control of Environmental Pollution by Solid Wastes (amended on April 24, 2015) (issued on December 29, 2004, implemented on April 1, 2005, amended on April 24, 2015) Article 68: Those who violate the provisions of this Law and commit any of the following acts shall be ordered by the environmental protection administrative department at or above the county level to cease such illegal activities, make corrections within a specified time limit, and be fined: (1) Failing to register industrial solid wastes in accordance with the relevant regulations, or engaging in fraud during the registration process ; (II) Failing to store temporarily unused or unusable industrial solid waste in facilities or locations designated for safe classification, or failing to take measures for harmless disposal of such waste ; (III) Transferring equipment that has been included in the list for phased out use to others for their use ; (IV) Those who arbitrarily shut down, leave idle, or dismantle facilities and sites for preventing and controlling environmental pollution caused by industrial solid waste ; (5) Constructing facilities and sites for the centralized storage and disposal of industrial solid waste, as well as landfills for domestic waste, in nature reserves, scenic spots, drinking water source protection areas, protected farmland areas, and other areas that require special protection ; (6) Illegally transferring solid waste out of the administrative regions of provinces, autonomous regions, and municipalities directly under the Central Government for storage or disposal ; (7) Failing to take appropriate preventive measures, resulting in the dispersion, loss, leakage of industrial solid waste or causing other environmental pollution ; (8) Those who discard or scatter industrial solid waste along the way during transportation. Whoever commits any of the acts specified in item 1 or item 8 of the preceding paragraph shall be fined not less than 5,000 yuan but not more than 50,000 yuan ; Whoever commits any one of the acts specified in items 2, 3, 4, 5, 6, or 7 of the preceding paragraph shall be fined not less than 10,000 yuan but not more than 100,000 yuan.
